Chapter I General Provisions

Article 1 These Measures are formulated in accordance with Article 11 of the Law of People's Republic of China (PRC) Municipality on Medical Practitioners and the relevant provisions of the qualification examination for doctors in order to standardize the traditional medicine and the qualification examination for doctors with real expertise.

Article 2 These Measures are applicable to those who study traditional medicine by way of apprenticeship or who have acquired professional knowledge for many years in clinical practice of traditional medicine and do not have medical professional qualifications to take the doctor qualification examination.

Article 3 Examination refers to the qualification evaluation and identification of those who have traditional medical knowledge and those who have expertise to apply for the doctor qualification examination. It is divided into the assessment of learning from traditional medicine (hereinafter referred to as apprentice assessment) and the assessment of traditional medical skills and expertise (hereinafter referred to as expertise assessment).

Article 4 state administration of traditional chinese medicine is responsible for the supervision and administration of the qualification examination for doctors of Chinese medicine teachers and personnel with practical expertise.

Article 5 Traditional medicine as mentioned in these Measures refers to traditional Chinese medicine and minority medicine.

Chapter II Introduction Evaluation

Sixth apprentice assessment by the provincial administrative department of traditional Chinese medicine specific organization and implementation.

Seventh apprentices should have a high school education or equivalent, and study with the teacher for three consecutive years.

Article 8 A tutor of an apprentice shall meet the following conditions:

(1) Having the qualifications of practicing doctors of traditional Chinese medicine and ethnic medicine;

(two) engaged in clinical work of traditional Chinese medicine or ethnic medicine 15 years or more, or with the qualifications of professional and technical positions above the deputy chief physician of traditional Chinese medicine or ethnic medicine;

(3) Having rich clinical experience and unique technical expertise;

(four) abide by the law, abide by professional ethics, good reputation;

(five) adhere to the clinical practice in medical institutions, can complete the teaching task.

Article 9 An apprentice shall sign a master-apprentice relationship contract with his mentor in a unified style in state administration of traditional chinese medicine.

The apprenticeship contract shall be notarized by a notary office at or above the county level, and the study time with the teacher shall be counted from the date of notarization.

Tenth instructors are not allowed to bring more than two teachers at the same time.

Eleventh the form and content of apprenticeship shall be formulated by the provincial administrative department of traditional Chinese medicine.

Article 12 Apprenticeship assessment should include professional ethics and professional level, focusing on the basic knowledge and skills of traditional medicine, the inheritance of academic experience and technical expertise; Methods include comprehensive written examination and clinical practice skill examination.

The specific assessment contents, standards and methods shall be formulated by state administration of traditional chinese medicine.

Article 13 An apprentice who applies for apprenticeship examination shall fill in the Application Form for Traditional Medicine Apprenticeship Examination uniformly printed by state administration of traditional chinese medicine, and submit an application to the provincial administrative department of traditional Chinese medicine after examination and approval by the administrative department of health and the administrative department of traditional Chinese medicine.

Article 14 An applicant applying for an apprenticeship examination shall submit the following materials:

(a) the traditional medicine teacher assessment application form;

(2) my identity certificate;

(3) Two two-inch bareheaded frontal half-length photos;

(four) proof of academic qualifications or academic ability;

(five) the instructor's doctor qualification certificate, doctor's practice certificate, professional and technical post qualification certificate, or the certificate issued by the administrative department of health and the administrative department of traditional Chinese medicine that he has been engaged in the clinical work of traditional Chinese medicine and ethnic medicine for more than 0/5 years;

(6) A notarized master-apprentice relationship contract;

(seven) other materials required by the administrative department of traditional Chinese medicine at or above the provincial level.

Fifteenth provincial administrative departments of traditional Chinese medicine shall examine the materials submitted by the applicants, and issue an admission ticket if they meet the examination conditions; Those who do not meet the evaluation conditions shall accept the application within 15 working days and explain the reasons to the applicant.

Sixteenth apprenticeship assessment is conducted once a year, the specific time is determined by the provincial administrative department of traditional Chinese medicine, and it is announced within the jurisdiction three months before the assessment begins.

Seventeenth apprentices who pass the examination shall be awarded the certificate of state administration of traditional chinese medicine unified style by the provincial administrative department of traditional Chinese medicine.

Chapter III Professional Evaluation

Eighteenth appraisal by the municipal health administrative department and the administrative department of traditional Chinese medicine organization and implementation.

Article 19 To apply for appraisal and evaluation, the following conditions shall be met:

(a) engaged in clinical practice of traditional medicine for more than 5 years according to law;

(two) to master the unique, safe and effective traditional medical diagnosis and treatment technology.

Twentieth expertise assessment should include professional ethics and professional level, focusing on the basic knowledge of traditional medicine and unique diagnosis and treatment technology and clinical basic operation; Methods include comprehensive written examination and clinical practice ability examination.

The specific assessment contents, standards and methods shall be formulated by state administration of traditional chinese medicine.

