Regulations of Tianjin Municipality on the Protection of Historic Buildings (revised on 20 18)
The term "historical building area" as mentioned in these Regulations refers to the area where historical buildings are concentrated in pieces and the street landscape is relatively complete and coordinated. Article 4 The protection of historical buildings shall follow the principles of unified planning, classified management, effective protection and rational utilization. Article 5 The municipal and district people's governments shall strengthen their leadership in the protection of historical buildings within their respective administrative areas and provide necessary financial support. Article 6 The Municipal People's Government shall organize planning, real estate and other administrative departments to work out the protection plans for historical buildings and historic buildings in this Municipality. Seventh city real estate administrative departments in charge of the protection of historical buildings and historical buildings in this city.
The district real estate administrative department is responsible for the daily protection and management of historical buildings and historic buildings within its jurisdiction.
The municipal planning administrative department is responsible for the planning and management of historical buildings and historic buildings in this Municipality.
Construction, urban management, market supervision, public security, culture, tourism and other relevant administrative departments shall, in accordance with their respective responsibilities, assist in the protection and management of historical buildings. Article 8 An Expert Advisory Committee on the Protection of Historic Buildings (hereinafter referred to as the Expert Advisory Committee) shall be established in this Municipality to be responsible for the relevant assessment of the protection of historic buildings.
The Expert Advisory Committee is composed of experts in planning, architecture, cultural relics, history, society, economy, culture, law and real estate. Article 9 The protection, utilization, relocation and consolidation of historical buildings shall be organized and implemented by the historical building consolidation organization authorized by the Municipal People's Government. Article 10 The owners, managers and users of historical buildings shall bear the responsibility of protecting historical buildings.
Any unit or individual has the right to put forward opinions and suggestions on the protection and management of historical buildings, and has the right to report acts endangering historical buildings to the real estate administrative department. Eleventh units and individuals that have made remarkable achievements in the protection of historical buildings shall be commended and rewarded by the municipal or district people's government. Chapter II Confirmation Article 12 A building that has been built for more than 50 years may be recognized as a historic building under any of the following circumstances:
(a) architectural style, structure, materials, construction technology and engineering technology have architectural artistic characteristics and scientific value;
(two) reflect the history, culture and folk traditions of this city, with the characteristics of the times and regional characteristics;
(3) Having the characteristics of foreign architectural style;
(4) representative works of famous architects;
(5) Having special commemorative significance in the history of revolutionary development;
(6) representative workshops, shops, factories and warehouses in the history of industrial development;
(7) Former residences of celebrities;
(eight) other buildings with special historical significance.
Buildings that meet the provisions of the preceding paragraph but have been lost can also be identified as historical buildings if they are restored and rebuilt according to their original appearance. Thirteenth historical buildings are divided into three levels: special protection, key protection and general protection. Fourteenth building owners, managers and users, as well as other units and individuals, can recommend historical buildings to the municipal real estate administrative department.
City real estate administrative departments shall, according to the recommendations of relevant units and individuals and historical data, put forward a list of suggestions and protection levels of historical buildings, solicit opinions from the public, and report to the Municipal People's Government for confirmation and promulgation after review by the expert advisory committee. Fifteenth list of historical buildings proposed by the municipal real estate administrative department in conjunction with the municipal planning administrative department, and to solicit opinions from the public. After review by the expert advisory committee, it shall be reported to the Municipal People's Government for confirmation and announcement. Sixteenth historical buildings and historical buildings, the Municipal People's government set up a unified protection sign.
No unit or individual may set, move, smear, alter or damage historical buildings and historical building protection signs without authorization. Article 17 In the process of urban construction, if a building with protection value has not been recognized as a building with historical features, the real estate administrative department and the construction unit shall take protective measures before it is recognized as a building with historical features in accordance with the provisions of Article 14 of these regulations. Chapter III Protection and Utilization Article 18 Owners, managers and users of historical buildings shall ensure the structural safety, rational use, neatness and beauty of historical buildings and maintain their original features. Nineteenth historical buildings under special protection shall not change the external shape, decorative materials and colors of the building, and shall not change the internal main structure, plane layout and important decoration.
Historic buildings under special protection shall not change their external shapes, decorative materials and colors, and shall not change their internal important structures and decorations.
The general protection of historical buildings shall not change the external shape, color and important decorative materials of the building.
