Regulations of Jiangsu Province on Road Transportation
The road transport business mentioned in the preceding paragraph refers to the activities of providing paid services for automobile transport for the public, including road passenger (passenger) transport business and road cargo transport business. Road passenger transport (hereinafter referred to as passenger transport) includes bus passenger transport, chartered passenger transport, tourist passenger transport, bus passenger transport and taxi passenger transport; Road cargo transportation (hereinafter referred to as cargo transportation) includes general cargo transportation, special cargo transportation, large cargo transportation and dangerous cargo transportation.
Road transport-related businesses include motor vehicle maintenance, motor vehicle comprehensive performance testing, motor vehicle driver training, car rental, road transport stations (yards) and transportation logistics, freight forwarding, freight information services and other business operations. Article 3 The local people's governments at or above the county level shall strengthen their leadership over road transport management, coordinate the coordinated development of road transport and other modes of transport, optimize and adjust the road infrastructure, transport equipment and transport service structure, improve the modern road transport system, gradually realize the integration of urban and rural passenger transport and the specialization and intensification of freight transport, promote the development of transportation and logistics industry, and provide transport guarantee for promoting national economic development and improving people's lives.
The local people's governments at or above the county level shall give priority to the development of bus passenger transport, and give policy and financial support to the development of bus passenger transport, road transport stations (yards) and transportation logistics.
The local people's governments at or above the county level shall include the funds needed for road transport management into the fiscal budget at the corresponding level, and ensure the expenses needed for emergency transportation such as emergency rescue, disaster relief and war preparedness. Article 4 The transportation departments of local people's governments at or above the county level shall be responsible for organizing and leading the road transport management within their respective administrative areas, and the road transport management institutions shall be responsible for the specific implementation of road transport management.
Other relevant departments of the local people's governments at or above the county level shall, in accordance with their respective responsibilities, do a good job in road transport management. Article 5 The transportation departments of local people's governments at or above the county level shall, jointly with relevant departments, formulate road transport development plans in their respective administrative areas according to law, formulate industrial policies, and organize their implementation after approval by the people's governments at the same level.
Road transport development planning should be based on national economic and social development planning, linked with urban and rural planning and overall land use planning, and in line with the comprehensive transportation system development planning.
The layout and construction of traffic facilities such as road transport stations (fields), bus stops, taxi service centers and driver training and coaching venues shall be incorporated into urban and rural planning, and shall be planned and controlled when making regulatory detailed planning. Sixth road transport management should follow the principles of openness, fairness, efficiency and convenience, protect fair competition and stop illegal business.
Engaged in road transport and related business activities, should operate in accordance with the law, honesty and credit, fair competition. No unit or individual may block or monopolize the road transport market. Article 7 Road transport and related operators are encouraged to implement large-scale, intensive and corporatized operations, to engage in road transport and related business activities by using energy-saving and new-energy vehicles that meet national standards, and to develop transport modes such as drop-and-go transport and multimodal transport. Article 8 Road transport trade associations shall, in accordance with the principle of voluntary self-discipline and the articles of association of the trade associations, standardize and guide the business activities of their members, safeguard their legitimate rights and interests, and promote the healthy development of the road transport industry. Chapter II General Provisions Article 9 To engage in road transport and related business activities, one shall meet the conditions stipulated by laws, regulations and these Regulations, obtain a road transport license according to law, and engage in business activities according to the approved time limit, scope, types, projects, regions and places.
Vehicles used for passenger transport, freight transport, motor vehicle driver training, car rental, transportation and logistics operations shall, in accordance with state regulations, apply to the road transport management institution at or above the county level where the vehicle registration is located, and carry them with the vehicle. Article 10 Passenger and freight drivers, road dangerous goods transport loading and unloading management personnel and escorts, motor vehicle driving training coaches and motor vehicle maintenance and inspection technicians specified by the state shall take the examination to obtain qualification certificates in accordance with the provisions of the state, and carry them with them when engaging in road transport and related business activities. Article 11 If road transport and related business operators fail to operate for more than 180 days from the date of obtaining the business license without justifiable reasons, or stop operating for 180 days after opening, the road transport management institution shall cancel the corresponding road transport business license and road transport license.
Road transport and related business operators who change the administrative licensing items of road transport and related business shall apply to the road transport management institution that has made the decision on administrative licensing; In line with the statutory conditions and standards, the road transport management institution shall go through the formalities for change according to law.
Bus passenger transport, chartered passenger transport, tourist passenger transport and taxi passenger transport operators need to terminate their operations, they shall inform the road transport management institution that has made the administrative licensing decision 30 days in advance. If a public passenger transport operator needs to terminate its operation, it shall apply to the road transport management institution that has made the administrative licensing decision 90 days in advance; It shall not be stopped without approval.
