What is the age of late marriage under the Marriage Law?

Three years above the legal age of marriage is a late marriage, i.e., a man is 25 years old and a woman is 23 years old. Definition of Late Marriage: A man who has reached the age of 25 and a woman who has reached the age of 23 and has registered her marriage according to the law is a late marriage, provided that both the man and the woman have been married for the first time.

If a person meets the age for late marriage (23 for a woman, or 25 for a man), he or she is entitled to late marriage leave (the number of days of late marriage leave varies according to local administrative regulations). Citizens who marry late and have children late are entitled to incentives or other benefits for extended marriage and childbirth leave. The provision of rewarding couples who marry late and have children late and parents of only children has now been deleted. This means that as of January 1, 2016, late-married and late-breeding couples will no longer have late-marriage and late-breeding leave. Parents who voluntarily have only one child will also no longer be eligible for incentives related to one-child parents after the law change.

I. What are the advantages of late marriage and late childbearing?

(1) in terms of family planning, late childbearing can prolong the cycle of human reproduction, is conducive to controlling the rapid growth of the population;

(2) although the marriage law provides for the minimum age of marriage of men and women with the basic development of the genitals, but the heart, lungs, brain, bones, etc. to the age of 25 years old before the full maturity of the premature birth of a child is not conducive to their own, to the body of their offspring;

(3) People between the ages of 20 and 30 are the most energetic, and it is a golden time to concentrate on study, work actively, invent and create, and make great achievements in their careers, so they can't let their youth be wasted by getting married and having children;

What is the procedure for registering a marriage?

(1) To apply, both parties must apply in person for marriage registration at the marriage registration office in the place where one of the parties has a hukou, and when applying, they should hold the following documents and certificates:

(1) proof of hukou;

(2) resident's identity card;

(3) certificate of marital status issued by the unit, villagers' committee or residents' committee;

(4) certificate of divorced status;

(5) certificate of marriage status issued by the village committee or residents' committee. >(4) If divorced, a divorce certificate shall also be held. If a divorced party resumes the relationship between husband and wife, both parties must apply in person to the marriage registration authority in the place where one of the parties has his or her household registration;

(5) Where premarital examination is practiced, the party applying for registration must go to a designated health care institution for a premarital health checkup, and submit a certificate of the premarital checkup to the marriage registration authority;

(2) Examination, the marriage registration administrative authority shall examine the application of the parties concerned and ascertain whether the application for marriage meets the conditions for marriage;

(3) registration; the marriage registration authority shall immediately register those who meet the conditions for marriage and issue marriage certificates; and those who have been divorced shall have their divorce certificates canceled.

Article 1046 Marriage shall be entered into by a man and a woman of their own free will, and it is forbidden for either party to force the other, or for any organization or individual to interfere with it.

Article 1047 The age of marriage shall not be earlier than twenty-two years for men and twenty years for women.

Article 1048 Marriage of blood relatives in the direct line or blood relatives within three generations is prohibited.

Article 109 A man and a woman who wish to marry shall apply in person to a marriage registration office for marriage registration. If they meet the provisions of this Law, they shall be registered and issued a marriage certificate. Upon completion of the marriage registration, the marriage relationship is established. If the marriage has not been registered, it shall be registered retroactively.

Article 1,050 After a marriage is registered, the woman may become a member of the man's family and the man may become a member of the woman's family, in accordance with the agreement between the man and the woman.

Article 101 A marriage shall be invalidated under any of the following circumstances:

(1) bigamy;

(2) kinship where marriage is forbidden;

(3) being under the legal age of marriage.
