Interim provisions on the qualification of printing operators

Article 1 In order to further standardize the establishment and examination and approval of printing operators and promote the printing operators to improve their professional quality and technical level, these Provisions are formulated in accordance with the provisions of the Regulations on the Administration of Printing Industry and the spirit of rectifying and standardizing the order of the printing market in the State Council.

Article 2 The term "printing operators" as mentioned in these Provisions includes enterprises engaged in printing business activities of publications, packaging and decoration printed matter, enterprises, units or individuals engaged in printing business activities of other printed matter, enterprises or units engaged in special typesetting, plate making and binding, and copying and printing business units or individuals.

Article 3 In addition to these provisions, the examination and approval of the qualification of a printing operator shall also meet other conditions stipulated by the state in terms of the total volume, structure and layout planning of the printing industry and laws and regulations.

Article 4 An enterprise engaged in publication printing business shall meet the following conditions:

(1) Having the name and articles of association of the enterprise;

(2) Having a definite business scope;

(3) Having a fixed place for production and business operation to meet business needs, with a construction area of not less than 800 square meters;

(4) It has funds capable of maintaining normal production and operation, with a registered capital of not less than 2 million yuan;

(5) Having the necessary printing equipment for publications, and having at least two sets of automatic offset printing equipment that have been produced in recent ten years and are not listed in the Catalogue of Eliminating Backward Production Capacity, Technology and Products;

(six) there are organizations and personnel that meet the needs of the business scope, and the legal representative and the main person in charge of production and operation must obtain the "Certificate of Training on Printing Regulations" issued by the provincial press and publication administrative department;

(seven) a sound printing verification, registration, storage, delivery, destruction and other business management, financial management system and quality assurance system.

Article 5 An enterprise engaged in the printing business of packaging, assembling and performing printed matter shall meet the following conditions:

(1) Having the name and articles of association of the enterprise;

(2) Having a definite business scope;

(3) Having a fixed place for production and business operation to meet business needs, with a construction area of not less than 600 square meters;

(4) Having funds to maintain normal production and operation, with a registered capital of not less than 6,543,800 yuan+500,000 yuan;

(5) Necessary packaging, assembly and printing equipment, with more than two sets of post-processing equipment, such as offset printing, gravure printing, flexo printing and screen printing, which have been produced in the last ten years and are not listed in the Catalogue of Eliminating Backward Production Capacity, Technology and Products;

(6) Having organizations and personnel that meet the needs of business scope, the legal representative of the enterprise and the main person in charge of production and operation must obtain the certificate of training on printing regulations issued by the administrative department in charge of publishing management of the people's government at or above the prefecture level (hereinafter referred to as the publishing administrative department);

(seven) a sound printing verification, registration, storage, delivery, destruction and other business management, financial management system and quality assurance system.

Article 6 Enterprises and units engaged in other printed matter printing business shall meet the following conditions:

(1) Having the name and articles of association of the enterprise or unit;

(2) Having a definite business scope;

(3) It has a fixed production and business operation place that meets the business needs, with a construction area of not less than 100 square meter, and is not in a place for residence;

(4) Having production equipment and funds that meet the business needs, with a registered capital of not less than 500,000 yuan;

(five) there are organizations and personnel to meet the business needs, and the legal representative of the enterprise or the person in charge of the unit must obtain the "Certificate of Training on Printing Regulations" issued by the publishing administrative department at or above the county level;

(six) a sound printing verification, registration, storage, delivery, destruction and other business management, financial management system and quality assurance system.

Seventh enterprises and units engaged in special typesetting, plate making and binding business shall meet the following conditions:

(1) Having the name and articles of association of the enterprise or unit;

(2) Having a definite business scope;

(3) Having a fixed place for production and business operation to meet business needs, with a construction area of not less than 300 square meters;

(4) Having funds to maintain normal production and operation, with a registered capital of not less than 800,000 yuan;

(5) Having the necessary typesetting, plate making and binding equipment, and having two or more prepress or postpress processing equipment produced in recent ten years and not listed in the catalogue of obsolete production capacity, technology and products;

(six) there are organizations and personnel to meet the needs of business scope, the legal representative of the enterprise, the main person in charge of production and operation and the person in charge of the unit must obtain the "Certificate of Training on Printing Regulations" issued by the publishing administrative department at or above the prefecture level;

(seven) a sound printing verification, registration, storage, delivery, destruction and other business management, financial management system and quality assurance system.

