Article 1 In order to reform the use system of urban state-owned land, rationally develop and utilize land resources, promote urban construction and economic development, and safeguard the legitimate rights and interests of land owners and users, these measures are formulated in accordance with the Provisional Regulations of the People's Republic of China on Assignment and Transfer of the Right to Use Urban State-owned Land (hereinafter referred to as the Regulations) and relevant laws and regulations, combined with the actual situation of this province. Article 2 The land departments of provinces, cities and counties shall be responsible for organizing the implementation of laws, regulations and these measures concerning the assignment and transfer of land use rights, and managing, supervising and inspecting the assignment, transfer, lease, mortgage and termination of urban state-owned land use rights (hereinafter referred to as land use rights) according to law. Provincial, city and county real estate, urban and rural planning, planning, finance and other management departments should be in accordance with laws, regulations and these measures, with the relevant management work. Article 3 The lawful rights and interests of persons who have obtained land use rights in accordance with the provisions of these Measures shall be protected by state laws. Article 4 The municipal and county people's governments shall strengthen the management of urban state-owned land in accordance with the principles of unified planning, unified land acquisition, unified development, unified transfer and unified management. Land acquisition work is unified by the land department responsible for organizing the implementation. Chapter II Assignment of Land Use Rights Article 5 Assignment of land use rights shall be carried out by the people's governments of cities and counties in a planned and step-by-step manner. City and county land departments shall, jointly with the planning, urban planning and construction management departments, prepare the annual plan for the assignment of land use rights (hereinafter referred to as the land supply plan) according to the local national economic development plan, the overall urban planning and the annual construction land plan, and implement it after being approved by the people's government at the same level. The land supply plan shall include the land area, location, scope, use, land supply mode and feasibility analysis of the state-owned land use right to be transferred in that year. The annual land supply plan shall be reported to the superior land department for the record, and may be announced to the public. Article 6 The following land use rights may be transferred according to law: (1) Land owned by rural collectives requisitioned by the people's governments of cities and counties according to the needs of urban construction and development; (two) according to the provisions of Article 19 of the Land Administration Law of the People's Republic of China and Article 47 of the Regulations, the land use right has been recovered by the government; (three) the state-owned land recovered by the government free of charge after the expiration of the transfer period; (four) other state-owned land available for sale in cities and towns.
