Regulations of Gansu Province on Road Transportation

Chapter I General Provisions Article 1 These Regulations are formulated in accordance with the Regulations of the People's Republic of China on Road Transport and relevant laws and regulations, combined with the actual situation of this province, in order to maintain the order of the road transport market, ensure the safety of road transport, protect the legitimate rights and interests of all parties involved in road transport and promote the healthy development of road transport. Article 2 Those who engage in road transport operations and related businesses within the administrative region of this province shall abide by these regulations.

The term "road transport operation" as mentioned in these Regulations includes road passenger transport operation and road cargo transport operation. Road passenger transport includes bus passenger transport, chartered passenger transport and bus passenger transport; Road cargo transportation includes general cargo transportation, special transportation, large cargo transportation and dangerous cargo transportation.

Road transport related businesses include road transport stations (yards), motor vehicle maintenance, motor vehicle driver training, motor vehicle comprehensive performance testing, car rental and other business operations. Article 3 The development of road transport industry shall follow the principles of overall planning, safety, convenience, energy conservation and environmental protection, and be reasonably connected and coordinated with other modes of transport such as railways, tracks, waterways, aviation and pipelines in accordance with the requirements of comprehensive benefits and complementary advantages, so as to give full play to the advantages of comprehensive transport. Article 4 The people's governments at or above the county level shall coordinate the development of urban and rural transportation, improve the modern road transportation system, give priority to the development of public transportation, gradually realize the integration of urban and rural and regional passenger transportation, promote the development of transportation logistics, and improve the service capacity of road transportation. Article 5 The people's governments at or above the county level shall incorporate the layout and construction of transportation facilities such as road transport stations (yards) and bus stations (yards) into the overall urban and rural planning, and give policy support in terms of land and funds. Article 6 The transportation departments of the people's governments at or above the county level shall be in charge of road transport within their respective administrative areas, and the road transport management institutions shall be responsible for the specific implementation of road transport management.

The relevant departments of the people's governments at or above the county level shall, in accordance with their respective responsibilities, do a good job in road transport management. Seventh road transport and related business operators should operate according to law, be honest and trustworthy, fair competition, and provide safe and high-quality transport services.

Road transport management institutions shall follow the principles of openness, fairness, impartiality and convenience, perform their duties, rectify illegal operations and protect fair competition. Eighth to encourage road transport enterprises to implement large-scale and intensive management.

No unit or individual may block or monopolize the road transport market. Chapter II * * * Same Provisions Article 9 Anyone who engages in road transport and related business activities shall meet the conditions stipulated by laws, regulations and these Regulations, obtain a road transport business license according to law, and engage in business activities in accordance with the licensing matters.

If road transport and related business operators need to change the licensing matters, they shall apply to the road transport management institution that made the licensing decision. Tenth road transport and related business operators shall collect fees in accordance with the national price policy and the standards approved by the competent price department. Eleventh road transport and related business operators should apply for road transport permits for their vehicles engaged in passenger transport, freight transport, motor vehicle driver training and car rental business and carry them with them.

Passenger and freight drivers, road dangerous goods transport loading and unloading management personnel and escorts, and motor vehicle driving training coaches shall take training examinations in accordance with state regulations, obtain qualification certificates, and carry them with them when engaging in business activities. Twelfth road transport and related business operators should establish and improve the responsibility system for production safety, formulate rules and regulations for production safety and operating procedures, implement the enterprise safety standardization system, and ensure the safety of road transport. Thirteenth passenger transport operators should ensure that the vehicle equipment and facilities are in good condition, meet the requirements of national safe operation, keep the vehicle clean and tidy, and ensure the personal and property safety of passengers. Fourteenth passenger and freight drivers who have been driving for four hours continuously shall stop and rest for not less than twenty minutes; The cumulative driving time of shuttle bus and chartered bus drivers within twenty-four hours shall not exceed eight hours. Fifteenth bus passenger transport, chartered passenger transport and dangerous goods transport operators should be in accordance with the provisions of the carrier liability insurance for passengers and dangerous goods.

The minimum amount of carrier liability insurance shall be stipulated by the Provincial Department of Transportation in conjunction with the provincial insurance supervision and administration institution. Article 16 Vehicles engaged in road transport shall conform to the national technical standards for motor vehicle safety, pollutant emission standards and fuel consumption limits stipulated by the state and this province, and shall be tested and maintained according to the mileage or time interval stipulated by the state.

Road transport operators shall, in accordance with the provisions of the state, install satellite positioning devices with driving record function in line with national standards for buses, chartered cars, dangerous goods transport and other vehicles to monitor the operation of vehicles in real time. Article 17 Road transport and related operators shall undertake emergency tasks such as emergency rescue, disaster relief and combat readiness assigned by the people's governments at or above the county level, and obey the unified dispatch and command of relevant departments.

People's governments at or above the county level or relevant departments shall give reasonable economic compensation to road transport operators and related business operators who undertake emergency transport tasks. Eighteenth traffic management departments of public security organs and road transport management institutions shall establish and improve the * * * sharing mechanism of information such as road transport drivers, motor vehicle driving training coaches and road transport vehicles traffic violations.

The traffic administrative department of the public security organ shall issue corresponding safety driving certificates for drivers and driving training coaches who apply for road transport.
