Regulations of the People's Republic of China and the State on Traditional Chinese Medicine

Chapter 1 General Provisions Article 1 These regulations are formulated in order to inherit and develop traditional Chinese medicine, ensure and promote the development of traditional Chinese medicine, and protect human health.

Article 2 Units or individuals engaged in traditional Chinese medicine medical treatment, prevention, health care, rehabilitation services, traditional Chinese medicine education, scientific research, foreign exchanges, and traditional Chinese medicine management activities within the territory of the People's Republic of China shall abide by these Regulations.

The development, production, operation, use, supervision and management of traditional Chinese medicines are carried out in accordance with the Drug Administration Law of the People's Republic of China.

Article 3 The state protects, supports, and develops the cause of traditional Chinese medicine, implements the policy of attaching equal importance to traditional Chinese medicine and western medicine, encourages traditional Chinese and western medicine to learn from, complement each other, and improve together, promotes the organic combination of traditional Chinese medicine and western medicine, and comprehensively develops our country

Article 4 The development of traditional Chinese medicine shall follow the principle of combining inheritance and innovation, maintain and carry forward the characteristics and advantages of traditional Chinese medicine, actively utilize modern science and technology, promote the development of traditional Chinese medicine theory and practice, and promote the modernization of traditional Chinese medicine.

Article 5 People’s governments at or above the county level shall incorporate traditional Chinese medicine into the national economic and social development plans so that traditional Chinese medicine develops in a coordinated manner with the economy and society.

When formulating regional health plans, local people's governments at or above the county level should make overall arrangements for the establishment and layout of traditional Chinese medicine medical institutions and improve urban and rural traditional Chinese medicine service networks based on the social and economic development conditions of the region and the medical needs of residents.

Article 6 The traditional Chinese medicine management department of the State Council is responsible for the national traditional Chinese medicine management.

Relevant departments under the State Council are responsible for work related to traditional Chinese medicine within the scope of their respective responsibilities.

The departments responsible for the management of traditional Chinese medicine under the local people's governments at or above the county level are responsible for the management of traditional Chinese medicine within their respective administrative regions.

Article 7 People's governments at or above the county level shall reward units and individuals that have made significant contributions to the inheritance and development of traditional Chinese medicine and have made outstanding achievements in the work of traditional Chinese medicine in remote areas.

Chapter 2 Traditional Chinese Medicine Medical Institutions and Practitioners Article 8 The establishment of a traditional Chinese medicine medical institution shall comply with the establishment standards of traditional Chinese medicine medical institutions and the local regional health plan formulated by the health administrative department of the State Council, and shall go through the approval procedures in accordance with the "Regulations on the Administration of Medical Institutions".

Only after obtaining a medical institution practice license can you engage in traditional Chinese medicine medical activities.

Article 9 Traditional Chinese medicine medical institutions engaged in medical service activities shall give full play to the characteristics and advantages of traditional Chinese medicine, follow the development laws of traditional Chinese medicine, use traditional theories and methods, and combine them with modern scientific and technological means to give full play to the role of traditional Chinese medicine in disease prevention, health care, and rehabilitation.

Its role is to provide the public with reasonably priced and high-quality traditional Chinese medicine services.

Article 10 Community health service centers (stations), township health centers and other urban and rural grassroots health service institutions established in accordance with the law should be able to provide traditional Chinese medicine medical services.

Article 11 Practitioners of traditional Chinese medicine shall pass the qualification examination in accordance with the laws, administrative regulations and departmental rules related to health management, and shall be registered and obtain a practice certificate before they can engage in traditional Chinese medicine service activities.

Those who study traditional Chinese medicine from teachers and those who have real expertise must, in accordance with the regulations of the health administration department of the State Council, pass the qualification examination for practicing physicians or practicing assistant physicians, and be registered and obtain a physician's practicing certificate before they can engage in traditional Chinese medicine medical activities.

Article 12 Practitioners of traditional Chinese medicine shall abide by the corresponding principles of diagnosis and treatment of traditional Chinese medicine, medical technical standards and technical operating specifications.

General practitioners and rural doctors should have basic knowledge of traditional Chinese medicine and basic skills in applying traditional Chinese medicine diagnosis and treatment knowledge and techniques to deal with common and frequently-occurring diseases.

Article 13 To publish traditional Chinese medicine medical advertisements, medical institutions shall apply and submit relevant materials to the departments responsible for traditional Chinese medicine management of the people's governments of the local provinces, autonomous regions, and municipalities directly under the Central Government in accordance with regulations.

The departments responsible for the management of traditional Chinese medicine under the people's governments of provinces, autonomous regions, and municipalities directly under the Central Government shall review the relevant materials within 10 working days from the date of receipt and make a decision on whether to issue an approval number for traditional Chinese medicine medical advertisements.

Those who meet the prescribed requirements will be issued an approval number for traditional Chinese medicine medical advertisements.

Without obtaining the approval number for TCM medical advertisements, TCM medical advertisements shall not be published.

The content of TCM medical advertisements released shall be consistent with the content approved for release.

Chapter 3 Traditional Chinese Medicine Education and Scientific Research Article 14 The state takes measures to develop traditional Chinese medicine education.

All types of traditional Chinese medicine education institutions should strengthen the teaching of basic theories of traditional Chinese medicine, pay attention to the combination of basic theories of traditional Chinese medicine and clinical practice of traditional Chinese medicine, and promote quality education.

Article 15 The establishment of various types of traditional Chinese medicine education institutions shall comply with the establishment standards stipulated by the state, and establish clinical teaching bases that comply with the standards stipulated by the state.

The standards for the establishment of traditional Chinese medicine education institutions shall be formulated by the health administration department of the State Council in conjunction with the education administration department of the State Council; the standards for clinical teaching bases of traditional Chinese medicine education institutions shall be formulated by the health administration department of the State Council.

Article 16 The state encourages the inheritance of academic experience and technical expertise of experts in traditional Chinese medicine and the cultivation of high-level clinical talents of traditional Chinese medicine and technical talents of traditional Chinese medicine.
