Regulations of Anhui Province on Road Transportation Management (revised in 2004)

Chapter I General Provisions Article 1 In order to strengthen the management of road transport, maintain the order of road transport, establish a unified, open, competitive and orderly road transport market, and safeguard the legitimate rights and interests of the parties involved in road transport, these Regulations are formulated in accordance with the relevant laws and regulations of the state and the actual situation of this province. Article 2 All units and individuals (hereinafter referred to as road transport operators) engaged in road passenger transport (excluding urban public utility bus passenger transport), cargo transport, handling, transport services and vehicle maintenance within the territory of this province shall abide by these regulations. Article 3 The traffic administrative departments of the people's governments at all levels are the departments in charge of road transport in their respective jurisdictions, and the road transport management institutions to which they belong are specifically responsible for the management, supervision and inspection of road transport in their respective jurisdictions.

Public security, industry and commerce, finance, taxation, price, construction and other relevant departments shall, in accordance with their respective responsibilities, assist the traffic administrative departments to do a good job in road transport management. Article 4 Traffic administrative departments at all levels shall make macro-control on the capacity structure, delivery and layout of automobile maintenance points of commercial road transport. Maintain the balance of transportation supply and demand, and guide the healthy development of the road transportation market.

Road transport should follow the principles of diversified business, unified management, coordinated development and equal competition. Fifth road transport management institutions at all levels should establish and improve the working system, open procedures, standardize law enforcement, improve work efficiency and management level.

Road transport operators should operate according to law, abide by professional ethics, use civilized language, provide quality services and ensure the safety of passengers and goods transportation.

Emergency transportation tasks issued by the people's governments at or above the county level shall be completed on schedule. Chapter II Opening, Change and Closure Article 6 Road transport is divided into commercial road transport and non-commercial road transport. Commercial road transport refers to road transport that provides services to the society in various ways. Non-commercial road transport refers to road transport that serves the company's work and life and does not occur in any way.

Engaged in commercial road transport, the implementation of the permit system. Seventh engaged in commercial road transport, should have the equipment, facilities, funds, professionals and other conditions that are suitable for its business type, project and scope. Specific standards shall be formulated and promulgated by the provincial administrative department of transportation. Article 8 Units and individuals applying for engaging in commercial road transport shall apply to the local road transport management institution at or above the county level for starting business, and the road transport management institution shall make a decision of approval or disapproval within 20 days from the date of accepting the application. After examination and approval, the road transport business license will be issued, and the business license will be issued by the administrative department for industry and commerce, and the business activities can only be engaged after tax registration with the tax department.

Foreign investors investing in road transport business in our province shall go through the examination and approval procedures prescribed by the state. Article 9 The vehicles of road passengers and cargo transport operators engaged in business must meet the requirements of Class II or above, and the local road transport management agencies shall issue road transport licenses and operation signs respectively according to the number and model of their registered vehicles, and carry them with them. Article 10 Where a commercial road transport operator needs to merge, divide, transfer, change its business scope or close down, it shall go through the formalities of change registration or close down at the originally approved road transport management institution and the administrative department for industry and commerce and taxation. Chapter III Road Passenger Transport Article 11 Road passenger transport is divided into bus passenger transport, fixed line passenger transport, tourist passenger transport, taxi passenger transport and chartered (or leased) passenger transport. Twelfth road transport management agencies to implement unified management, grading examination and approval of road passenger lines, shifts, stations and business areas. Thirteenth road passenger transport shall carry passengers at stations (points) approved by the road transport management institution, and shall not increase or decrease the number of flights or stop at stations, change business routes, advance or postpone the departure, change vehicles halfway or hand over passengers to others for transportation.

Approved bus passenger transport and fixed line passenger transport shall not stop without approval, and passengers shall not be taken out of the urban area. Fourteenth passengers must take a valid ticket and abide by these regulations. Passengers who cause personal injury, property loss or damage to vehicles and facilities due to their own fault shall be responsible for compensation.

The carrier shall refund the passengers who have taken the bus or missed the bus because of their own mistakes, or give priority to them, and shall compensate for the losses caused. Fifteenth drivers and passengers engaged in road passenger transport should maintain the order in the car, crack down on all kinds of illegal and criminal acts, and protect the personal and property safety of passengers. Article 16 Vehicles engaged in bus passenger transport, fixed-line passenger transport and tourist passenger transport shall hang the passenger line signs uniformly produced by the road transport management institution and the passenger fare table supervised by the competent price department in a prominent position. Seventeenth rental passenger vehicles should be equipped with rental signs, overhead lights, empty signs to be rented, and the normal use of taxi meters recognized by the technical supervision department. Eighteenth drivers engaged in taxi passenger transport, should wear a taxi passenger service certificate issued by the transportation management agency, and be polite; Do not refuse to carry or deliberately bypass. Nineteenth vehicles engaged in chartered passenger transport shall hang the license plate issued by the road transport management institution at or above the county level. Chartered passenger transport shall use chartered tickets and shall not take scattered passengers.
