The third session of the Fifth National People's Congress of People's Republic of China (PRC) passed the Marriage Law of the People's Republic of China, and decided to implement it as of 198 1 and 1. This marriage law is the basic principle of marriage and family relations in China, and it is an important law related to the vital interests of every household, men, women and children. Its implementation is of great significance to effectively protect citizens' legitimate rights and interests in marriage and family, family harmony and personal happiness, and even the healthy development of the whole society. Party organizations and political organs at all levels should conscientiously carry out extensive and in-depth publicity and education in the army, strengthen the management of the marriage problems of all officers and men, advocate the new socialist fashion in marriage and family relations, oppose the bad style of feudal capitalism, crack down on illegal acts that abuse and hurt women and the elderly, strengthen the concept of obeying the law, and ensure the smooth implementation of the new marriage law in the army.

Our army shoulders the glorious mission of defending and building the motherland. In order to purify and consolidate the army, improve the combat effectiveness of our army, and strengthen the unity between the army, the government and the people, we hereby make the following interim provisions on issues related to the implementation of the Marriage Law of the People's Republic of China:

First, about the age of marriage.

The new marriage law stipulates: "The age of marriage shall not be earlier than 22 for men and 20 for women. Late marriage and late childbearing should be encouraged. " The army should also abide by this rule. But the legal age for marriage is the minimum age for marriage, that is, you can't get married before this age, but you must get married at this age. Therefore, it is necessary to educate unmarried cadres, soldiers and workers, actively respond to the call of the party and the government, and not to fall in love and get married prematurely.

After the marriage of active servicemen, both husband and wife have the obligation to carry out family planning, and strongly advocate that a couple should have only one child.

Second, about the spouse conditions and marriage problems of cadres.

The spouses chosen by military cadres must be China citizens with clear history, progressive thinking, reliable politics, decent work style and no serious infectious diseases. It is forbidden to marry counter-revolutionaries and bad elements. Generally speaking, it is not allowed to marry the immediate family members of counter-revolutionaries and bad elements, or the relatives of people engaged in counter-revolutionary activities in foreign countries and Hongkong, Macao and Taiwan Province provinces; If the other person's history is clear, there is no political problem and the reality is good, he can also be allowed to get married as appropriate. Spouses of confidential personnel should be clear in history, progressive in thinking, politically reliable, and have no complicated social relations or overseas relations.

After establishing a love relationship, cadres should take the initiative to report to the party organization, and the party organization and political organs should conduct necessary political review of their love objects. Regarding the investigation of asking local authorities for certification materials of cadres' lovers, it shall be handled in accordance with the spirit of Item 1 and Item 3 of Article 1 of the Provisions on Investigation Certification Materials issued by the Organization Department of the Central Committee, the United Front Work Department of the Central Committee, the Ministry of Public Security and the General Political Department of the Military Commission on February 20th 1979.

During the study in school, students are generally not allowed to get married except in some special circumstances. The Navy, Air Force, National Defense Science and Technology Commission and the Political Department of the Second Artillery Corps may make necessary supplementary provisions on the marriage of naval personnel, aircrew and personnel engaged in cutting-edge core secrets of national defense, and report them to the General Political Department for the record.

Third, about the love and marriage between soldiers and workers.

In order to strengthen combat readiness and improve military-civilian relations, soldiers are not allowed to find objects within the army and in the station. In principle, volunteers are not allowed to find objects in troops or stations. However, for orphans and people who are injured and disabled in the line of duty and have difficulty finding a partner in their original place, finding a partner in the army or the resident can be considered as a special case and reviewed and approved by political organs at or above the military (independent division).

Soldiers are not allowed to get married before completing active service. Soldiers and volunteers who have extended their service are allowed to take home leave to get married. Any soldier who has decided to be demobilized and has extended his service, if he proposes to get married before demobilization, should try his best to make arrangements.

The marriage of military personnel shall be handled in accordance with the relevant regulations of the local government.

Four, active servicemen are not allowed to marry foreigners or Hong Kong and Macao residents. Han soldiers who want to marry minority citizens who are not used to marrying Han people generally have to persuade both sides to give up this marriage; If both parties are firm, marriage can also be allowed with the consent of minority parents, provided that they respect and do not violate the marriage habits of ethnic minorities.

Five, the military battalion cadres to apply for marriage, approved by the political organs; The application for marriage by cadres at or above the regiment level shall be examined and approved by the political organ at the next higher level. Then, my date of birth, nationality and marital status will be issued by the political organ at or above the regiment level, and I will go through the marriage registration formalities at the local marriage registration office. Soldiers and volunteers who have served overtime apply for marriage. Generally, the certificate of birth date, nationality and marital status is issued by the political organ at or above the regiment level, and then the marriage registration formalities are handled at the local marriage registration office. However, some soldiers and volunteers who extended their service found partners during their family visits and applied for marriage. If it is too late to issue a certificate to the original troops, the local people's armed forces departments of counties, cities and municipal districts may issue relevant certificates and go through the marriage registration formalities at the local marriage registration office. When applying for divorce again, you must also hold a divorce certificate.

Six, active servicemen divorce, should take a serious and prudent attitude, otherwise it will violate laws and regulations and will not corrupt morality. To apply for divorce, you must obtain the consent of the political organ at or above the regimental level and issue a certificate before you can register for divorce at the local marriage registration office or file a divorce lawsuit with the people's court.

This regulation shall be implemented from 198 1 1. Where the relevant provisions in the past are inconsistent with these Provisions, these Provisions shall prevail.