Article 21 The personnel applying for appraisal shall fill in the Application Form for Appraisal of Traditional Medical Skills in a unified style in state administration of traditional chinese medicine, and apply to the municipal health administrative department and the administrative department of traditional Chinese medicine with the consent of the local county-level health administrative department.

Twenty-second applications for appraisal and evaluation shall submit the following materials:

(a) an application form for the identification of traditional medical skills;

(2) my identity certificate;

(3) Two two-inch bareheaded frontal half-length photos;

(four) the materials issued by the health administrative department at the county level where the applicant is located to prove his years of clinical practice in traditional medicine;

(five) materials issued by two or more medical practitioners to prove that they have mastered the unique, safe and effective traditional medical diagnosis and treatment technology;

(six) other materials required by the administrative department of health and the administrative department of traditional Chinese medicine at or above the municipal level.

Twenty-third expertise assessment is conducted once a year, the specific time is determined by the municipal health administrative department and the administrative department of traditional Chinese medicine, and the assessment work is announced within the jurisdiction 3 months before the start.

Twenty-fourth those who pass the examination shall be issued by the administrative department of health and the administrative department of traditional Chinese medicine in charge of organizing the examination, and shall be reported to the provincial administrative department of traditional Chinese medicine for the record.

Chapter IV Physician Qualification Examination

Article 25 The examination of doctors' qualifications for students and professionals is an examination to evaluate whether the applicants for doctors' qualifications have the professional knowledge and skills required for practicing, and it is an integral part of the national examination of doctors' qualifications.

Twenty-sixth examination methods for the qualification of doctors are divided into practical skills examination and comprehensive written examination. Only those who pass the practical skills test can take the comprehensive written test.

The specific content and scheme of the examination shall be formulated by the Examination Committee for Physician Qualification of the Ministry of Health.

Article 27. After obtaining the Master Apprentice Certificate of Traditional Chinese Medicine or the Professional Skills Certificate of Traditional Chinese Medicine, students who have completed the 1 year probation period in the medical institutions of the provinces (autonomous regions and municipalities directly under the Central Government) that awarded the Master Apprentice Certificate of Traditional Chinese Medicine or the Professional Skills Certificate of Traditional Chinese Medicine and passed the examination may apply for the qualification examination of practicing assistant doctors.

Twenty-eighth students and professionals who have obtained the practicing certificate of practicing assistant doctors and have been engaged in traditional medical work in medical institutions for five years may apply for taking the qualification examination for practicing doctors.

Twenty-ninth students and professionals who apply to take the doctor qualification examination shall register at the prescribed test center office and submit the following materials:

(1) Two two-inch bareheaded frontal half-length photos;

(2) my identity certificate;

(3) Apprentice Certificate of Traditional Medicine or Professional Certificate of Traditional Medicine;

(4) A probation certificate issued by a probation institution;

(5) Where an assistant practicing physician applies for the qualification examination of a practicing physician, it shall submit a copy of the qualification certificate of the assistant practicing physician and the practicing certificate of the physician;

(six) other materials required for the review.

Other application procedures shall be implemented in accordance with the relevant provisions of the doctor qualification examination.

Thirtieth the organization, management and implementation of the qualification examination for doctors who study under the teacher and doctors who really have expertise shall be implemented in accordance with the relevant provisions of the qualification examination for doctors.

Thirty-first teachers and professionals in the doctor qualification examination qualified line determined by the Ministry of health doctor qualification examination committee.

Those who pass the examination will be awarded the "Physician Qualification Certificate" uniformly printed by the Ministry of Health.

Chapter V Punishment

Thirty-second applicants and those who do have expertise in evaluation are disqualified from participating in the evaluation in the current year in any of the following circumstances. If the case constitutes a crime, criminal responsibility shall be investigated according to law:

(a) false name, age, education, length of service, nationality, household registration, school status and forged documents, certificates and files, to obtain the qualification to apply;

(2) Disrupting the evaluation order in the evaluation;

(3) bribing the examiners;

(4) Threatening or publicly insulting or slandering examiners;

(5) Other serious frauds.

Article 33 The staff of the administrative department of health and the administrative department of traditional Chinese medicine, in violation of the relevant provisions of these measures, issue false certificates and provide false files in the evaluation, practice fraud, neglect their duties, abuse their powers, engage in malpractices for selfish ends, which do not constitute a crime, shall be given administrative sanctions according to law; If a crime is constituted, criminal responsibility shall be investigated according to law.

Thirty-fourth in the process of doctor qualification examination, there are violations of discipline, according to the relevant provisions of the doctor qualification examination violations of punishment.

Chapter VI Supplementary Provisions

Article 35 The term "clinical practice of traditional medicine" as mentioned in these Measures refers to those who have obtained effective medical qualifications, or those who have not obtained effective medical qualifications but are engaged in traditional medical practice activities under the guidance of traditional Chinese medicine doctors and ethnic medicine doctors.
