Regulations on the Protection of Traditional Villages in Xiangxi Tujia and Miao Autonomous Prefecture

Chapter I General Provisions Article 1 In order to strengthen the protection and development of traditional villages and inherit and carry forward excellent traditional culture, these Regulations are formulated in accordance with the Law of People's Republic of China (PRC) on Regional National Autonomy, the Law of People's Republic of China (PRC) on Urban and Rural Planning, the Law of People's Republic of China (PRC) on Intangible Cultural Heritage and other relevant laws and regulations, and in combination with the actual situation of this state. Article 2 These Regulations shall apply to the planning, protection and utilization of traditional villages within the administrative area of this state.

The term "traditional villages" as mentioned in these Regulations refers to the traditional villages in China and the villages recognized by the provinces, prefectures and counties (cities) within their respective administrative areas. Measures for the declaration and identification of state and county (city) level traditional villages shall be formulated by the state people's government.

Villages with ethnic characteristics that are not included in the protection list of traditional villages shall be implemented with reference to these regulations. Article 3 The protection and development of traditional villages should adhere to the principles of government leading, villagers' autonomy, social participation, scientific planning, giving priority to protection, live transmission and green development. Article 4 State and county (city) people's governments shall be responsible for the protection and development of traditional villages within their respective administrative areas, incorporate the protection and development of traditional villages into national economic and social development planning, national land space planning and urban and rural planning, establish a coordination mechanism for the protection of traditional villages, and make overall plans to promote the protection of traditional villages. Fifth state, county (city) housing and urban and rural construction departments are responsible for organizing, coordinating, guiding and supervising the protection and development of traditional villages.

State, county (city) natural resources and planning departments are responsible for the preparation of traditional village protection and development planning, and guide and supervise the implementation of the planning.

State, county (city) cultural tourism radio and television departments are responsible for protecting the material and intangible cultural heritage of traditional villages.

State, county (city) development and reform, finance, poverty alleviation and development, ecological environment, human resources and social security, ethnic and religious, emergency management, agriculture and rural areas, forestry, water conservancy and other relevant departments shall do a good job in the protection and development of traditional villages according to their respective responsibilities. Article 6 The township (town) people's government and sub-district offices where traditional villages are located shall perform the following duties:

(a) to cooperate with the preparation and organization of the implementation of the protection and development planning of traditional villages within their respective administrative areas;

(two) to coordinate or organize the implementation of traditional village style transformation, protection and development projects;

(three) improve the traditional village infrastructure, public service facilities, improve the living environment;

(four) to assist in the rescue, protection, preservation and inheritance of the material and intangible cultural heritage of traditional villages;

(five) the implementation of fire safety, termite control and other safety protection responsibilities;

(six) to guide and urge the village (neighborhood) committees to do a good job in the protection and development of traditional villages. Seventh traditional villages where the village (neighborhood) committees do the following work:

(a) to participate in the preparation and implementation of traditional village protection and development planning, and cooperate with relevant departments to carry out the protection and publicity of traditional villages;

(two) according to the organization of village (neighborhood) people's meeting or village (neighborhood) people's representative meeting, the protection and development of traditional villages into the village rules and regulations;

(three) to register the traditional buildings (structures) that are in danger of damage, collect and protect the components of the collapsed and scattered traditional buildings (structures), and report to the township (town) people's government and the sub-district office;

(five) to assist in the implementation of fire safety, termite control and other safety protection responsibilities;

(six) organize villagers (residents) to carry out various cultural activities in accordance with traditional customs, and protect, inherit and spread intangible cultural heritage. Eighth traditional village protection and development funds should be earmarked, and accept the supervision of the financial, auditing and supervision departments of the state and county (city) people's government. Its sources of funds include:

(a) the financial budget at the corresponding level;

(2) Special financial subsidies;

(3) Donations from citizens, legal persons and other organizations;

(four) other ways to raise funds according to law. Chapter II Planning Article 9 The people's government of the county (city) where the traditional village is located shall organize the preparation of the protection and development plan of the traditional village within one year from the date of approval and publication of the traditional village, and publish and implement it after approval in accordance with legal procedures.

The protection and development plan of traditional villages approved according to law shall not be changed or modified without authorization. If it is really necessary to amend it, it shall be submitted for approval in accordance with legal procedures. Tenth traditional village protection and development planning should include the scope of protection, protection objects, protection measures, industrial layout, improvement of human settlements and other contents. Eleventh traditional village protection and development planning should highlight the local characteristics of ethnic minorities, and connect with the national space, industrial development, poverty alleviation and development, ecological environment protection, global tourism, rural revitalization and ethnic minority village planning.

The protection and development planning of traditional villages should pay attention to maintaining the integrity, authenticity and continuity of traditional villages, and the style, materials, site selection and height of buildings should meet the requirements of natural landscape environmental protection of traditional villages. Twelfth traditional village protection and development planning before approval, should be discussed and agreed by the village (neighborhood) people's meeting or the village (neighborhood) people's representative meeting. The township (town) people's government and sub-district offices shall publish the draft plan according to law, and solicit the opinions of experts and the public through demonstration meetings, hearings or other means. The announcement period shall not be less than thirty days.

The township (town) people's government and sub-district offices shall fully consider the opinions of experts and the public, and attach the opinions and reasons for adoption to the examination and approval materials.

The county (city) people's government shall set up exhibition boards in public places of traditional villages to publicize the protection and development planning of the traditional villages.
