Basic Principles of Labor Law
The basic principles of labor law include: the principle that labor is both a right and an obligation; the principle of protecting the legitimate rights and interests of workers; and the principle of rational allocation of labor resources.
I. The principle that labor is both a right and an obligation. Every citizen with the ability to work has the same right to engage in labor:
(1) for citizens means the right to work, including the right to employment and the right to choose a job;
(2) the right to choose, in accordance with the law, occupations and employers suitable for their own characteristics;
(3) the right to take advantage of the state and the community to provide all kinds of employment security conditions, in order to improve employability and increase employment opportunities.
II. The principle of protecting the legitimate rights and interests of workers. These include: (1) favoring and prioritizing protection; (2) equal protection; (3) comprehensive protection; and (4) basic protection.
Third, the principle of rational allocation of labor resources. Including: (1) dual value orientation; (digging absolute 2) macro-allocation of labor resources; (3) micro-allocation of labor resources.
Legal basis
Article 4 of the Labor Law of the People's Republic of China*** and the State Employers shall establish and improve regulations in accordance with the law to ensure that workers enjoy their labor rights and fulfill their labor obligations.
