Regulations of Anhui Province on Waterway Transportation

Chapter I General Provisions Article 1 These Regulations are formulated in accordance with the State Council's Regulations on the Administration of Domestic Waterway Transportation and other relevant laws and administrative regulations, combined with the actual situation of this province, in order to standardize the operation of Waterway Transportation, maintain the market order of Waterway Transportation, ensure the safety of Waterway Transportation, protect the legitimate rights and interests of the parties involved in Waterway Transportation, and promote the sustained and healthy development of Waterway Transportation. Article 2 These Regulations shall apply to activities such as waterway transportation business, waterway transportation auxiliary business, waterway transportation development and its supervision and management within the administrative region of this province. Article 3 The development of waterway transportation shall follow the principles of market dominance, government guidance, overall planning and coordination, energy conservation and environmental protection, and build a smooth, efficient, safe, green and intelligent waterway transportation system. Article 4 People's governments at or above the county level shall strengthen their leadership over waterway transportation, incorporate waterway transportation into the national economic and social development plan, increase investment in waterway transportation infrastructure construction and maintenance, and actively guide social capital to invest in waterway transportation infrastructure construction and maintenance. Fifth provincial people's government departments in charge of transportation in the province's water transport work, its subordinate water transport management agencies to implement water transport management.

The water transport management department or institution of the people's government at the city or county level divided into districts shall be responsible for the water transport management in their respective administrative areas. Article 6 Waterway transport industry organizations established according to law shall, in accordance with the provisions of laws, regulations and articles of association, formulate industry business norms and service standards, establish industry integrity supervision and restraint mechanisms, organize professional ethics education and business training, and implement self-discipline management on members' business behaviors and service quality. Chapter II Development of Waterway Transportation Article 7 The people's governments of provinces and cities divided into districts shall, according to the needs of national economic and social development, organize the preparation of water transport development plans. The water transport development plan of a city divided into districts shall conform to the provincial water transport development plan.

Waterway transportation development planning should be linked with waterway planning, port planning and environmental protection planning to promote the coordinated development of waterway, port, ship and supporting system. Eighth people's governments at or above the county level shall, when compiling the overall land use planning and urban and rural planning, make overall consideration of the spatial layout and land demand of waterway transportation construction projects. Article 9 The people's governments at or above the county level shall, according to the waterway planning, enhance the navigation capacity of trunk lines, improve the navigation conditions of tributaries, promote the coordinated development of trunk lines and branch lines of the Yangtze River, Huaihe River and Xin 'anjiang River, and promote the construction of a high-grade waterway network connecting major ports in the Yangtze River Delta. Tenth waterway related construction projects, in addition to laws, administrative regulations or special projects such as flood control and water supply stipulated by the State Council, shall not reduce the navigation conditions of the waterway due to the construction of the project.

In the construction of waterway-related projects, the construction unit shall assess the impact of the construction project on navigation conditions according to law and submit it to the waterway management department with the right to audit. In addition to the construction projects audited by the competent department of transportation in the State Council, the construction projects on the waterway above Grade 4 determined by the plan shall be audited by the provincial waterway management department, and other construction projects shall be audited by the municipal waterway management department with districts. Article 11 The operators and managers of navigation structure, such as shiplocks, shall operate according to the plan approved by the waterway management department of the city where they are located, and shall not refuse the passage of ships without justifiable reasons.

In case of ship lock blockage or possible blockage affecting the passage of ships, the operators and managers of navigation structure, such as ship locks, shall obey the unified dispatch of the local waterway management department. Article 12 The transportation department of the provincial people's government shall, jointly with the departments of development and reform, water administration and land resources, make overall plans for the development of port shoreline resources, optimize the port layout, and promote the sharing of port public resources.

The port administrative department of a city divided into districts shall strengthen the construction of public docks and public anchorages, optimize the berth structure of docks, guide the technical upgrading of docks, and promote the construction of specialized, intensive, large-scale and modern port areas.

New docks should plan, design and build shore-based power supply facilities, and completed docks should gradually implement the transformation of shore-based power supply facilities. After the ship stops, the shore power should be given priority.

Port operators shall, in accordance with the provisions of the state, build garbage receiving, transshipment and treatment facilities to improve the receiving and treatment capacity of oily sewage and chemical tank washing water and the emergency disposal capacity of pollution accidents. Article 13 Port operators shall provide convenience for waterway transport operators, shippers and consignees to go through the formalities of ships or goods entering and leaving the port by themselves, and shall not forcibly provide paid services.

Port operators shall abide by the provisions of the state on port operating prices and charges, and publicize the charging items and standards in their business premises. Fourteenth encourage waterway transportation and related operators to improve the automation and informatization level of key equipment such as loading and unloading, transportation and storage management, and provide logistics information services. Fifteenth people's governments at or above the county level shall formulate and organize the implementation of industrial policies and measures conducive to the sustained and healthy development of waterway transportation industry, promote the integrated development of waterway transportation and related industries, strengthen cross-regional cooperation, and realize information exchange, resource sharing and complementary advantages.

Guide the port layout of advantageous industrial projects, and form a port-facing industrial economy with high industrial concentration, strong radiation and coordination with the port layout along the Yangtze River and Huaihe River.
