Provisions of Shenzhen Municipality on Funeral Management
If a foreigner dies in Shenzhen, except that he needs to be transported back to his place of origin for burial, he shall go through the formalities of transporting the corpse with the certificate of the civil affairs department at or above the county level where the deceased is registered, and the rest shall be cremated on the spot.
If the deceased is a minority with burial habits, respect their funeral customs; However, if cremation is carried out voluntarily, no one else may interfere. Article 5 The cremation of remains shall be timely, and the time for mortuary shall generally not exceed ten days. If it is necessary to extend the time of mortuary under special circumstances, it must be approved by the public security organ or the civil affairs department at or above the district level, and go through the formalities for extending the time of mortuary. Article 6 A corpse that has died or rotted due to an infectious disease shall be cremated immediately after being disinfected by the health and epidemic prevention department. Bodies that die abnormally or are unclaimed must be examined by public security organs before cremation. Article 7 The cremation of remains shall have a death certificate issued by the unit where the deceased lived or by the residents' committee, public security organ or hospital. Article 8 In areas where cremation is practiced, no unit or individual may provide transportation and other assistance for burial. Article 9 The people's governments of districts and towns in the reform areas of burial shall, in accordance with the principle of being conducive to production and construction, plan burial sites and establish cemeteries. Burial cemeteries must be built and afforested in accordance with the planning of Shenzhen Municipal People's Government (hereinafter referred to as the municipal government), and the area of each grave should be limited. No unit or individual may occupy land for burial at will.
The establishment of an operating burial cemetery shall be examined and approved by the municipal government and reported to the Guangdong Provincial Civil Affairs Department for approval. Article 10 The original graves outside cemeteries in districts and towns where cemeteries have been built shall be moved into cemeteries or demolished within a time limit in accordance with the regulations of the local government. However, the tombs of revolutionary martyrs, celebrities, overseas Chinese ancestors and ancient tombs with historical, artistic and scientific value protected by the state are excluded.
For ancient tombs that must be relocated due to construction needs, the land-using unit shall submit a report and apply to the Shenzhen Civil Affairs Department for relevant relocation procedures. In areas where cremation is carried out, all the ashes moved out are cremated, and the ashes are stored in the ashes storage place or ashes cemetery under the unified management of the civil affairs department of Shenzhen City or district or town. Eleventh it is forbidden for any unit or individual to build "Shouwu" or "Yinyang City", and it is forbidden to build graves for the living in advance. The original bones of Shouwu and Yinyang should be cremated, and their ashes can be placed in cemeteries, or centralized burial in places designated by Shenzhen and the district government. In Dai Xiao, it is forbidden to pray for the soul, to wear linen and to participate in funeral processions. It is forbidden for any unit or individual to build tombs of surnames and clans or engage in activities of offering sacrifices to surnames and clans. Article 13 Compatriots from Hong Kong, Macao and Taiwan, overseas Chinese and overseas Chinese who wish to transport the ashes of their relatives who died abroad or abroad back to Shenzhen for burial in the cemetery should apply to the Overseas Chinese Affairs Department of Shenzhen, and the Overseas Chinese Affairs Department will determine the burial place jointly with the civil affairs department.
If a foreigner or foreign Chinese dies in Shenzhen and his relatives request that his body be transported abroad for burial, the Shenzhen funeral home shall handle it with reference to the relevant regulations of Beijing International Body Transport Service Center. Article 14 Compatriots from Hong Kong, Macao and Taiwan, overseas Chinese and overseas Chinese who want to repair or relocate their ancestral graves in Shenzhen should apply to the Overseas Chinese Affairs Department or the Civil Affairs Department of Shenzhen, which will put forward their opinions and report them to the municipal government for approval.
The ancestral graves of compatriots from Hong Kong, Macao and Taiwan, overseas Chinese and overseas Chinese who really need to be relocated due to land requisition for national construction shall be reported by the land acquisition unit to the people's government at or above the municipal level with the approval of the district, and the relevant relatives shall be notified to agree on the relocation location and burial method. Fifteenth in the cremation area, it is forbidden for any unit or individual to produce and sell coffins and funeral supplies.
In the reform area of burial, units and individuals engaged in the production and operation of coffins and burial utensils shall apply to the civil affairs department of Shenzhen within three months from the date of implementation of these Provisions, and may operate only after being approved and registered by the administrative department for industry and commerce. Sixteenth civil affairs departments at all levels in Shenzhen are the competent departments of funeral management, and perform the following duties:
(a) to publicize and implement the provisions of the State Council and Guangdong Province on funeral management and these Provisions;
(two) to promote the publicity and education of cremation and burial reform;
(three) to investigate and deal with illegal funeral activities;
(four) other matters responsible for funeral management. Seventeenth Shenzhen public security, industry and commerce, land planning, health, finance, urban management and other departments should cooperate with the civil affairs departments to do a good job in funeral management according to their respective responsibilities.
