Regulations on Urban and Rural Planning and Construction Management in Qianxinan Buyi and Miao Autonomous Prefecture

Chapter I General Provisions Article 1 In order to strengthen the management of urban and rural planning and construction in the Autonomous Prefecture, coordinate the spatial layout of urban and rural areas, improve the urban and rural habitat, and promote the comprehensive, coordinated and sustainable development of the economy and society, in accordance with the "Law of the People's Republic of China on Regional Ethnic Autonomy," "Law of the People's Republic of China on Urban and Rural Planning," "Law of the People's Republic of China on Architecture," and other relevant laws and regulations, and in conjunction with the actuality of the Autonomous Prefecture, these regulations have been formulated. Formulate these regulations. Article 2 These Regulations shall apply to urban and rural planning, construction and management activities within the administrative area of the Autonomous Prefecture. Article 3 The urban and rural planning area referred to in these regulations refers to the built-up areas of urban and rural areas, as well as urban and rural construction and development needs to implement planning control areas. The specific scope of the planning area by the relevant people's government in the organization of the preparation of the city master plan, township master plan, township planning and village planning, according to the level of economic and social development of urban and rural areas and the need for integrated urban and rural development delineation.

The management of urban and rural planning and construction referred to in these regulations includes the management of urban and rural planning, urban and rural construction, environmental sanitation, landscaping and maintenance of municipal facilities. Article 4 The people's governments at all levels in the autonomous prefectures shall incorporate urban and rural planning and construction management into national economic and social development planning. The funds required for urban and rural planning and urban and rural management shall be included in the financial budget. Article 5 the people's governments at or above the county level, the administrative department of urban and rural planning and construction is responsible for the management of urban and rural planning and construction in the administrative area, other relevant departments in accordance with their respective responsibilities, urban and rural planning and construction management.

The people's governments at the township level are responsible for planning and construction management in their respective areas according to law.

Street offices (community), village (neighborhood) shall assist in urban and rural planning and construction management. Article 6 The township system planning, city (county) master plan, before reporting to the people's government at the next level for approval, shall be considered by the standing committee of the people's congress at this level, and announced to the public; other township master plan, township planning, before reporting to the people's government at the next level for approval, shall be considered by the township and township people's congress, and announced to the public. Once a plan has been approved, it may not be modified without authorization. Where modification is necessary, it shall be reported to the Standing Committee of the People's Congress or the People's Congress at the present level for consideration and the consent of the original approving authority.

The people's governments at all levels shall report annually to the people's congresses or standing committees of the people's congresses at their level or on the implementation of urban and rural planning and construction management. The composition and rules of procedure of the urban and rural planning committees shall be prescribed by the people's government at the same level.

The master plan of a city, the master plan of a town organized by the people's government at or above the county level, as well as the relevant special plans and detailed control plans shall be submitted to the urban and rural planning committee of the same level for deliberation and approval before they are submitted for approval. Article 8 Urban and rural planning in the Autonomous Prefecture shall be organized for preparation and approval in accordance with the following provisions:

(1) The preparation of planning for cross-county or city administrative areas shall be entrusted by the counties or cities involved, and shall be approved by the people's government of the Prefecture;

(2) The master plans of key towns and demonstration towns, etc., determined by the people's government of the Prefecture shall be approved by the people's government of the Prefecture;

(3) Where there are other provisions in the laws and regulations for the preparation and approval are subject to other provisions. Article 9 The preparation of urban and rural planning shall be connected with the national economic and social development planning and the overall land use planning, etc., and the scale of development of towns and cities shall be scientifically and reasonably determined. Urban and rural infrastructure, public **** service facilities and other special planning shall be connected with each other.

The urban and rural planning should establish the concept of green development, and promote the construction of ecological civilization. Urban and rural planning should be in line with the natural ecological characteristics of mountain tourism, reflecting the green space, mountains, wetlands, fields, forests and urban and rural integration of spatial form, highlighting the regional characteristics, national characteristics and style of the times.

The people's governments at or above the county level in the development and implementation of urban and rural planning management shall strengthen the protection of local history and culture, national culture and traditional villages, heritage and rational use of ancient sites and ancient architecture, modern historical buildings, approved historical and cultural cities, towns, villages and neighborhoods should be prepared for the special planning, reflecting the characteristics of the national culture and the continuation of the historical lineage. Article 10 The administrative department of urban and rural planning shall, in accordance with the requirements determined by the detailed planning of control, review the nature of the use of construction projects, building density, building height, floor area ratio, green space rate, infrastructure and public **** service facilities supporting the content. Article 11 After the completion of housing construction projects, shall not be arbitrarily added layers, widening or additional ancillary facilities, etc., do need to remodel or change the nature of the use of the relevant procedures must be carried out in accordance with the law. Article XII of the people's government of the autonomous prefectural people's government shall be the county (city) people's government and development zones, industrial parks for the implementation of the planning of the situation of audit and supervision, to maintain the authority and continuity of planning. Chapter III Urban and Rural Construction Article 13 Construction activities within the urban and rural planning areas shall be subject to relevant formalities in accordance with law. Article 14 Before the commencement of a construction project, except for those that can be retained in accordance with the law, the construction unit shall demolish all the original buildings and structures within the scope of the construction site within the prescribed period. Temporarily retained construction facilities shall be removed immediately after the completion of the project. Article 15 The administrative department of urban and rural construction at the county level shall strengthen the guidance on the design and construction of residential housing for villagers (residents). Village (residents) new construction, alteration, expansion of three-story and more than three-story residence, shall be designed by the design unit with appropriate qualifications, or constructed in accordance with the general standard design drawings provided by the competent administrative department of construction at or above the county level at no cost.
