How do I get a license to make movies and TV shows? What qualifications are required? Procedures?
1: the conditions for the radio and television program production license
1, with independent legal personality of the domestic social organizations, enterprises and institutions (excluding wholly foreign-owned enterprises or Sino-foreign joint ventures, cooperative enterprises set up in the territory), there are in line with national laws and regulations of the name of the institution, the organization and the constitution;
2, there are adapted to the business scope of the needs of the Radio and television and related professionals, capital and workplace, of which the enterprise registered capital of not less than 3 million yuan;
3, in the three years prior to the date of application, its legal representative has no record of violation of laws or regulations or the agency has not been revoked the record of the "radio and television program production and operation license";
4, other conditions prescribed by laws and administrative regulations.
Two: reporting procedures
1, acceptance: the applicant shall submit the application materials in accordance with the catalog of application materials, the materials should be complete and in accordance with the statutory form.
2, review: the application materials are complete and in accordance with the statutory form, the applicant meets the conditions of the statutory administrative licensing.
3, decision: the standard with the review criteria.

Three: declaration materials
1, application report;
2, the charter of the radio and television program production and operation organizations;
3, "radio and television program production and operation license" application form;
4, the main personnel materials:
(1) legal representative of the identity card (a copy) and resume;
(2) the main management personnel (not less than three) of radio and television and related professional resume, performance or have participated in related professional training certificate and other materials.
5, registered capital or proof of capital verification;
6, proof of office space;
7, enterprise and public utility license or business name approval of the administrative department of industry and commerce.
Four: Drama License Application
Dramas are produced by organizations holding the Radio and Television Program Production and Operation License, TV stations (including radio and TV stations, broadcasting and film groups) at or above the prefectural and municipal level and film production organizations holding the Cinematography License, provided that a separate license for the production of TV dramas has been obtained in advance.
1. There are two types of TV drama production licenses: TV Drama Production License (Type B) and TV Drama Production License (Type A), which are uniformly printed by the State Administration of Radio, Film and Television.
The Television Drama Production License (Type B) is limited to the use of the dramas indicated on the license and is valid for no more than 180 days. It may be appropriately extended under special circumstances with the approval of the licensing authority.
The Television Drama Production License (Type A) is valid for two years, and is valid for all television dramas produced by the licensee before the expiration of the validity period.
2. The TV Drama Production License (Type B) is issued by the administrative departments of radio and television at or above the provincial level. Among them, the central unit in Beijing and its directly subordinate organizations apply directly to the State Administration of Radio, Film and Television, and other organizations apply to the local radio and television administrative departments, and after reviewing at each level, report to the provincial radio and television administrative departments for approval.
3.? To apply for the TV Drama Production License (Type B), the applicant organization shall submit the following application materials:
(1) application report;
(2) Registration Form for Application of TV Drama Production License (Type B);
(3) a copy of the approval document of the subject matter planning of the State Administration of Radio, Film and Television (SARFT) for the establishment of the project;
(4) authorization letter of the scriptwriter;
(5) A copy of the contract or letter of intent of cooperation signed by the applicant organization with the producer, director, cameraman, main actors and other creators, and cooperative organizations (investment institutions). Among them, if overseas creators are hired to participate in the production, a copy of the approval document from the State Administration of Radio, Film and Television (SARFT) is also required;
(vi) "Radio and Television Program Production and Operation License" (copy) or the corresponding qualification certificates of the TV station or the film production organization;
(vii) proof of the implementation of the production funds issued by the licensed organization.
4. Provincial radio and television administrations shall report the issuance of the "TV Drama Production License (B)" to the SARFT for record within one week after the issuance.
5. If a TV drama production organization completes the production of more than six single dramas or more than three serial dramas (more than three episodes/part) within two consecutive years, it may apply to the SARFT for the qualification of "TV Drama Production License (Type A)" according to the procedures.
6. To apply for the TV Drama Production License (Category A), the applicant organization shall submit the following application materials:
(1) application report;
(2) application form for the TV Drama Production License (Category A);
(3) application for the TV Drama Production License (Category B) for the last two years (copy);
(4) Catalog of TV dramas completed in the last two years with the TV Drama Production License (Type B) and the corresponding TV Drama Distribution License (copy).
7. If the licensee applies for extension of the TV Drama Production License (Type A) after the expiration of the validity period, the extension shall be granted if the licensee meets the provisions of Article 17 of the Regulations and has no record of violation of the regulations; and the extension shall not be granted if the licensee fails to meet the above conditions.
