Regulations on Ecological Environment Protection in Gannan Tibetan Autonomous Prefecture of Gansu Province

Grassland Law", "Chinese People's *** and State Water Law", "Chinese People's *** and State Forestry Law", "Chinese People's *** and State Mineral Resources Law", "Gansu Provincial Environmental Protection Regulations", "Gansu Gannan Tibetan Autonomous Prefecture Autonomous Region Regulations" and other relevant laws and regulations, combined with the actual ecological environment of the Autonomous Prefecture, the formulation of these regulations. Article 2 The environment referred to in these regulations refers to the atmosphere, water, land, soil, wetlands, mineral deposits, forests, grasslands, wildlife, micro-organisms and natural relics, humanistic relics and scenic spots.

The ecological environment protection referred to refers to the protection, management and construction of the natural ecological environment and human living environment.

The scope of protection of forest and wetland resources referred to in these Regulations refers to the forest and wetland resources under the jurisdiction of the People's Government of the Autonomous Prefecture. Article 3 Citizens, legal persons and other organizations engaged in activities such as resource development, production and living, engineering construction, teaching and research related to the ecological environment, as well as the implementation of ecological environmental protection, governance and supervision in the administrative area of the Autonomous Prefecture shall abide by these Regulations.

Ecological restoration projects shall be designed, constructed and put into use at the same time as construction projects. Article 4 Ecological environmental protection shall aim at maintaining biodiversity and protecting natural ecosystems, focusing on water bodies, forests, grasslands, wetlands, wildlife and plants, and adhering to the principles of conservation priority, scientific planning, strict management, sustainable utilization and public participation. Article 5 The people's governments of the autonomous prefectures and counties (cities) shall strengthen the research and development of scientific and technological research on ecological environmental protection, encourage scientific and technological innovation, and promote the application of advanced technologies for the protection of forests, grasslands, wetlands and biodiversity, ecological restoration, soil and water conservation, and the conservation and recycling of resources.

The people's governments of the autonomous prefectures and counties (cities) shall promote new energy development technologies such as wind and light energy, reduce greenhouse gas emissions, reduce environmental pollution and promote sustainable development. Article 6 The autonomous prefectures implement the system of paid use of ecological resources development and resource compensation.

The people's governments of the autonomous prefectures and counties (cities) to set up special funds for ecological protection and ecological benefit compensation fund. Special funds for ecological protection are mainly used for the protection and construction of grasslands, forests and wetlands, and for the prevention and control of natural disasters. Eco-efficiency compensation fund is mainly used for local farmers and herdsmen to protect and build grasslands, forests, wetlands compensation. Specific measures shall be formulated by the People's Government of the Autonomous Prefecture. Article 7 The ecological environmental protection within the administrative area of the autonomous prefectures implements the management system of unified leadership by the government, division of labor and responsibility among departments, and participation by the whole society*** together. The autonomous prefectures implement a target responsibility system for ecological environmental protection. The people's government of the autonomous prefectural government to formulate ecological environmental protection objectives, the people's governments of counties (cities) to check the implementation of the assessment, the results of the assessment to the public.

The people's governments of the autonomous prefectures and counties (cities) are responsible for ecological environmental protection in their administrative areas; the competent departments of environmental protection are responsible for the management, coordination and supervision of ecological environmental protection in their administrative areas. Development and reform, land, transportation, water and electricity, agriculture and animal husbandry, forestry and other departments in conjunction with the competent department of environmental protection, in accordance with their respective responsibilities **** with the work of ecological environmental protection.

Township (township) people's governments and street offices are responsible for ecological environmental protection in their administrative areas, and set up organizations and staff responsible for ecological environmental protection.

Village committees and other self-governing organizations shall formulate village rules and regulations for ecological environmental protection, and do a good job of ecological environmental protection in the region.

Citizens, legal persons and other organizations are obliged to protect the ecological environment of responsibility, and have the right to report, charge the destruction of the ecological environment. Article 8 The people's governments of the autonomous prefectures and counties (cities) shall incorporate funds for ecological environmental protection into their financial budgets and increase them year by year in accordance with local financial resources.

The autonomous prefectures encourage and support citizens, legal persons and other organizations to donate and invest in the cause of ecological environmental protection and construction, and respect and protect the legitimate rights and interests of donors and investors. Article 9 The people's governments of the autonomous prefectures and counties (cities) shall widely carry out publicity and education on ecological environmental protection and construction, and enhance the awareness of ecological environmental protection and legal consciousness of the whole society. Article 10 The people's governments of the autonomous prefectures and counties (cities) shall commend and reward the units and individuals who have made remarkable achievements in the work of ecological environmental protection. Chapter II ecological environmental protection planning and ecological function zoning Article 11 The competent department of environmental protection of the people's governments of the autonomous prefectures and counties (cities) shall organize the development and reform, land, forestry, agriculture and animal husbandry, hydropower, construction, transportation, tourism and other relevant departments to prepare a general plan for ecological environmental protection within the administrative jurisdiction, the people's government of the people's government of the level of examination and report to the people's government of the higher level for approval and implementation.

The ecological civilization construction plan prepared by the people's governments of the autonomous prefectures and counties (cities) shall include the long-term and near-term goals of ecological environmental protection, the key areas of protection, the main tasks, and governance measures.
