Shenzhen Cultural Industry Promotion Regulations

Chapter I General Provisions Article 1 In order to y implement the strategy of establishing culture in the city, improve and perfect the mechanism of promoting and safeguarding the development of cultural industries, accelerate the pace of development of cultural industries, and enhance the soft power of culture, according to the provisions of relevant national laws and regulations, combined with the actuality of Shenzhen City (hereinafter referred to as the city), to formulate the Regulations. Article 2 The cultural industry referred to in these regulations refers to the activities of providing cultural and entertainment products and services for the public, and the collection of activities related to these activities.

The cultural enterprises referred to in these Regulations refer to the production and operation units engaged in the production and operation activities stipulated in the preceding paragraph. Article 3 The promotion of the development of cultural industries shall be guided by the following principles:

(1) integrated planning and coordinated development;

(2) encouragement of independent innovation;

(3) support for distinctive and advantageous cultural industries;

(4) strengthened protection of intellectual property rights;

(5) unification of social and economic benefits. Article 4 The people's governments of cities and districts (hereinafter referred to as the city and district governments) shall formulate plans for the development of cultural industries and incorporate them into the national economic and social development plans as well as the overall planning of cities.

City and district governments shall take various forms to widely solicit opinions from all sectors of the society when formulating the development plan of cultural industries. Article 5 The municipal and district governments shall, according to the development plan of cultural industries, formulate corresponding policies on cultural industries; the encouraging cultural industry projects which are included in the government investment-oriented catalog shall be guided and supported. Article 6 The municipal and district governments shall give priority to supporting the development of new and original cultural industries, focusing on supporting characteristic and advantageous cultural industries, and actively promoting the industrialization of national and traditional cultures in terms of land, capital and talents.

Encourage and support the development of non-publicly owned cultural enterprises. Article 7 The administrative affairs agencies of the municipal government for the development of cultural industries shall perform the following duties:

(1) to carry out and implement the laws, regulations and rules relating to the development of cultural industries;

(2) to organize the formulation and implementation of the planning and policies for the development of cultural industries;

(3) to take part in the formulation of the catalog for guiding the governmental investment, and to take part in the argumentation and examination of the cultural industry projects invested by the government;

(4) to encourage the development of non-public cultural enterprises and to support the development of non-public cultural enterprises.

(4) to provide comprehensive coordination, guidance and services for the development of cultural industries;

(5) to coordinate and guide the construction of cultural industry parks and bases as well as the pre-declaration of cultural industry projects, and to promote the construction of major cultural industry projects;

(6) to organize and guide the construction of cultural industry exhibition and trading, information platforms, and public **** technology platforms;

(vii) to supervise the special funds for the development of cultural industries in accordance with the relevant provisions;

(viii) other duties as stipulated by laws and regulations and assigned by the municipal government.

The relevant departments of the municipal government shall promote the development of cultural industries within their respective scope of responsibilities. Chapter II Entrepreneurial Development Support Article 8 The municipal and district governments shall establish and improve the information, technology and trading service platforms for the development of cultural industries, build a support system for the development of cultural industries in the city, and create an environment conducive to the promotion of the development of cultural industries and the creation of well-known cultural brands. Article 9 The municipal and district governments and judicial organs shall strengthen the construction of intellectual property protection system and improve the mechanism of administrative enforcement and judicial protection of intellectual property. Actively provide intellectual property rights public **** services, support and guidance to cultural enterprises to enhance the awareness and ability of self-defense. Article 10 The municipal and district governments shall support the construction of cultural industry parks and bases, support the establishment of enterprise-led, market-oriented operation of cultural industry parks and bases, and guide the relevant cultural enterprises and intermediary institutions to enter the cultural industry parks and bases. It shall build national-level creative industry parks and actively attract well-known cultural enterprises, intermediary organizations and research and training institutions to set up their headquarters or R&D, manufacturing, purchasing and financial centers in the parks.

Support the transformation of old urban areas, old villages, old industrial areas into cultural industry parks and bases. Article 11 guides the establishment of all kinds of trade associations in the field of cultural industry according to law. Article 12 encourages the development of independent, impartial and standardized operation of cultural intermediaries to enhance the service function.

Encourage intermediary organizations to provide services for cultural enterprises in market development, investment and financing, property rights trading, cultural brokerage, qualification certification. Article 13 State organs, institutions and social organizations, in the use of government financial funds for the procurement of cultural products and services, under the same conditions shall give priority to the procurement of national independent and innovative cultural products and cultural services. Article 14 The cultural enterprises can enjoy the national, provincial and municipal preferential policies to support the development of cultural industry in accordance with the relevant provisions. Recognized as high-tech enterprises, can also choose to enjoy the national, provincial and municipal support for the development of high-tech industry preferential policies. Article 15 The city and district governments shall establish a scientific and reasonable evaluation and incentive mechanism. To obtain the annual best creative achievement transformation, the annual largest export volume of cultural enterprises and for the development of cultural industries in the city to make outstanding contributions to the individual to give appropriate incentives. Chapter III Export Support Article 16 encourages and supports cultural enterprises to engage in the following cultural products and services export business according to law:

(1) to go abroad to carry out commercial performances of music, drama, acrobatics, folklore, etc.;

(2) to go abroad to carry out commercial exhibitions, exhibitions, sales of books, newspapers and periodicals, electronic publications, arts, crafts and other activities.
