Regulations of Hebei Province on Road Transportation

Chapter I General Provisions Article 1 These Regulations are formulated in accordance with the Regulations of the People's Republic of China on Road Transport and other relevant laws and administrative regulations, in combination with the actual situation of this province, in order to standardize the market order of road transport, ensure the safety of road transport, protect the legitimate rights and interests of the parties involved in road transport and promote the healthy development of road transport. Article 2 These Regulations shall apply to road transport operations, road transport-related businesses and their supervision and management activities within the administrative area of this province.

The road transport business as mentioned in these Regulations includes urban bus passenger transport, shuttle bus passenger transport, chartered passenger transport, tourist passenger transport, taxi passenger transport, freight transport and other activities.

Road transport related businesses include road transport station (field) operation, motor vehicle maintenance, motor vehicle driver training, car rental and other activities. Article 3 The development of road transport industry shall follow the principles of overall planning, scientific development, energy conservation and environmental protection, safety and convenience, give priority to the development of public transport, promote the development of transportation and logistics industry, and promote urban-rural integration and regional coordinated development. Article 4 The people's governments at or above the county level shall strengthen their leadership over the management of road transport, incorporate the transportation development plan into the national economic and social development plan, coordinate the coordinated development of road transport and other modes of transport, implement preferential policies for land use and taxation, and ensure the funds for road transport management and emergency disposal. Fifth transportation departments of the people's governments at or above the county level shall be responsible for the management of road transport within their respective administrative areas.

Road transport management institutions at or above the county level shall be responsible for the specific implementation of road transport management.

The relevant departments of the people's government at or above the county level, such as development and reform, public security, finance, housing and urban and rural construction, supervision and management of production safety, industry and information technology, quality and technical supervision, administration of industry and commerce, taxation, etc., shall, according to their respective functions and duties, do a good job in road transportation. Article 6 Whoever engages in road transport business or road transport-related business shall, in accordance with the conditions stipulated in laws, administrative regulations and these Regulations, go through the relevant registration procedures with the administrative department for industry and commerce according to law, obtain the corresponding business license, and engage in business activities in accordance with the approved business license items.

Foreign investors investing in road transport operations and road transport-related businesses shall abide by the laws, administrative regulations and relevant provisions of China. Article 7 People's governments at or above the county level and their relevant departments and road transport operators shall implement the responsibility for road transport safety, formulate relevant emergency plans, organize regular drills, conduct safety education and professional ethics training for employees, investigate hidden dangers of accidents, and take effective preventive measures to ensure road transport safety. Article 8 Road transport and related businesses are encouraged to implement large-scale and intensive operations, use energy-saving and environment-friendly vehicles that meet national standards, and promote the application of information technologies such as big data, cloud computing, electronic payment and the Internet in the field of operation and management. Article 9 Road transport industry associations shall establish and improve the industry self-discipline system, standardize and guide the business behaviors of their members, safeguard their legitimate rights and interests, participate in the research, formulation and publicity of road transport-related policies and industry standards, and promote the healthy development of the road transport industry. Article 10 Any unit or individual has the right to complain and report the illegal business operations of road transport.

The transportation department of the people's government at or above the county level and the road transport management institution shall establish and improve the acceptance and reward system for complaints and reports, publish the service supervision telephone number, and handle the complaints and reports according to law. Chapter II Road Transport Operation Section 1 General Provisions Article 11 Passenger vehicles shall not carry goods in violation of regulations, and freight vehicles shall not transport passengers.

Passenger transport operators shall provide school bus services in accordance with the laws and administrative regulations on school bus management. Article 12 Employees engaged in road transport business shall obtain corresponding qualifications according to law and carry relevant certificates. Thirteenth road transport operators should establish and improve the road transport management system, and abide by the following provisions:

(a) to fulfill the main responsibility of road transport safety production;

(two) according to the law for its road transport vehicles to the relevant road transport management agencies to apply for road transport documents, and carry them with the car;

(three) in accordance with national regulations and standards, regular maintenance and testing of road transport vehicles, to ensure that the technical condition of vehicles is good, emissions meet national and provincial environmental standards;

(4) Installing electronic signs and satellite positioning terminal equipment for road transport vehicles according to national regulations and standards, and not dismantling electronic signs, closing satellite positioning terminal equipment or shielding satellite positioning terminal equipment signals without authorization;

(five) establish and improve all kinds of ledgers and files, and truthfully submit relevant materials and information to the road transport management institution in accordance with the relevant provisions. Article 14 road transport operators engaged in road transport business activities shall implement the system of clearly marked prices and use invoices or tickets supervised by tax authorities in accordance with regulations. If government pricing or government-guided pricing is implemented, fees shall be charged according to the approved standards; if market-regulated pricing is implemented, the normal price order shall be consciously maintained. Fifteenth passenger and freight drivers who drive continuously for four hours should stop and rest for not less than twenty minutes; The cumulative driving time of bus passenger, chartered passenger and tourist passenger drivers within twenty-four hours shall not exceed eight hours.
