Legal analysis: The Tobacco Monopoly Law stipulates that no tobacco monopoly retail license shall be set within 50 meters around the school. Of course, the situation in each region is different, but most of them are around 50 meters, so it is impossible to apply for a tobacco monopoly retail license.

Legal basis: Article 25 of the Measures for the Administration of Tobacco Monopoly Licenses shall not issue a tobacco monopoly retail license under any of the following circumstances: (1) The business premises are not suitable for handling cigarettes due to safety factors; (2) Around primary and secondary schools; (three) the qualification of tobacco monopoly operation has been cancelled for less than 3 years; (4) The Tobacco Monopoly Bureau decides not to accept or issue a license because the applicant conceals relevant information or provides false materials, and the applicant applies again within 1 year; (5) The applicant applies again within 3 years after the tobacco monopoly license obtained by cheating, bribery or other improper means has been revoked; (six) did not obtain a tobacco monopoly retail license to operate tobacco monopoly goods business, and was punished by law enforcement agencies for more than two times in 1 year, and did not apply for a tobacco monopoly retail license within 3 years; (seven) other circumstances stipulated by the State Tobacco Monopoly Bureau.
