Administrative Measures for the Protection of Intangible Cultural Heritage in Linfen City

Chapter I General Provisions Article 1 In order to inherit and carry forward the excellent traditional culture of the Chinese nation, strengthen the protection and preservation of intangible cultural heritage, and promote the construction of a strong cultural city, according to the relevant laws and regulations, combined with the actual situation of the city, to formulate these measures. Article 2 These Measures shall apply to the protection, preservation and management of intangible cultural heritage within the administrative area of the city. Article 3 The intangible cultural heritage referred to in these Measures refers to the various traditional cultural expressions that have been handed down from generation to generation by the people of all nationalities within the administrative area of the City and are regarded as part of their cultural heritage, as well as the physical objects and places related to the traditional cultural expressions. It includes:

(i) traditional oral literature and the language that serves as its carrier;

(ii) traditional fine arts, calligraphy, music, dance, drama, opera and acrobatics;

(iii) traditional skills, medicine and calendars;

(iv) traditional rituals, festivals and other folklore;

(v) traditional sports and amusement games;

(vi) other intangible cultural heritage.

The relevant provisions of laws and regulations on the protection of cultural relics shall apply to objects and places that are part of the intangible cultural heritage and are cultural relics. Article IV of the intangible cultural heritage protection to implement the protection of the main, rescue first, rational use, inheritance and development of the policy, focusing on its authenticity, integrity and inheritance. Article 5 The people's governments of cities and counties (cities and districts) shall incorporate the protection and preservation of intangible cultural heritage into the national economic and social development planning at their respective levels, include the funds for protection and preservation in the financial budget at their respective levels, and set up a coordinating mechanism for the implementation of effective protection and management. Article 6 The competent departments of culture of the people's governments of cities and counties (cities and districts) shall be responsible for the protection and preservation of the intangible cultural heritage within their administrative regions.

Cities, counties (cities, districts) people's governments intangible cultural heritage protection agencies, should be under the leadership of the competent cultural department at the same level, the organization and implementation of intangible cultural heritage protection, preservation and other work. Article 7 The people's governments of cities and counties (cities and districts) shall establish a representative list of local intangible cultural heritage, and include in the list of items of intangible cultural heritage in the administrative region that embody the excellent traditional culture of the Chinese nation and have historical, literary, artistic and scientific value for protection. Article 8 The people's governments of cities and counties (cities and districts) shall encourage citizens, legal persons and other organizations to participate in the protection of intangible cultural heritage, and organizations and individuals who have made remarkable achievements in the protection of intangible cultural heritage shall be commended and rewarded in accordance with the relevant provisions. Chapter II Protection of intangible cultural heritage duties Article 9 municipal, county (city, district) people's government departments in charge of culture to perform the following duties:

(1) publicity and implementation of intangible cultural heritage protection of laws and regulations, and supervise the relevant units and individuals to carry out the obligations of protection of intangible cultural heritage in accordance with the law;

(2) the development and organization of the implementation of intangible cultural heritage protection planning;

(3) organizing and carrying out publicity, display and exchange activities for intangible cultural heritage;

(4) supervising and inspecting the protection, preservation, management and utilization of representative items of intangible cultural heritage;

(5) establishing a pool of experts on intangible cultural heritage, providing professional consultation and evaluation and argumentation for the protection and preservation of intangible cultural heritage at this level;

(5) establishing an expert pool for the protection and preservation of intangible cultural heritage;

( (vi) managing special funds for the safeguarding of the intangible cultural heritage and supervising the use thereof;

(vii) carrying out other work relating to the safeguarding and preservation of the intangible cultural heritage. Article 10 The intangible cultural heritage protection institutions to organize and carry out intangible cultural heritage survey, excavation, collation, assessment, identification and research work on the intangible cultural heritage representative projects and representative bearers of the core skills of the intangible cultural heritage to take written records, audio, video, multimedia and other ways of recording, and the establishment of municipal intangible cultural heritage archives and databases. Article 11 The relevant departments of the people's governments of cities and counties (cities and districts) shall do a good job of protecting intangible cultural heritage in accordance with the following duties:

(1) The education department shall support the inclusion of intangible cultural heritage in education, carry out activities to popularize the knowledge of intangible cultural heritage, and cultivate intangible cultural heritage heritage inheritors;

(2) The financial department shall be responsible for the protection of intangible cultural heritage. representative projects, representative inheritors, and the construction of related facilities to ensure funding, and management and supervision of the use of funds;

(3) the planning department is responsible for the architectural heritage related to intangible cultural heritage, historical cities, towns, villages and neighborhoods planning, as well as the construction of representative projects of intangible cultural heritage construction land planning;

(4) the housing and construction department is responsible for the historical city, Historical and Cultural Neighborhoods;

(v) the health department is responsible for organizing experts to evaluate the intangible cultural heritage projects of traditional medicine;

(vi) the tourism department is responsible for publicizing and promoting the representative projects of intangible cultural heritage related to tourism;

(vii) the public security department is responsible for investigating and dealing with the encroachment on, destruction of, and damages to the intangible cultural heritage

(viii) the water conservancy department is responsible for coordinating the protection of intangible cultural heritage in the construction of water conservancy;

(ix) the nationalities and religions department is responsible for coordinating the protection of intangible cultural heritage related to nationalities and religions;

(x) other relevant departments are responsible for the protection of the intangible cultural heritage within their respective areas of responsibility.
