Regulations of Sichuan Province on Intangible Cultural Heritage

Chapter I General Provisions Article 1 In order to inherit and carry forward the excellent traditional culture of the Chinese nation and strengthen the protection and preservation of intangible cultural heritage, these Regulations are formulated in accordance with the Law of People's Republic of China (PRC) on Intangible Cultural Heritage and other laws and administrative regulations, combined with the actual situation of Sichuan Province. Article 2 These Regulations shall apply to the protection and preservation of intangible cultural heritage within the administrative area of Sichuan Province.

The intangible cultural heritage as mentioned in these Regulations refers to various forms of traditional cultural expressions handed down from generation to generation by people of all ethnic groups and regarded as part of their cultural heritage, as well as objects and places related to traditional cultural expressions. Including:

(1) traditional oral literature and the language as its carrier;

(2) Traditional arts, calligraphy, music, dance, drama, folk art and acrobatics;

(3) Traditional skills, medicine and calendars;

(4) Traditional etiquette, festivals and other folk customs;

(5) Traditional sports and entertainment;

(6) Other traditional cultural expressions.

Objects and places that are part of intangible cultural heritage are all cultural relics, and the relevant provisions of laws and regulations on the protection of cultural relics shall be observed. Article 3 "Protection" as mentioned in these Regulations refers to the measures taken to inherit and spread the intangible cultural heritage that embodies the excellent traditional culture of the Chinese nation and has historical, literary, artistic and scientific value; Preservation refers to the identification, recording and archiving of intangible cultural heritage. Article 4 The protection and preservation of intangible cultural heritage shall follow the principles of giving priority to protection, giving priority to rescue, rational utilization and inheritance and development, adhere to the principles of government-led, departmental responsibility and social participation, and pay attention to its authenticity, integrity and inheritance, which is conducive to strengthening national unity and promoting social development. Article 5 The local people's governments at or above the county level shall strengthen their leadership over the protection of intangible cultural heritage, establish a coordination mechanism for the protection of intangible cultural heritage, incorporate the protection and preservation of intangible cultural heritage into the national economic and social development plan at the corresponding level, and include the protection and preservation funds in the fiscal budget at the corresponding level. Article 6 Local people's governments at or above the county level shall give support to the protection and preservation of intangible cultural heritage in ethnic minority areas, old revolutionary base areas, remote areas and poverty-stricken areas in terms of funds, personnel training and facilities construction. Seventh local people's governments at or above the county level shall be responsible for the protection and preservation of intangible cultural heritage within their respective administrative areas.

The relevant departments of development and reform, finance, education, human resources and social security, ethnic and religion, press and publication, radio and television, tourism, urban and rural planning, commerce, health and family planning, sports, poverty alleviation and immigration are responsible for the protection and preservation of intangible cultural heritage within their respective functions and duties.

Township (town) people's governments and sub-district offices shall assist in the protection and preservation of intangible cultural heritage. Article 8 The local people's governments at or above the county level shall strengthen the publicity on the protection of intangible cultural heritage, and can combine the local intangible cultural heritage work with community education, vocational education, compulsory education and preschool education, popularize the knowledge of intangible cultural heritage, and enhance the awareness of intangible cultural heritage protection in the whole society. Article 9 Citizens, legal persons and other organizations are encouraged and supported to participate in the protection of intangible cultural heritage according to law.

Organizations and individuals that have made outstanding contributions to the protection of intangible cultural heritage shall be commended and rewarded in accordance with relevant state regulations. Chapter II Investigation of Intangible Cultural Heritage Article 10 Local people's governments at or above the county level shall organize the investigation of intangible cultural heritage according to the needs of the protection and preservation of intangible cultural heritage.

The cultural administrative department of the local people's government at or above the county level is responsible for the investigation of intangible cultural heritage, and comprehensively grasps its type, quantity, distribution, living environment and protection status; Other relevant departments may investigate the intangible cultural heritage within their scope of work. Eleventh citizens, legal persons and other organizations can provide clues and materials of intangible cultural heritage to the local cultural authorities, and can also conduct intangible cultural heritage surveys according to law. Twelfth overseas organizations or individuals to carry out the investigation of intangible cultural heritage in Sichuan Province, shall apply to the competent cultural department of the provincial people's government, indicating the contents, objects, time, place, organization or personnel of the investigation; The competent cultural department of the provincial people's government shall make a written decision on approval or disapproval within twenty days from the date of accepting the application.

Overseas organizations shall cooperate with domestic intangible cultural heritage academic research institutions when conducting intangible cultural heritage surveys in Sichuan Province.

Overseas organizations or individuals shall, within 30 days after the end of the investigation, submit the investigation report and copies of the pictures and materials obtained in the investigation to the competent cultural department of the provincial people's government. Thirteenth investigation of intangible cultural heritage shall obtain the consent of the respondents, respect their customs and religious beliefs, and shall not damage their legitimate rights and interests, and shall not illegally occupy or damage the relevant materials, objects, buildings and places of intangible cultural heritage. Article 14 The competent cultural department of the local people's government at or above the county level shall establish a list of endangered intangible cultural heritage projects, and take timely rescue measures to give priority protection to intangible cultural heritage projects that are found to be in danger of disappearing through investigation or other means.
