What are the prohibitions and advocates provided for in the Marriage Law?

(1) Article 1042 of the Civil Code provides for prohibitions: "Arranged marriages, sale of marriages, and other interferences with the freedom of marriage are prohibited.

The solicitation of property through marriage is prohibited.

Bigamy is prohibited.

It is prohibited for a person with a spouse to cohabit with another person.

Domestic violence is prohibited.

Abuse and abandonment among family members is prohibited."

First, it prohibits arranged marriages, sale of marriages, and interference by others in the freedom of marriage, and the solicitation of property through marriage.

This article corresponds to the principle of freedom of marriage. Arranged marriages and the sale of marriages are all violations of the freedom of marriage, and with the breakthrough of feudalism and social and economic development, the problems of arranged marriages and the sale of marriages in our country have basically been completely changed, but it is difficult to eradicate the problem of soliciting property by means of marriage, especially in remote mountainous regions and rural areas, where a large amount of property is solicited from a man in return for marrying a daughter, even resulting in the formation of a marriage contract between a daughter and a man. A large amount of property, and even the formation of the marriage of the daughter of the wind of comparison, not only to corrupt the social atmosphere, but also not conducive to the happy life of the newlyweds.

Secondly, bigamy is prohibited, and cohabitation of a spouse with another person is prohibited.

This article corresponds to the principle of monogamy, the implementation of which necessarily prohibits bigamy.

The so-called bigamy means, firstly, that a person who already has a spouse registers a separate marriage with another person;

Thirdly, domestic violence is prohibited, and abuse and abandonment among family members is prohibited.

Domestic violence refers to physical and mental aggression between family members in the form of beating, binding, maiming, restricting personal freedom, as well as regular verbal abuse and intimidation.

Abuse is not exactly the same as domestic violence, referring to both physical beating and torture and mental destruction of family members.

Abandonment among family members means that the person who is obliged to raise, support and alimony do not fulfill their obligations of raising, supporting and alimony, so that "young parents have nothing to support, old children have nothing to rely on", domestic violence, abuse and abandonment among family members are not in line with the provisions of the law, and even more contrary to the morality of our society and public morality.

(2) Article 1043 of the Civil Code stipulates that there is an advocacy clause: "Husbands and wives shall be faithful to each other, respect each other and care for each other;

Family members shall respect the old and love the young, help each other, and maintain equal, harmonious and civilized marriage and family relations." Marriage and family are the closest cells between social relations, and the harmony, love and concord of marriage and family are the smallest molecules and components of realizing a harmonious society.

China's law puts the basic moral norms of mutual fidelity, respect and love between husband and wife into the law, which, on the one hand, highlights the importance of the construction of the relationship between husband and wife and, on the other hand, is in line with the traditional social culture of our country of respecting the old and loving the young and helping each other, as well as the social pursuit of today's age that aspires to equality, harmony and civilization in marriage and family relations.
