Chapter I General Provisions Article 1 These Measures are formulated in accordance with the provisions of relevant laws and regulations and in the light of the actual situation of this Municipality in order to strengthen the management of urban housing use safety, safeguard public safety and ensure the safety of people and property. Article 2 These Measures shall apply to the housing safety management activities that are legally built on state-owned land within the administrative area of this Municipality and completed, accepted and delivered for use.

The use safety management of houses, fire safety of houses, elevators, gas, water supply and other professional facilities and equipment of the military, religious groups, historical buildings and cultural relics protection units shall be implemented in accordance with the provisions of relevant laws and regulations. Article 3 The term "house use safety management" as mentioned in these Measures refers to the management activities to ensure the safe use of houses, including the safe use of houses, the appraisal of house safety, the management of dangerous houses and the supervision and inspection of dangerous houses. Article 4 The safety management of house use shall follow the principles of territorial management, prevention first, rational use and standardized governance to ensure the safety of house use. Article 5 The municipal, district (county) people's governments shall strengthen the organization, leadership and comprehensive coordination of the housing use safety management within their respective administrative areas, formulate the housing use safety supervision and management system and emergency plan, and organize to deal with housing use safety emergencies.

City, district (county) real estate administrative department is the administrative department in charge of housing safety supervision and management within their respective administrative areas.

Public security, finance, land and resources, construction, planning, urban management, industry and commerce, quality supervision, safety supervision and other departments shall, according to their respective functions and duties, do a good job in the safety management of housing use.

Township (town) people's governments and sub-district offices shall cooperate with the real estate administrative departments to do a good job in the safety management of housing use. Article 6 The municipal, district (county) people's governments shall incorporate the funds for housing use safety management into the fiscal budget to ensure the smooth development of housing use safety investigation, safety appraisal, crisis relief subsidies and emergency rescue. Seventh real estate administrative departments should regularly organize housing use safety surveys, establish housing use safety management files, build information platforms, implement dynamic management and enjoy information. Township (town) people's governments and sub-district offices shall assist in the safety investigation of housing use. Eighth real estate administrative departments should strengthen the guidance and supervision of property management, housing use safety appraisal and other units; The construction administrative department shall strengthen the guidance and supervision of the work of the construction industry, decoration and other industry associations. , support trade associations to carry out their work according to law, and give play to the role of trade associations in the safety management of housing use. Article 9 The acts and related information of housing survey, design, construction, supervision units, housing decoration enterprises, housing use safety appraisal institutions and property service enterprises that violate laws, regulations and the provisions of these Measures shall be loaded into their credit files by the administrative departments of construction and real estate, and announced to the public. Tenth real estate administrative departments, news media, property service enterprises and other units should take various forms to carry out publicity and education, popularize the laws, regulations and knowledge of housing use safety management, and raise public safety awareness. Eleventh any unit or individual has the right to report and complain about houses that endanger the use safety of houses or have major security risks. After receiving reports and complaints, the real estate administrative department shall register and accept them, and inform the informants and complainants of the handling within 15 working days. Chapter II Safety Management of House Use Article 12 The owner of a house is the person responsible for the safety of house use and is responsible for the safety of house use. If the owner of the house is inconsistent with the actual user and manager, the owner of the house shall not refuse to bear the responsibility for the safety of the use of the house on the grounds that there is an agreement with the actual user and manager.

Because the property right is unclear or the whereabouts of the owner of the house are unknown, the owner of the house cannot bear the responsibility for the use of the house, and the actual user and manager of the house shall fulfill the responsibility of the person responsible for the use of the house.

The management unit of state-owned public housing is the responsible person for the safety of state-owned public housing. Thirteenth people responsible for the use of housing safety shall bear the following responsibilities for the use of housing safety:

(two) inspection and maintenance of houses, timely management of housing security risks;

(four) commissioned by the housing safety appraisal;

(5) Take other necessary measures to ensure the safe use of the house. Fourteenth prohibit the following acts endangering the safety of housing use:

(1) Dismantling or destroying walls, beams, slabs, piers, columns and other main bodies and load-bearing structures without the consent of the original design unit or a design unit with corresponding qualification grade;

(two) the demolition of non-load-bearing structures with overall seismic and fire prevention functions;

(three) excessive increase in housing load;

(4) reduce the indoor elevation of the bottom floor;

(five) installation of facilities and equipment that affect the structural safety of buildings;

(six) unauthorized change of housing purposes;

(seven) excavation and expansion of the basement;

(eight) other acts that endanger the safety of housing use.
