Scope of cases accepted by railway transport courts

Legal analysis: the railway transport court accepts criminal cases prosecuted by the railway transport procuratorate at the same level and private prosecution cases filed by private prosecutors to the railway transport court according to law. Civil lawsuits involving railway transportation, railway safety and railway property are also under the jurisdiction of the railway transportation court: disputes over railway passengers and luggage transportation contracts; Disputes over railway freight transport contracts and railway freight transport insurance contracts; Disputes over international railway intermodal transport contracts and multimodal transport contracts with railway transport enterprises as operators; Consignment, packaging, warehousing, distribution and other railway transportation extension service contract disputes; Contract disputes such as outsourcing services and contracting occurred in railway transportation enterprises in loading and unloading operations and line maintenance; Contract disputes related to the construction of railways and their ancillary facilities; Contract disputes such as procurement, installation, processing contract, maintenance and service of railway equipment and facilities; Disputes over compensation for personal and property damage caused by railway traffic accidents and other railway operation accidents; Infringement disputes that violate the laws and regulations on railway safety protection and cause damage to railway lines, vehicles, safety facilities and other property; Environmental pollution infringement disputes caused by railway construction and railway transportation; Property right disputes of railway transport enterprises.

Legal basis: Several Provisions of People's Republic of China (PRC) and the Supreme People's Court on the Jurisdiction of Railway Transport Courts.

Article 1 The railway transport court shall accept criminal cases prosecuted by the railway transport procuratorate at the same level according to law. The following criminal prosecution cases are under the jurisdiction of the railway transport court where the crime occurred: crimes in railway working areas such as stations, freight yards and transport command institutions; Crimes against railway lines, rolling stock, communications, electric power and other railway equipment and facilities; Crimes committed by employees of railway transport enterprises in performing their duties. If a crime is committed on a train, it shall be under the jurisdiction of the railway transport court at the location or destination of the station where the train stops first after the crime is committed; However, crimes committed on international trains shall be governed by relevant jurisdiction agreements signed between China and relevant countries. If there is no agreement, it shall be under the jurisdiction of the railway transport court of the place or destination where the train stops first after the crime.

Article 2 Where a private prosecutor files a private prosecution on a criminal private prosecution case within the scope of the second and third paragraphs of Article 1 of these Provisions, the railway transport court shall accept it.
