Shanghai Water Transport Management Regulations (2003 revision)

Chapter 1 General Provisions Article 1 In order to maintain the order of the city's water transport market, protect the legitimate rights and interests of water transport operators, passengers, cargo owners and other parties, promote the development of water transport, and standardize the management of water transport, in accordance with relevant national laws and regulations

, this regulation is formulated based on the actual situation of this city.

Article 2 These regulations apply to commercial domestic and international waterway cargo transportation, waterway passenger transportation (including tourist transportation) and waterway transportation services (hereinafter collectively referred to as waterway transportation) and related management activities within the administrative region of this city.

Article 3 The Shanghai Municipal Port Administration Bureau (hereinafter referred to as the Municipal Water Transport Administrative Department) is responsible for the management of water transport in this city and organizes the implementation of these Regulations; Pudong New District, Jiading District, Minhang District, Baoshan District, Jinshan District, Songjiang District, Qingpu District

The water transport administrative departments of the District, Nanhui District, Fengxian District and Chongming County [hereinafter collectively referred to as the district (county) water transport administrative departments] are responsible for the management of water transport within their respective administrative areas.

The Shanghai Navigation Management Office (hereinafter referred to as the Municipal Navigation Office) under the municipal water transport administrative department is responsible for the specific management of water transport in this city; the Navigation Management Office (office) under the district (county) water transport administrative department [hereinafter referred to as the district]

(County) Navigation Administration (Institute)], under the professional guidance of the Municipal Navigation Office, is responsible for the specific management of waterway transportation within its own administrative region.

The relevant administrative departments of this city, as well as administrative departments such as maritime safety supervision, ship inspection, and customs, shall coordinate the implementation of these Regulations in accordance with their respective responsibilities.

Article 4 The management of waterway transportation shall follow the principles of protecting legal operations, maintaining fair competition, and adhering to coordinated development, and promote waterway transportation to provide safe, punctual, fast, economical, and convenient services for the development of the national economy and society.

Article 5 The municipal water transport administrative department shall, in accordance with the needs of economic and social development, prepare the municipal water transport development plan, submit it to the Municipal People's Government for approval and then organize its implementation.

Article 6 An industry association organized by water transport operators in accordance with the law shall establish an industry self-discipline mechanism in accordance with laws and regulations; provide policy and information consulting services to operators, and safeguard the legitimate rights and interests of operators; accept the entrustment of the municipal water transport administrative department to conduct

Provide guidance on the business activities of water transport operators; provide opinions and suggestions to the municipal water transport administrative department.

Chapter 2 Basic Provisions Article 7 This city implements a licensing system for commercial waterway transportation.

To engage in commercial waterway transport activities, one must obtain legal waterway transport business qualifications in accordance with laws, regulations and waterway transport regulations issued by the national waterway transport administrative department, and operate within the approved business scope.

Article 8 To establish a waterway cargo transportation or passenger transportation enterprise, the following conditions must be met: (1) Have ships suitable for the business scope and hold a valid ship certificate issued by the ship inspection department; (2) Have corresponding organizational structures and

Professionals; (3) The main crew members hold valid certificates of competency; (4) Have fixed business premises and necessary facilities, and those operating passenger transport must also implement docking stations along the passenger ship line; (5) Have business scope related to

Appropriate registered capital.

To open an individual industrial and commercial household for waterway cargo transportation or passenger transportation, the conditions specified in items (1), (3), (4) and (5) of the preceding paragraph shall be met.

If the state stipulates that third-party liability insurance, passenger accident insurance and ship insurance are required, proof of insurance must also be provided.

Article 9 To establish a water transport service enterprise, the following conditions must be met: (1) Have corresponding organizational structures and professionals; (2) Have a fixed business location and necessary business facilities; (3) Have a business scope that is compatible with the business scope

Registered capital.

The conditions for setting up individual industrial and commercial households providing water transport services shall be handled in accordance with national regulations.

Article 10 Applications for engaging in domestic waterway transport shall be submitted to the Municipal Navigation Affairs Office or the local district (county) navigation administration office (office); applications for engaging in international waterway transport shall be submitted to the municipal waterway transport administrative department.

The accepting authority shall submit the application to relevant authorities for review and approval in accordance with its authority for review and approval.

The municipal examination and approval authority shall make a written examination and approval decision within the prescribed time limit.

If it is decided to approve, a water transport license, a water transport service license or relevant approval documents will be issued according to its business scope.

The establishment of water transport enterprises with foreign investment must be reviewed by the municipal water transport administrative department and go through the approval procedures in accordance with relevant laws and regulations.

Article 11 Those who have obtained a water transport license and water transport service license or approval document shall register with the industrial and commercial and taxation administrative departments with the certificate or approval document, and can only operate after obtaining a business license and tax registration certificate upon approval.

Article 12 The waterway cargo transportation and passenger transportation operators in this city who are engaged in domestic waterway transportation shall obtain the ship business transportation certificate and relevant business documents from the Municipal Navigation Office according to the ship applied for approval.

The ship's business transportation certificate must be carried with the ship.