8. Domestic radio and television broadcasters and radio and television program production and management organizations to cooperate with foreign organizations to produce radio and television programs, in accordance with the relevant provisions of the State Administration of Radio, Film and Television to declare.

State Administration of Radio, Film and Television Decree No. 34
Regulations on the Administration of Radio and Television Program Production and Operation, adopted by the Board of Governors of the State Administration of Radio, Film and Television at its meeting of June 15, 2004, are hereby promulgated and shall come into effect on August 20, 2004, as of the same date.
Chapter I: General Provisions
Article 1 The Provisions are formulated in accordance with the relevant laws and regulations of the State for the purpose of insisting on the correct orientation of broadcasting and television programs, promoting the prosperous development of the broadcasting and television program production industry, and serving the construction of socialist material and spiritual civilization.
Article 2 These provisions shall apply to the establishment of radio and television program production and management organizations or engage in the production of radio and television programs such as features, columns, variety shows, cartoons, radio dramas, television dramas and other radio and television programs, and the trading of program copyrights, agency transactions and other activities.
Institutions specializing in the production of radio and television advertising programs, their establishment and business activities are regulated in accordance with the Advertising Law and other relevant laws and regulations.
Article 3 The State Administration of Radio, Film and Television (hereinafter referred to as the State Administration of Radio, Film and Television) is responsible for formulating the development plan, layout and structure of the national radio and television program production industry, as well as managing, guiding and supervising the national radio and television program production and business activities.
Local radio and television administrations at or above the county level are responsible for the management of radio and television program production and operation activities within their administrative areas.
Article 4 The State implements a licensing system for the establishment of radio and television program production and management organizations or for engaging in radio and television program production and management activities.
The establishment of radio and television program production and management agencies or engaged in radio and television program production and management activities shall obtain a "radio and television program production and management license.
Article 5 The State encourages domestic social organizations, enterprises and institutions (excluding wholly foreign-owned enterprises or Chinese-foreign joint ventures and cooperative enterprises established within the territory) to set up radio and television program production and management agencies or engage in radio and television program production and management activities.
Chapter II License for Program Production and Operation Business
Article 6 The application for a Radio and Television Program Production and Operation License shall be in line with the national development plan, layout and structure of the radio and television program production industry, and shall have the following conditions:
(1) independent legal personality, and have the name of the institution, its organizational structure and articles of association which conform to the provisions of the national laws and regulations;
(2) the institution shall have the right to establish and operate radio and television programs in accordance with the provisions of the national laws and regulations.
(ii) have broadcasting and television and related professionals, funds and workplaces that are adapted to the needs of the business scope, of which the registered capital of the enterprise is not less than RMB 3 million;
(iii) in the three years prior to the date of application, its legal representative has no record of violation of laws or regulations or the institution has not been revoked the record of the "broadcasting and television program production and operation license";
(iv) other conditions stipulated by the laws , other conditions stipulated by administrative regulations.
Article 7 To apply for a Radio and Television Program Production and Operation License, the applicant organization shall submit the following materials to the approval authority at the same time:
(1) application report;
(2) articles of association of the radio and television program production and operation organization;
(3) application form for the Radio and Television Program Production and Operation License;
(4) materials of the main Personnel materials:
1. Certificate of identity (copy) and resume of the legal representative;
2. Resumes of the main management personnel (not less than three) in radio and television and related professions, performance or have participated in relevant professional training certificates and other materials.
(v) registered capital or proof of capital verification;
(vi) proof of office space;
(vii) enterprise and public utility licenses or business name approvals from the administrative department of industry and commerce.
Article VIII of the central unit in Beijing and its directly under the application of the "radio and television program production license", reported to the State Administration of Radio, Film and Television for approval; other organizations applying for the "radio and television program production license", to the location of the radio and television administrative departments to apply, after reviewing the level by level, reported to the provincial radio and television administrative departments for approval.
The approval authority shall make a decision of approval or disapproval within 20 working days from the date of receipt of complete application materials. In line with the provisions of Article 6 and Article 7 of the Regulations, the applicant shall be issued a "radio and television program production and operation license"; disapproved, the applicant shall be a written explanation of the reasons for non-approval.
The provincial radio and television administrative departments shall report the approval status to the SARFT for record within one week from the date of the approval or disapproval decision.
