Measures of Huizhou Municipality on the Protection and Management of Intangible Cultural Heritage

Article 1 In order to strengthen the protection and preservation of intangible cultural heritage, and inherit and carry forward the excellent traditional culture of the Chinese nation, these Measures are formulated in accordance with the People's Republic of China (PRC) Intangible Cultural Heritage Law, the Guangdong Intangible Cultural Heritage Regulations and other laws and regulations, and combined with the actual situation of this Municipality. Article 2 These Measures shall apply to the protection and preservation of intangible cultural heritage within the administrative area of this Municipality.

The term "intangible cultural heritage" as mentioned in these Measures refers to various forms of traditional cultural expressions handed down from generation to generation by people of all ethnic groups in our city and regarded as part of its cultural heritage, as well as objects and places related to traditional cultural expressions. Including:

(1) Traditional oral literature and the language as its carrier.

(2) Traditional arts, calligraphy, music, dance, drama, folk art and acrobatics.

(3) Traditional skills, medicine and calendars.

(four) traditional etiquette, festivals and other folk customs.

(5) Traditional sports and entertainment.

(6) Other intangible cultural heritage.

Articles and places that are part of intangible cultural heritage belong to cultural relics, and the provisions of laws and regulations on the protection of cultural relics shall apply. Article 3 The protection and preservation of intangible cultural heritage should pay attention to authenticity, integrity and inheritance, adhere to the principles of government leading, social participation, protection first, rescue first, rational utilization and inheritance and development, and correctly handle the relationship between economic construction, social development and intangible cultural heritage protection.

The use of intangible cultural heritage should respect its form and cultural connotation, and should not be distorted, abused or derogated. Fourth people's governments at or above the county level shall incorporate the protection and preservation of intangible cultural heritage into the national economic and social development plan at the corresponding level; Protection and preservation funds will be included in the fiscal budget at the corresponding level.

The people's governments at or above the county level shall set up special funds for the protection of intangible cultural heritage, which are mainly used for:

(a) rescue, excavation, collection, acquisition, collation, compilation, research, publication and preservation of intangible cultural heritage materials and related objects.

(2) On-site transmission, exhibition and dissemination of intangible cultural heritage.

(three) the investigation and identification of intangible cultural heritage and the naming and commendation of the inheritors of representative projects.

(4) Cultivation of inheritors of representative projects of intangible cultural heritage.

(five) rescue and protection of endangered intangible cultural heritage.

(six) the establishment of intangible cultural heritage database and archives (room).

(seven) the publicity of intangible cultural heritage and the training of managers of intangible cultural heritage protection institutions.

(eight) other matters related to the protection and preservation of intangible cultural heritage.

Special funds for the protection of intangible cultural heritage should be strengthened in management and supervision, focused, earmarked and pragmatic. Article 5 The competent cultural departments of the people's governments at or above the county level shall be responsible for the protection and preservation of intangible cultural heritage within their respective administrative areas, and shall guide, manage and supervise the protection and preservation of intangible cultural heritage according to law.

The competent cultural departments of the people's governments at or above the county level shall, in accordance with the relevant provisions of the state and the province, establish intangible cultural heritage protection centers. The intangible cultural heritage protection center at or above the county level shall undertake the following tasks:

(a) the implementation of intangible cultural heritage protection planning, planning and work norms.

(2) Organizing the investigation, identification, declaration, protection, exchange and dissemination of intangible cultural heritage. Sixth other relevant departments of the people's governments at or above the county level shall do a good job in the protection of intangible cultural heritage in accordance with the following duties:

(a) the development and reform department is responsible for cooperating with and participating in the examination and approval of important projects for the protection of intangible cultural heritage by relevant units.

(two) the economic and information technology department is responsible for the rescue and protection of the intangible cultural heritage of traditional craft projects.

(3) The education department is responsible for incorporating local representative intangible cultural heritage projects into the extracurricular education content of school students in conjunction with relevant departments, and supporting primary and secondary schools and institutions of higher learning to carry out teaching and research on intangible cultural heritage projects.

(four) the intellectual property department is responsible for handling illegal acts involving intangible cultural heritage patents according to law.

(five) ethnic and religious departments are responsible for coordinating the protection of ethnic and religious related intangible cultural heritage.

(six) the public security department is responsible for dealing with the destruction of items and places that are part of the intangible cultural heritage according to law, which constitutes a violation of public security management.

(seven) the financial department is responsible for the management and supervision of the relevant funds and the use of funds for the protection of intangible cultural heritage.

(eight) the land and resources department is responsible for the protection of intangible cultural heritage related to land and mineral resources.

(nine) the housing and urban and rural planning and construction departments are responsible for the declaration, planning and protection of historical and cultural cities, towns, villages, blocks, historical buildings and traditional villages related to the protection of intangible cultural heritage.

(ten) the sports department in conjunction with the relevant departments responsible for the rescue and protection of traditional sports intangible cultural heritage.

(eleven) the marine and fishery departments are responsible for the protection of intangible cultural heritage related to marine and fishery.

(twelve) the tourism department is responsible for the publicity and promotion of tourism projects related to intangible cultural heritage.

(thirteen) the food and drug supervision department is responsible for the rescue and protection of the intangible cultural heritage of traditional medicine and diet projects.

(fourteen) the industrial and commercial departments shall be responsible for handling illegal acts involving trademarks and advertisements of intangible cultural heritage according to law.

(fifteen) other relevant departments to do related work in accordance with their duties.
