Measures of Zhejiang Province on the Administration of Postal Franchise

Article 1 These Measures are formulated in accordance with the Postal Law of People's Republic of China (PRC), the Detailed Rules for the Implementation of the Postal Law of People's Republic of China (PRC) and other relevant laws and regulations in order to protect citizens' communication rights, protect freedom and secrets of communication, standardize and protect the exclusive activities of postal enterprises, and promote the universal postal service and the development of postal undertakings. Article 2 These Measures shall apply to the operation and management of postal franchise business within the administrative area of this province. Article 3 Post offices at or above the county (city) level are public enterprises established according to law (hereinafter referred to as postal enterprises), which undertake the obligation of providing universal postal services to the society and are responsible for the unified operation of postal franchise business. Fourth provinces, cities and counties (cities) postal industry management departments, responsible for the management of postal franchise business within their respective administrative areas.

Industry and commerce, public security, national security, inspection and quarantine, customs, taxation, prices, foreign trade and other departments shall, in accordance with their respective responsibilities, coordinate in the management of postal franchise business. Article 5 All units and individuals shall consciously abide by the national and provincial regulations on the management of postal monopoly business, and have the right to report and accuse acts that violate the regulations on the management of postal monopoly business. Article 6 The following postal services shall be exclusively operated by postal enterprises according to law:

(1) delivering letters and articles with the nature of letters;

(2) Sales of ordinary stamps;

(three) other franchise business as stipulated by laws and administrative regulations. Article 7 Postal enterprises may entrust non-postal enterprise organizations and individual industrial and commercial households (hereinafter referred to as non-postal units) to handle postal franchise business according to law, and non-postal units may not delegate after accepting the entrustment.

Without the entrustment of postal enterprises, no unit or individual may engage in postal franchise business. Article 8 A non-postal unit applying for postal franchise business shall meet the following conditions and sign an entrustment contract with local postal enterprises through consultation:

(1) Having a fixed business place;

(2) It has funds suitable for its business operation;

(3) Obtaining an industrial and commercial business license;

(4) Other conditions stipulated by laws and regulations. Article 9 If an international freight forwarding enterprise needs to handle the delivery of inbound and outbound letters and articles with the nature of letters when engaging in express delivery business, it shall handle the entrustment formalities with the postal industry management department at or above the provincial level in accordance with the provisions of the state. Tenth non postal units shall accept the supervision and inspection of the postal industry management department during the performance of the agency contract. Article 11 Postal enterprises and postal delivery agencies shall announce the service scope, service standards, business processes, tariff standards, business hours, supervision telephone numbers, inquiry time limits and compensation standards in their business premises; Mark the unpacking time on the mailbox (cylinder). Article 12 Postal enterprises and postal delivery agencies shall deliver mail quickly and accurately according to the prescribed frequency, time limit and delivery scope, and collect postage according to the prescribed tariff standards. Thirteenth postal enterprises and units engaged in postal franchise business should provide users with safe and convenient postal communication services, and consciously safeguard citizens' freedom of communication and privacy rights. Postal workers and agents shall not provide any organization or individual with the name, address and purpose of postal services, except as otherwise provided by law. Fourteenth postal enterprises, units engaged in postal franchise business and their staff shall not have the following acts:

(1) Opening, concealing, destroying, stealing mail or tearing up stamps without permission;

(2) delaying the delivery of mail without reason;

(three) to suspend the postal service to users without authorization;

(4) charging fees in violation of the tariff standards stipulated by the state or charging fees in disguised form;

(five) other prohibited acts as prescribed by laws and regulations. Article 15 Law enforcement officers of postal industry management departments (hereinafter referred to as postal law enforcement officers) have the right to enter postal enterprises and other places engaged in postal delivery business and postage tickets according to law to conduct law enforcement inspections on business activities of operators; Business units and relevant personnel shall cooperate.

Industry and commerce, public security, national security, taxation, customs and other departments shall provide assistance to the law enforcement activities of the postal industry management department. Sixteenth postal law enforcement officers may exercise the following functions and powers when conducting law enforcement inspections on operators:

Asking the parties and relevant personnel;

(two) to inspect the business premises and property related to the postal franchise business;

(3) consulting documents, bills, vouchers, contracts, invoices, account books and other materials related to business operations;

(4) Collecting, registering and preserving evidence related to illegal business operations;

(5) Other functions and powers as prescribed by laws and regulations. Seventeenth postal law enforcement personnel to carry out law enforcement inspection, should produce administrative law enforcement certificates, to achieve fair and civilized law enforcement; The privacy and business secrets of the parties concerned shall be kept confidential. Eighteenth postal industry management departments should open procedures, establish a reporting system and accept social supervision; Complaints against the parties concerned shall be accepted in a timely manner, and a reply or treatment shall be made within 10 working days from the date of acceptance. Nineteenth postal vehicles with special postal signs are exempt from vehicle tolls when they pass toll bridges, roads (including highways), tunnels and ferries when performing mail transportation and delivery tasks; Postal vehicles are not engaged in mail transportation and delivery tasks, and they still need to pay vehicle tolls according to regulations. The specific implementation measures shall be formulated by the provincial transportation and postal administration departments and reported to the provincial people's government for the record.
