Notice of the General Office of the People's Government of Zhejiang Province on Printing and Distributing the Measures for the Administration of Key Projects in Zhejiang Province

Article 1 In order to strengthen the management of provincial key projects, ensure the engineering quality and construction progress of provincial key projects, improve the investment benefit and promote the sustained, rapid and healthy development of the national economy, these measures are formulated in accordance with the relevant provisions of the state and combined with the actual situation in our province. Article 2 The term "provincial key projects" as mentioned in these Measures refers to the following key projects that have a significant impact on national economic and social development as determined in the plan of large and medium-sized capital construction and technological transformation projects in this province:

(a) major projects of infrastructure, basic industries and pillar industries;

(two) high-tech projects that can promote the technological progress of the industry;

(three) cross regional projects that have a significant impact on the economic development of the whole province or region;

(four) projects that have a significant impact on social development;

(5) Other key projects.

Provincial key projects are divided into provincial key preparatory work projects and provincial key construction projects according to stages. Article 3 National key construction projects belong to provincial key construction projects in our province.

The provincial key construction projects in the city (prefecture) are the key construction projects in the city (prefecture). Fourth provincial key construction leading group and the provincial planning and Economic Commission are responsible for the decision-making, organization, coordination and comprehensive management of key preparatory work projects and key construction projects in the province. Its main responsibilities are:

(a) the implementation of national and provincial government guidelines and policies on key construction; Formulate and implement relevant policies for key provincial projects;

(two) the deployment of key projects in the province's preliminary work and key construction tasks;

(three) the examination and approval of provincial key preparatory work projects, provincial key construction projects (including construction preparation projects) and the list of projects put into production;

(four) to review the commencement report and assessment period of key construction projects in the province, examine and approve the annual production projects, and organize the completion and acceptance work;

(five) to coordinate and balance the allocation of funds and related manpower and material resources for key preparatory work projects and construction projects in the province;

(six) to cooperate with the organization department to determine the leading group of provincial key projects and to examine and approve the members of the on-site command organization of the project;

(seven) guidance, inspection and supervision of the province's key construction work, timely solve major problems;

(eight) responsible for the management of bidding investment, engineering consulting, supervision, quality and safety of key construction projects in the province. Fifth provincial key construction leading group office (hereinafter referred to as the provincial key office) and the provincial key construction leading group project prophase office (hereinafter referred to as the provincial project prophase office) are located in the Provincial Planning Commission, which are the daily working institutions of the provincial key construction leading group and are responsible for handling daily affairs. Article 6 According to the needs and possibilities of the national industrial policy and the national economic and social development, combined with the objectives and requirements set in the national economic and social development plan of our province, and in accordance with the principle of "focusing on key points and doing what you can", the provincial key preparatory work projects and provincial key construction projects are determined. Article 7 provincial key projects shall be determined once at the beginning of each year in principle, and the application shall be submitted to the provincial key office and the provincial preparatory office by the relevant departments of the city (prefecture) or the province, and shall be summarized by the provincial key office and the provincial preparatory office. After comprehensive balance by the Provincial Planning Commission, it shall be submitted to the provincial leading group for examination and approval. Where the key preparatory work projects included in the five-year plan of the province are approved by the feasibility study report of the project, they are preparatory projects for key construction of the province; After the preliminary design is approved to be included in the annual construction plan, it will be turned into a provincial key construction project.

Other special projects can be supplemented as key construction projects after the preliminary examination of the provincial key office and the approval of the provincial key construction leading group. Eighth in accordance with the provisions of the state, the provincial key projects to implement the registered capital system of investment projects, construction project legal person responsibility system (except some public welfare projects), construction project bidding system and project construction supervision system.

(a) according to the relevant provisions of the state, investment projects must be subscribed by investors according to the proportion of capital contribution announced by the state; Investors can enjoy the owner's rights and interests in proportion to their capital contribution, or transfer their capital contribution, but they may not withdraw their capital contribution in any way.

(two) the implementation of the project legal person responsibility system, that is, the project legal person is responsible for the whole process of project planning, fund raising, construction and implementation, production and operation, debt repayment and asset preservation and appreciation. After the approval of the new project proposal, the preparatory group of the project legal person shall be organized in time; When submitting the feasibility study report, the establishment plan of the project legal person shall be put forward at the same time; Without industrial and commercial registration and the funds are not in place on time, the project legal person shall not approve the preliminary design and commencement report.

Business projects also need to go through relevant procedures in accordance with the Company Law of People's Republic of China (PRC) and relevant national and provincial regulations.

(three) the supervision and construction of key construction projects in the province shall be carried out by the construction project legal person according to law, and the winning bidder shall be selected; At the same time, we should actively create conditions to carry out bidding for engineering design (scheme) and procurement of equipment and materials.

Provincial Planning and Economic Commission is responsible for the supervision and management of key project bidding.

(four) the provincial key construction projects shall be supervised, and the main contents of supervision are: controlling the investment, construction period and project quality of the project construction; Engineering construction contract management; Coordinate the working relationship between relevant units.

Provincial Planning and Economic Commission is responsible for the supervision and management of engineering construction supervision.
