Chapter I General Provisions Article 1 In order to maintain the order of the road transport market, establish a unified, open and competitive road transport market, standardize business practices, safeguard the legitimate rights and interests of road transport operators and their customers, and promote the healthy development of the road transport industry, these Regulations are formulated in accordance with relevant national laws and administrative regulations and in light of the actual situation of this Municipality. Article 2 The term "road transport" as mentioned in these Regulations refers to road passenger transport, road cargo transport and related transport service activities such as vehicle maintenance, handling and driver training.

All units and individuals engaged in the management and operation of commercial road transport and the business service objects within the administrative area of this Municipality shall abide by these regulations. Third city traffic administrative departments in charge of the city's road transport management.

The traffic administrative departments of counties (autonomous counties and cities) shall be responsible for the management of road transport within their respective administrative areas in accordance with the prescribed duties.

City and district, county (autonomous county, city) traffic administrative departments of road transport management agencies responsible for the specific management of road transport within their respective administrative areas.

The administrative departments of public security, municipal administration, agricultural machinery, industry and commerce, taxation, price, environmental protection, quality and technical supervision, etc. shall, in accordance with their respective functions and duties, cooperate with the traffic administrative department to implement these regulations. Article 4 The municipal traffic administrative department shall, according to the needs of the city's economic and social development, formulate a road transport development plan, which will be incorporated into the city's national economic and social development plan and the overall urban planning after being approved by the Municipal People's Government, and organize its implementation.

The people's governments of counties (autonomous counties, cities) shall, according to the needs of the economic and social development of their respective administrative regions, formulate road transport development plans, and coordinate with the road transport development plans formulated by the Municipal People's Government. Article 5 Road transport shall follow the principles of openness, fairness, impartiality, unified management, coordinated development and equal competition, and unfair competition shall be prohibited. Article 6 Road transport operators shall abide by laws and regulations and provide customers with safe, timely and high-quality services. Chapter II Basic Management Article 7 Anyone who engages in road transport business shall have the equipment, facilities, technology, capital and professional qualifications suitable for its business type, project and scope. The specific standards shall be announced to the public by the municipal traffic administrative department. Article 8 Units and individuals applying for engaging in road transport business shall submit a written application to the local district or county road transport management institution. The road transport management institution shall, within fifteen working days from the date of receiving the application, make a decision within the prescribed authority.

To prepare for the establishment of foreign-invested road transport enterprises, first-class passenger (cargo) transport station operating enterprises, bus (electric) passenger transport and intermodal transport enterprises, a written application shall be submitted to the municipal road transport management institution. The municipal road transport management institution shall, in accordance with the provisions and procedures of the municipal traffic administrative department, examine and approve or submit for approval. Ninth meet the relevant qualifications, approved to engage in road transport business, road transport business license issued; For those who do not meet the examination and approval conditions, notify the applicant in writing and explain the reasons.

The applicant can only operate after obtaining the road transport business license, industrial and commercial and tax registration certificate, business license and tax registration certificate. Article 10 Road transport operators shall engage in business activities within the scope approved by the road transport business license and business license.

Road transport operators who suspend business, suspend business or merge, split up, change their business scope or transfer their operating vehicles shall go through the relevant formalities with the original approval and registration authority. Eleventh road transport management institutions shall conduct an annual inspection of the business qualifications of road transport operators, and shall not continue to engage in road transport business without annual inspection or unqualified inspection. Twelfth city and district, county (autonomous county, city) road transport management institutions shall, in accordance with the provisions of the road transport development plan and the municipal administrative department of transportation, manage road transport operators to add and update commercial road transport vehicles. Thirteenth vehicles engaged in commercial road transport shall obtain a road transport certificate issued by the road transport management institution.

Road transport permits should be carried with the vehicle. Fourteenth traffic administrative departments to implement industry management of automobile driving schools and driver training. Fifteenth road transport operators and employees shall receive relevant knowledge and skills training, pass the examination and hold relevant certificates. Drivers engaged in commercial road transport shall obtain a driver's license issued by the road transport management institution and carry it with the vehicle. Sixteenth road transport management institutions should strengthen the supervision and inspection of the safety technical management of commercial road transport vehicles, and prohibit them from engaging in commercial road transport if they do not meet the requirements of safety technical grade. Seventeenth commercial road transport vehicles shall, in accordance with the relevant provisions, go to the road transport management institution to check and sign the secondary maintenance records of vehicles, check and sign the technical grades of vehicles, and classify the technical types of vehicles.

Passenger vehicles engaged in ultra-long lines, expressway and night bus transportation must meet the technical requirements of Class I vehicles. Other vehicles must meet the technical requirements of Class II vehicles. Eighteenth road transport operators should use vehicles in accordance with the relevant provisions of the state and technical specifications for vehicle application, and establish vehicle technical files one by one to maintain the technical condition of transport vehicles.

Road transport operators must establish a safety production management system, formulate safety assessment indicators, and guide and guide the safety work of all links, jobs and posts in production.