Eighth units engaged in copying and printing business shall meet the following conditions:

(a) the name and articles of association of the unit;

(2) Having a definite business scope;

(3) It has a fixed production and business operation place that meets the business needs, and the building area of the factory building is not less than 15 square meters, and it is not in a place for residence;

(4) The registered capital or capital amount is not less than RMB 654.38+10,000;

(5) There should be photocopiers, computers, printers, famous film machines and other equipment (there should be no light printing equipment with more than eight sizes);

(six) there are organizations and personnel to meet the needs of the business scope, and the person in charge of the unit must obtain the "Certificate of Training on Printing Regulations" issued by the publishing administrative department at or above the county level;

(seven) a sound printing verification, registration, storage, delivery, destruction and other management systems.

Article 9 Individuals engaged in other printed matter printing business activities and copying and printing business activities shall abide by the provisions of Articles 6 and 8 of these Provisions.

Tenth printing operators engaged in other types of printing business activities, should also meet the conditions for the establishment of printing enterprises or printing units.

Eleventh publishing administrative departments must be in accordance with the provisions of the examination and approval of the qualification of printing operators, do not meet the requirements of these provisions, shall not be approved.

Article 12 In addition to the conditions stipulated in these Provisions, the annual verification of printing operators also requires that printing operators have no record of violating printing management regulations.

Article 13 If a printing operator established before the implementation of these Provisions fails to meet the requirements of these Provisions before March 0, 2002, the Printing Business License shall not be renewed temporarily.

Article 14 These Provisions shall come into force as of the date of promulgation.

Establish a printing enterprise

Article 7 The State practices a printing business license system. No unit or individual may engage in printing business activities without obtaining a printing business license in accordance with the provisions of these regulations.

Article 8 The establishment of a printing enterprise shall meet the following conditions:

(1) Having the name and articles of association of the enterprise;

(2) Having a definite business scope;

(3) Having production and business premises and necessary funds, equipment and other production and business conditions that are suitable for the business scope;

(4) Having an organization and personnel suitable for its business scope;

(5) Other conditions stipulated by relevant laws and administrative regulations.

The examination and approval of the establishment of a printing enterprise shall not only conform to the provisions of the preceding paragraph, but also conform to the national plan on the total amount, structure and layout of printing enterprises.

Article 9 To establish an enterprise engaged in the printing business of publications, packaging and decoration printed matter and other printed matter, an application shall be submitted to the publishing administrative department of the local people's government of the province, autonomous region or municipality directly under the Central Government; Among them, the establishment of an enterprise specializing in business card printing shall apply to the publishing administrative department of the local people's government at the county level. After examination and approval, the applicant has obtained a printing business license; And in accordance with the relevant provisions of the state, apply to the public security department with a printing business license, and after approval, obtain a special trade license, apply to the administrative department for industry and commerce for registration with a printing business license and a special trade license, and obtain a business license.

Individuals may not engage in printing business activities of publications, packaging and decoration printed matter; Individuals engaged in other printed matter printing business activities shall go through the examination and approval procedures in accordance with the provisions of the preceding paragraph.

Article 10 When accepting an application for the establishment of a printing enterprise, the publishing administrative department shall make a decision of approval or disapproval within 60 days from the date of accepting the application. If the establishment is approved, a printing business license shall be issued; If the application for establishment is not approved, it shall notify the applicant and explain the reasons.

The printing business license shall indicate the types of printing business activities that the printing enterprise is engaged in.

The Printing Business License shall not be sold, leased, lent or transferred in other forms.

Article 11 When a printing operator applies to run or change the business activities of printed publications, packaging and decoration printed matter or other printed matter, or merge with other printing operators, or establish a new printing operator due to merger or division, it shall go through the formalities in accordance with the provisions of Article 9 of these Regulations.

If a printing operator changes its name, legal representative or person in charge, domicile or business premises, or terminates its printing business activities, it shall go through the formalities of change and cancellation of registration with the public security department and the administrative department for industry and commerce that originally registered, and report to the publishing administrative department that originally approved the establishment for the record.

Article 12 The State allows the establishment of Sino-foreign joint venture printing enterprises and Sino-foreign cooperative printing enterprises, and allows the establishment of foreign-funded enterprises to engage in the printing business of packaging and decoration printed matter. The specific measures shall be formulated by the publishing administrative department of the State Council in conjunction with the foreign economic relations and trade department of the State Council.

Thirteenth units to set up a printing plant (institute), must go through the registration formalities with the publishing administrative department of the local people's government at or above the county level, and in accordance with the relevant provisions of the state to the public security department for the record; A printing house (institute) established within a unit that prints printed matter involving state secrets shall also go through the registration formalities with the security department.

The printing factory (institute) established within the unit shall not engage in printing business activities; Engaged in printing business activities, must go through the formalities in accordance with the provisions of this chapter.
