Regulations of Zhejiang Province on Traditional Chinese Medicine
Township people's governments and sub-district offices shall assist relevant departments in the management of traditional Chinese medicine. Article 5 This province promotes the establishment of a regional integration development mechanism for integrating Chinese medicine into the Yangtze River Delta, and carries out cooperation in the construction of Chinese medicine standard system, quality management, personnel training, scientific research, health services, cultural communication and industrial development. Article 6 The provincial department in charge of traditional Chinese medicine shall, jointly with the provincial department in charge of economy and informatization, strengthen the digital management of traditional Chinese medicine and promote the digital reform of traditional Chinese medicine management in accordance with the requirements of overall wisdom. Seventh Chinese medicine industry organizations should strengthen industry self-discipline, safeguard the legitimate rights and interests of the industry, organize industry exchanges, evaluation and technical training, as well as academic exchanges, knowledge popularization and consulting services of Chinese medicine. Chapter II Chinese Medicine Services Article 8 The people's governments at or above the county level shall strengthen the construction of Chinese medicine service system, incorporate the construction of Chinese medicine medical institutions into the regional health development plan and the establishment plan of medical institutions, rationally allocate Chinese medicine service resources, improve the Chinese medicine service network, establish a Chinese medicine service system integrating preventive health care, disease treatment, rehabilitation service and epidemic prevention, and provide Chinese medicine services covering the whole people and the whole life cycle.
The people's governments at or above the county level shall strengthen the digitalization of Chinese medicine services, and promote new medical services such as telemedicine, mobile medical care and smart medical care, as well as online and offline integrated services. Article 9 The people's governments of provinces, cities divided into districts and counties (cities) shall set up at least one comprehensive Chinese medicine hospital with Chinese medicine characteristics. The comprehensive Chinese medicine hospital organized by the District People's Government shall be arranged by the Municipal People's Government with districts according to the medical service demand. Confirmed by the provincial department in charge of traditional Chinese medicine, the county that has already held a national medical hospital can no longer hold a comprehensive traditional Chinese medicine hospital.
A comprehensive Chinese medicine hospital organized by the people's government of a province or a city divided into districts shall meet the construction standards of a third-class first-class hospital, and a comprehensive Chinese medicine hospital organized by the people's government of a county (city, district) shall meet the construction standards of a second-class first-class hospital or above. Article 10 The people's governments at or above the county level shall take supporting measures to support the Chinese medicine medical institutions organized by the government to take the lead in establishing county-level medical and health services, urban medical groups or Chinese medicine specialist alliances and other medical consortia, integrate the Chinese medicine service resources within their jurisdiction, and promote the expansion and balanced allocation of high-quality Chinese medicine resources. Encourage qualified social forces to organize Chinese medical institutions to participate in the construction of medical complexes.
Support qualified Chinese medicine medical institutions to establish national and provincial high-level Chinese medicine medical centers, medical centers and characteristic hospitals to improve the service level of Chinese medicine in the region. Eleventh Chinese medicine medical institutions should be equipped with medical personnel, mainly Chinese medicine professional and technical personnel, mainly to provide Chinese medicine services. The proportion of Chinese medicine professional and technical personnel and Chinese medicine service personnel in Chinese medicine medical institutions shall comply with the relevant provisions of the state and province.
Institutions that provide professional public health services such as disease prevention and control, health education, maternal and child health care, mental health, pre-hospital first aid, etc. shall be reasonably equipped with professional and technical personnel of Chinese medicine.
Encourage the combination of medical care and old-age care institutions to be equipped with Chinese medicine professional and technical personnel to provide Chinese medicine services. Article 12 Chinese medicine practitioners who have passed the qualification examination for practicing Chinese medicine or obtained the qualification after being recognized may practice in the clinical departments of medical institutions such as general hospitals, maternal and child health care institutions and specialized hospitals, and provide corresponding diagnosis and treatment services according to the registered scope of practice.
Chinese medicine practitioners who have studied Chinese medicine as apprentices or obtained medical expertise through years of practice and obtained medical qualifications through examination may carry out Chinese medicine diagnosis and treatment activities in accordance with regulations within the registered scope of practice.
Provincial departments in charge of traditional Chinese medicine shall establish a search system for medical skilled personnel, organize the investigation and registration of medical skilled personnel, and encourage them to obtain medical qualifications according to law through examinations or assessments.
Encourage Chinese medical institutions to set up Chinese medicine (specialist) doctors, support Chinese medicine (specialist) doctors to undertake Chinese medicine training tasks, and promote the promotion, application and inheritance of folk characteristic technical therapy. Article 13 Non-TCM doctors who have obtained professional qualifications and degrees in traditional Chinese medicine, integrated traditional Chinese and western medicine, and minority medicine, or who have participated in professional knowledge training in traditional Chinese medicine organized or recognized by provincial departments in charge of traditional Chinese medicine and passed the examination, can carry out TCM diagnosis and treatment activities related to their majors.
Non-TCM doctors, rural doctors and nursing staff can apply appropriate techniques of TCM in their practice by participating in the training of cupping, scrapping and other appropriate techniques of TCM organized or recognized by the provincial competent department of TCM and passing the examination.
