Seeking the concept explanation of mixed debate litigation in criminal procedure law

Debate litigation is also called "adversarial litigation". The litigation procedure adopts the way of confrontation between the two parties, with the parties as the main body and the judge only playing the role of referee. The forms of criminal proceedings in common law countries are contrary to those in civil law countries. The characteristic is that the judge presides over the court investigation and is responsible for accepting and judging the evidence provided by both parties. It is the right of both parties to decide how to proceed with the case, not the responsibility of the judge. The examination of the authenticity of evidence and the questioning of witnesses shall be conducted by lawyers of both parties. Only when one party objects to the evidence presented by the other party will the judge intervene. After the debate, the judge made a judgment as a third party.
