Measures for the Administration of Waterway Transportation in Jiangxi Province (revised 1998)

Article 1 In order to strengthen the management of waterway transportation industry in our province, ensure legal operation and improve transportation efficiency, these measures are formulated in accordance with the Regulations on the Administration of Waterway Transportation in People's Republic of China (PRC) issued by the State Council and combined with the actual situation in our province. Article 2 These Measures shall apply to units and individuals engaged in waterway passenger and cargo transportation and transportation services within the territory of this province. Article 3 Commercial waterway transportation refers to the passenger and freight transportation that provides waterway transportation services for the society and settles the expenses; Commercial waterway transportation service refers to the labor service activities that provide services and settle expenses for waterway transportation.

Non-business transportation refers to transportation that serves the production and life of the unit without cost settlement. Fourth units and individuals engaged in water transport and water transport services must abide by the laws and regulations of the state and the water transport regulations issued by the transportation department. Article 5 Under the guidance of the state plan, waterway transportation shall follow the principle of diversified operation by regions, industries and departments, adhere to the coordinated development of various economic forms such as state-owned, collective and individual, and protect fair competition. Article 6 Without the approval of People's Republic of China (PRC) and the Ministry of Communications, foreign-funded enterprises, Chinese-foreign joint ventures and Chinese-foreign cooperative enterprises may not engage in waterway transportation in navigable waters of this province. 5. Conduct industry statistics and organize personnel training. Article 9 To establish a commercial waterway transport enterprise, the following conditions shall be met:

First, the ship must meet the requirements of technical specifications, and pass the inspection by the ship inspection department, and hold a valid ship certificate. The engineer must pass the examination by the navigation administration department and hold a valid crew job certificate issued by the navigation administration department;

Two, provide economic benefit demonstration data within the scope of business;

(3) Having an organization and person-in-charge for business management;

Four, there are places and its own liquidity that are suitable for the business project and scope. Article 11 An application for the establishment of a water transport service enterprise shall meet the conditions stipulated in Article 9, paragraphs 2, 3 and 4. Article 12 Units and individuals that meet the conditions stipulated in these Measures and apply for engaging in commercial waterway transportation or transportation services must submit a registration form for business opening approval to the navigation administration department at or above the county level in accordance with the classification approval authority with the certificates and relevant materials of the local people's governments at or above the township level. Port enterprises in the port area shall report to the port management authority. Article 13 The shipping administrative department shall, according to the management level, transportation capacity, technical status and passenger and cargo supply of water transport enterprises and other units and individuals engaged in commercial transportation, verify their business scope. Fourteenth shipping management departments to approve the establishment of water transport enterprises and other units and individuals engaged in business transportation issued transport licenses; Approved water transport service enterprises shall issue transport service licenses. Whether to approve or not, you should reply within forty days. Fifteenth units and individuals that have obtained transportation licenses or transportation service licenses may apply to the local administrative department for industry and commerce for industrial and commercial registration, and can only start business after obtaining a business license.

Those who participate in temporary business (less than one year) shall go through the formalities for examination and approval of temporary business with the local shipping management department, and the administrative department for industry and commerce shall issue a temporary business license. Article 16 Waterway transport enterprises, transport service enterprises and other units and individuals engaged in commercial transport shall go through the formalities of closing down their business in accordance with relevant regulations. Seventeenth water transport units and individuals approved by the administrative department for Industry and commerce (including temporary operation), the shipping management department shall issue business licenses according to the number of registered ships. One ship, one license, certificate to participate in the transportation of the approved navigation area. Eighteenth units and individuals engaged in non-business transportation, must hold the certificate of the competent unit, to the shipping management department for ship registration. Nineteenth waterway cargo transport in accordance with the provisions of the "Detailed Rules for the Implementation of the Contract for the Carriage of Goods by Waterway" to conclude a transport contract, the implementation of responsible transport. The transport of dangerous goods shall be handled in accordance with the Transport Rules of Dangerous Goods of the Ministry of Communications; Materials restricted by the state to be transported must go through the formalities of transportation approval according to regulations. Article 20 The transportation plan and port throughput plan of mandatory materials such as key materials, intermodal materials and foreign trade materials shall be comprehensively balanced by the transportation department or the shipping management department on the premise of confirming the transportation contract.

Units and individuals responsible for transportation and loading and unloading shall ensure the completion of the above-mentioned material transportation plan in a comprehensive and balanced manner. Twenty-first passenger and freight beyond the transportation plan determined by the comprehensive balance, water transport enterprises and other units and individuals engaged in business transportation can organize their own transportation within the approved scope.

No unit or individual may block or monopolize customers and commodities; Do not interfere with or crowd out the legitimate business activities of others.
