Measures of Anhui Province for the Administration of Provincial Grain Reserves

Chapter I General Provisions Article 1 In order to strengthen the management of provincial-level grain reserves, ensure the authenticity, quality and storage safety of provincial-level grain reserves, maintain the stability of the grain market, and give full play to the role of provincial-level grain reserves in macro-control, these measures are formulated in accordance with the Regulations of the State Council on the Administration of Central Grain Reserves and combined with the actual situation of this province. Article 2 The term "provincial grain reserves" as mentioned in these Measures refers to the grain reserved by the provincial people's government for regulating the total grain supply and demand in the province, stabilizing the grain market, and responding to major natural disasters or other emergencies. Third units and individuals engaged in and participating in the management and supervision of provincial grain reserves shall abide by these measures. Article 4 The management of provincial-level grain reserves shall be based on strict system, strict management and strict responsibility, so as to ensure the true quantity, good quality, safe storage, good management, proper adjustment and use of provincial-level grain reserves, and save costs and expenses.

Without the approval of the provincial people's government, no unit or individual may use provincial grain reserves without authorization. Article 5 The grain administrative department of the provincial people's government shall be responsible for the management of provincial grain reserves, and supervise and inspect the quantity, quality and storage safety of provincial grain reserves; In accordance with the national and provincial regulations, rules, national standards and technical specifications on the management of provincial grain reserves, establish and improve the business management system of provincial grain reserves, and report it to the provincial people's government for the record.

According to the authorization of the administrative department of grain of the provincial people's government, the administrative department of grain of the municipal people's government divided into districts is responsible for assisting in the management of provincial grain reserves and is responsible for the quantity, quality and storage safety of provincial grain reserves. Article 6 The administrative department of grain of the provincial people's government shall, jointly with the administrative department of development, reform and finance of the provincial people's government, be responsible for drawing up macro-control opinions on the total amount, layout and utilization of provincial grain reserves, and organize their implementation after approval by the provincial people's government.

The financial administrative department of the provincial people's government shall be responsible for arranging the loan interest, management fees and rotation subsidies for provincial grain reserves according to the actual situation of the province, and supervise and inspect the financial implementation of provincial grain reserves.

Anhui Branch of China Agricultural Development Bank (hereinafter referred to as the Provincial Agricultural Development Bank) shall, in accordance with the relevant provisions of the state, timely and fully arrange the loans required for provincial grain reserves, and implement credit supervision on the loans issued for provincial grain reserves. Article 7 No unit or individual may cheat, occupy, intercept or misappropriate provincial grain reserve loans or loan interest, management fees and rotation subsidies in any way. Article 8 No unit or individual may damage the storage facilities of provincial grain reserves, or steal, plunder or damage provincial grain reserves.

The people's governments of the places where provincial grain reserves are stored shall promptly organize relevant departments to stop and investigate and deal with illegal acts of destroying provincial grain reserves storage facilities, stealing, looting or damaging provincial grain reserves. Ninth any unit or individual has the right to report the illegal acts in the operation and management of provincial grain reserves to the administrative department of grain of the provincial people's government and other relevant departments. After receiving the report, the relevant departments shall promptly investigate and deal with it; If the handling of reported matters falls within the responsibilities of other departments, it shall be transferred to other departments in a timely manner. Chapter II Provincial Grain Reserve Plan Article 10 The storage scale, variety and overall layout plan of provincial grain reserves shall be put forward by the grain administrative department of the provincial people's government in conjunction with the development and reform of the provincial people's government and the financial administrative department according to the needs of macro-control and financial affordability, and submitted to the provincial people's government for approval. Eleventh provincial grain reserves purchase and sale plan by the administrative department of food of the provincial people's government according to the provincial people's government approved the storage scale, variety and overall layout planning. With the consent of the development and reform of the provincial people's government and the examination and approval of the financial administrative department, the food administrative department of the provincial people's government shall, jointly with the development and reform of the provincial people's government, the financial administrative department and the Agricultural Development Bank of the province, issue them to the enterprises undertaking the storage task of provincial grain reserves (hereinafter referred to as storage enterprises).

The administrative department of food of the municipal people's government with districts shall be responsible for organizing the storage enterprises within their respective administrative areas to implement the purchase and sale of provincial grain reserves according to the purchase and sale plan of provincial grain reserves. Twelfth provincial grain reserves to implement a balanced rotation system, the annual rotation number is generally 20% to 30% of the total storage of provincial grain reserves.

The administrative department of food of the municipal people's government divided into districts shall, according to the quality and storage life of provincial-level grain reserves, put forward the annual rotation plan of provincial-level grain reserves, and submit it to the administrative department of food of the provincial people's government, which shall be approved by the administrative department of food of the provincial people's government jointly with the financial administrative department of the provincial people's government and the provincial agricultural development bank. The food administrative department of the Municipal People's Government with districts shall organize the implementation of the rotation of provincial-level grain reserves according to the supply and demand of the grain market in the annual rotation plan. Article 13 The administrative department of food of the municipal people's government divided into districts shall report the specific implementation of the purchase, sale and annual rotation plan of provincial-level grain reserves to the administrative department of food and finance of the provincial people's government for the record, and send a copy to the provincial agricultural development bank. Chapter III Storage of Provincial Grain Reserves Article 14 An enterprise that meets the conditions prescribed by the state may undertake the task of storing provincial grain reserves after being audited by the grain administrative department of the provincial people's government and seeking the opinions and consent of the Provincial Agricultural Development Bank.

The grain administrative department of the provincial people's government shall sign a contract with the provincial grain reserve storage enterprises to clarify the rights, obligations and liabilities for breach of contract of both parties.

Where a storage enterprise is revoked, dissolved or bankrupt according to law, the provincial-level grain reserves it stores shall be transferred out by the grain administrative department of the provincial people's government.
