Regulations on the protection of traditional arts and crafts

(Promulgated by Order No.217 of People's Republic of China (PRC) on May 20, 1997, revised according to the Decision of the State Council on Abolishing and Amending Some Administrative Regulations on July 6, 2065438).

Article 1 These Regulations are formulated for the purpose of protecting traditional arts and crafts and promoting their prosperity and development. Article 2 The term "traditional arts and crafts" as mentioned in these Regulations refers to the handicraft varieties and skills with a long history of over 100 years, exquisite skills, handed down from generation to generation, complete craftsmanship, made of natural raw materials, distinctive national style and local characteristics, and enjoying high reputation at home and abroad. Article 3 The State pursues the policy of protecting, developing and improving the varieties and skills of traditional arts and crafts. Local people's governments at all levels should strengthen their leadership over the protection of traditional arts and crafts and take effective measures to support and promote the prosperity and development of traditional arts and crafts in their own regions. Article 4 The department responsible for the protection of traditional arts and crafts in the State Council is in charge of the protection of traditional arts and crafts throughout the country. Article 5 The State practices the system of identifying varieties and skills of traditional arts and crafts. Arts and crafts varieties and techniques that meet the requirements stipulated in Article 2 of these Regulations shall be recognized as traditional arts and crafts varieties and techniques in accordance with the provisions of these Regulations. Sixth varieties and skills of traditional arts and crafts, by the the State Council city department responsible for the protection of traditional arts and crafts to hire experts to form a review committee for review; The department responsible for the protection of traditional arts and crafts in the State Council shall identify and publish it according to the evaluation conclusion of the evaluation committee. Article 7 Enterprises and individuals who make traditional arts and crafts products may apply to the local county-level people's government departments for the protection of traditional arts and crafts for varieties and skills, which shall be reviewed by the departments for the protection of traditional arts and crafts of the people's governments of provinces, autonomous regions and municipalities directly under the Central Government and recommended to the departments for the protection of traditional arts and crafts in the State Council. Article 8 Enterprises and individuals applying for the identification of varieties and skills of traditional arts and crafts shall submit complete and detailed materials in accordance with the provisions of the department responsible for the protection of traditional arts and crafts in the State Council. Article 9 The State shall take the following measures to protect the recognized traditional arts and crafts: (1) Collecting, sorting out and establishing archives; (2) Collecting and soliciting outstanding representative works; (three) to determine the classification of its technical secrets and keep them confidential according to law; (4) funding research and training talents. Article 10 The outstanding works among the varieties of traditional arts and crafts shall be named as China Arts and Crafts Treasures (hereinafter referred to as Treasures) by the competent department of traditional arts and crafts protection in the State Council after being judged by an evaluation committee composed of experts hired by the competent department of traditional arts and crafts protection in the State Council. Article 11 The State shall take the following measures to protect treasures: (1) Treasures collected and purchased by the State shall be collected by the China Museum of Arts and Crafts or the museums of arts and crafts of provinces, autonomous regions and municipalities directly under the Central Government. (2) It is forbidden to export treasures. The exhibition of treasures abroad must be approved by the department responsible for the protection of traditional arts and crafts in the State Council in conjunction with the relevant departments in the State Council. Article 12 A person who meets the following conditions and has been engaged in the production of traditional arts and crafts for a long time may be awarded the title of Master of Arts and Crafts in China by relevant industry associations: (1) Having made outstanding achievements and enjoying a reputation at home and abroad; (two) superb skills, its own genre. Thirteenth relevant departments of the people's governments at or above the county level shall make overall plans and make proper arrangements for the natural raw materials and materials that are particularly needed for the production of traditional arts and crafts. Article 14 The State shall strengthen the protection of precious stones, jade and other rare minerals especially needed in the production of traditional arts and crafts, and prohibit indiscriminate mining and excavation. Article 15 The state encourages local people's governments at all levels to take necessary measures to explore and rescue traditional arts and crafts, collect excellent traditional arts and crafts, cultivate talents of traditional arts and crafts and fund scientific research on traditional arts and crafts. Article 16 People's governments at all levels shall take necessary measures to support and help arts and crafts production enterprises with low economic benefits and high artistic value, which are on the verge of extinction. Seventeenth enterprises that produce traditional arts and crafts products shall establish and improve the protection or confidentiality system of traditional arts and crafts, and earnestly strengthen the management of traditional arts and crafts. Personnel engaged in the production of traditional arts and crafts products shall abide by the provisions of relevant state laws and regulations, and shall not disclose technical secrets and other business secrets known in the production of traditional arts and crafts products. Article 18 The state rewards units and individuals that have made outstanding contributions to the inheritance, protection and development of traditional arts and crafts. Nineteenth in violation of the provisions of this Ordinance, one of the following acts, by the relevant departments in accordance with the provisions of relevant laws and administrative regulations, given administrative sanctions or administrative penalties; If a crime is constituted, criminal responsibility shall be investigated according to law: (1) stealing or revealing the secrets of traditional arts and crafts; (two) illegal exploitation of rare mineral resources used to make traditional arts and crafts or illegal sale of rare mineral products used to make traditional arts and crafts; (3) Smuggling treasures out of the country. Those who produce and sell fake traditional arts and crafts works signed by China arts and crafts masters shall bear civil liability according to law; The relevant departments may impose administrative penalties in accordance with the provisions of relevant laws and administrative regulations. Article 20 These Regulations shall come into force as of the date of promulgation.
