Measures of Zhengzhou Municipality on the Protection of Intangible Cultural Heritage
The term "intangible cultural heritage" as mentioned in these Measures refers to various forms of traditional cultural expressions handed down from generation to generation by people of all ethnic groups as part of their cultural heritage, as well as objects and places related to traditional cultural expressions. Including:
(1) traditional oral literature and the language as its carrier;
(2) Traditional arts, calligraphy, music, dance, drama, folk art and acrobatics;
(3) Traditional skills, medicine and calendars;
(4) Traditional etiquette, festivals and other folk customs;
(5) Traditional sports and entertainment;
(six) other intangible cultural heritage that needs protection. Article 3 The protection and preservation of intangible cultural heritage should pay attention to authenticity, integrity and inheritance, and adhere to the principles of government leading, social participation, protection first, rescue first, rational utilization and inheritance and development. Article 4 The people's governments of cities and counties (cities, districts) shall strengthen their leadership in the protection of intangible cultural heritage within their respective administrative areas and incorporate the protection of intangible cultural heritage into the national economic and social development plan at the corresponding level; Establish a funding guarantee mechanism that is compatible with the protection of intangible cultural heritage, and the protection funds will be included in the fiscal budget at the same level. Article 5 The municipal administrative department of intangible cultural heritage shall be responsible for the protection of intangible cultural heritage in the whole city, and the administrative departments of intangible cultural heritage in counties (cities) and districts shall be responsible for the protection of intangible cultural heritage within their respective administrative areas.
Development and reform, finance, natural resources and planning, human resources and social security, science and technology, sports, education, health and market supervision and other relevant departments shall, within their respective functions and duties, do a good job in the protection of intangible cultural heritage.
Township (town) people's governments and sub-district offices shall cooperate with the protection of intangible cultural heritage. Article 6 The people's governments of cities and counties (cities, districts) shall organize the administrative departments of intangible cultural heritage and relevant departments to establish a joint conference system for the protection of intangible cultural heritage, and hold regular meetings to study and coordinate major issues in the protection of intangible cultural heritage. The joint meeting mainly performs the following duties:
(a) to study and formulate joint protection measures;
(two) jointly promote the implementation of important projects;
(3) Coordinate and solve outstanding problems;
(four) to guide, supervise and inspect the protection of intangible cultural heritage;
(five) other important matters that need to be resolved through coordination.
The daily work of the joint meeting shall be undertaken by the administrative department of intangible cultural heritage. Article 7 The administrative departments of intangible cultural heritage of cities and counties (cities, districts) shall organize the preparation of intangible cultural heritage protection plans within their respective administrative areas, which shall be implemented after being approved by the people's governments at the same level and reported to the administrative departments of intangible cultural heritage at the next higher level for the record. Article 8 Citizens, legal persons and other organizations are encouraged and supported to participate in the protection of intangible cultural heritage through research, exhibition, inheritance, collection, donation and voluntary service. Article 9 The people's governments of cities and counties (cities, districts) and their administrative departments of intangible cultural heritage shall, in accordance with relevant regulations, commend and reward citizens, legal persons and other organizations that have made outstanding contributions to the protection and preservation of intangible cultural heritage. Chapter II Investigation and Management Article 10 The administrative departments of intangible cultural heritage of cities and counties (cities, districts) shall, according to the protection and preservation of intangible cultural heritage within their respective administrative areas, organize and carry out surveys of intangible cultural heritage on a regular basis, so as to fully grasp its types, quantity, distribution, living environment and protection status.
Other relevant departments may investigate the intangible cultural heritage within their scope of work. Eleventh city and county (city, district) administrative departments of intangible cultural heritage and other relevant departments shall establish and improve the information sharing mechanism of intangible cultural heritage survey.
Other relevant departments shall, within 30 days after the investigation of intangible cultural heritage, submit the objects, pictures, copies and related materials to the administrative department of intangible cultural heritage at the same level. Twelfth city and county (city, district) administrative departments of intangible cultural heritage shall record the intangible cultural heritage in a true, systematic and comprehensive way through words, audio, video and digital multimedia. , the establishment of intangible cultural heritage files, properly preserve the relevant physical objects and materials. Thirteenth city and county (city, district) administrative departments of intangible cultural heritage shall establish intangible cultural heritage database and digital protection system platform, and carry out digital protection, dissemination, promotion and transformation of intangible cultural heritage.
Unless it should be kept confidential according to law, the archives of intangible cultural heritage and related data and information should be made public. City, county (city, district) administrative departments of intangible cultural heritage should improve the convenience measures such as inquiry, reading and copying to facilitate public access. Article 14 The administrative departments of intangible cultural heritage of cities and counties (cities, districts) shall, jointly with the relevant departments of natural resources, planning and cultural relics protection, delimit the scope of protection of buildings, sites, relics and their appendages directly related to intangible cultural heritage, and take effective measures to protect them. No unit or individual may move, dismantle or destroy it without authorization.
