The labor system can basically be divided into
Labor system can basically be divided into labor contract system, labor security system, labor employment system, labor arbitration system. The labor contract system refers to the system that specifically regulates labor contracts, called the labor contract system. The labor contract is closely related to every worker and is an agreement that every worker must sign when he or she goes to work and has a labor relationship with the employer. The content of the labor contract consists of the terms and conditions regarding the rights and obligations of the laborer and the employer, which are agreed upon after equal consultation.
According to Article 2 of the Law of the People's Republic of China on Labor Contracts, this Law shall apply to enterprises, individual economic organizations, private non-enterprise units and other organizations within the territory of the People's Republic of China (hereinafter referred to as the employer) in establishing labor relations with workers, and in concluding, fulfilling, altering, cancelling or terminating labor contracts.
State organs, institutions, social organizations and workers with whom they have established labor relations shall enter into, perform, change, cancel or terminate labor contracts in accordance with this Law.
Article 4 stipulates that employers shall establish and improve labor rules and regulations in accordance with the law, and ensure that workers enjoy their labor rights and fulfill their labor obligations.
When an employer formulates, amends or decides on rules and regulations or major matters directly affecting the immediate interests of workers, such as labor remuneration, working hours, rest and vacation, labor safety and health, insurance and welfare, employee training, labor discipline, and the management of labor quotas, the employer shall, through the employee representative assembly or all employees, discuss and put forward its proposals and opinions, and determine them through consultations on an equal footing with the trade unions or the representatives of the employees. Consultations shall be held with the trade unions or workers' representatives on an equal footing.
In the process of implementing the rules and regulations and deciding on important matters, if the labor union or the employees think that they are inappropriate, they have the right to propose to the employer that they be revised and improved through consultation.
The employer shall publicize the rules and regulations and decisions on important matters directly involving the immediate interests of the workers, or inform the workers.