The License to Produce and Operate Radio and Television Programs is uniformly printed by the State Administration of Radio, Film and Television. It is valid for 2 years.
Article IX of the approval of the "radio and television program production and operation license" of the enterprise, with the license to the administrative department for industry and commerce for registration or business additions.
Article X has obtained the "radio and television program production and operation license" of the institutions in other provinces, autonomous regions and municipalities directly under the Central Government need to set up radio and television program production and operation of branches with independent legal personality, shall be in accordance with the provisions of Article 7 of these Regulations, to the branch where the provincial radio and television administrative departments to apply for a separate "broadcasting television program production and operation license", and to the original examination and approval authorities For the record;
The establishment of non-independent legal personality branch, do not need to apply for a separate "radio and television program production and operation license".
Article 11 The radio and television stations established in accordance with the law are not required to apply for a separate Broadcast Television Program Production and Operation License for the production and operation of radio and television programs.
Chapter IV Management
Article 21 An organization that obtains a Radio and Television Program Production and Operation License shall carry out its business activities in strict accordance with the scope of production and operation approved by the license.
Radio and television current affairs news and similar features, columns and other programs can only be produced by radio and television broadcasters, and other institutions that have obtained the "Radio and Television Program Production License" shall not produce current affairs news and similar features, columns and other radio and television programs.
Article 22 The production and operation of radio and television programs must comply with national laws, regulations and relevant policies. It is prohibited to produce and operate programs containing the following contents:
(1) opposing the basic principles determined by the Constitution;
(2) endangering the unity, sovereignty and territorial integrity of the country;
(3) leaking state secrets, endangering national security or harming the honor and interests of the country;
(4) inciting ethnic hatred and discrimination, undermining the unity of the nation, or infringing on national customs and habits. or infringing on national customs and habits;
(v) promoting cults and superstitions;
(vi) disrupting social order and undermining social stability;
(vii) promoting obscenity, gambling, violence or abetting crimes;
(viii) insulting or slandering others and infringing on their legitimate rights and interests;
(ix) jeopardizing social morality
(i) jeopardize social morality or the fine cultural traditions of the nation;
(j) have other contents prohibited by laws, administrative regulations and state provisions.
Article 23: The production of radio and television programs such as TV dramas on major revolutionary and historical themes and TV specials on theoretical literature shall be carried out in accordance with the relevant provisions of the State Administration of Radio, Film and Television.
Article 24 The distribution and broadcasting of radio and television programs such as TV dramas and animated films shall be subject to appropriate distribution licenses.
Article 25 Radio and television broadcasters shall not broadcast TV dramas and animated films produced by organizations that have not obtained the Radio and Television Program Production and Operation License and have not obtained the distribution permit.
Article 26 prohibits altering, renting, transferring, selling and forging the License to Produce and Operate Radio and Television Programs and the License to Produce Television Dramas in any way.
Article 27 If there is any change in the name, legal representative, address and constitution of the production organization as stated in the "Radio and Television Program Production License" and "Television Drama Production License (Type A)", or in the name of the production organization, the name of the drama, or the number of episodes as stated in the "Television Drama Production License (Type B)", the licensee shall report it to the original licensing authority to carry out the procedures of approval for the change; if a radio and television program production and operation activity is terminated, it shall be terminated within 1 week after the change. Termination of radio and television program production business activities, should be within one week to the original licensing authority for cancellation procedures.
Article 28 The issuance of Radio and Television Program Production License and Television Drama Production License shall be announced by the State Administration of Radio, Film and Television to the public.
Chapter V Penalties
Article 29 Violations of these provisions shall be punished in accordance with the Radio and Television Regulations. If it constitutes a crime, it shall be investigated for criminal responsibility according to law.
Chapter VI Supplementary Provisions
Article 30 The provisions of this August 20, 2004 shall come into force. The Ministry of Radio, Film and Television "Interim Provisions on the Administration of Film and Television Production and Operation Institutions" (Ministry of Radio, Film and Television Decree No. 16), "Provisions on the Administration of Television Drama Production Licenses" (Ministry of Radio, Film and Television Decree No. 17), and the General Administration of Radio, Film and Television "Implementing Rules on Implementing the System of Industry Entry for Broadcasting and Television Programming, Distribution and Production (for Trial Implementation)" (GDTVO [2001] No. 1476) are also repealed.
