Regulations of Yangzhou Municipality on the Administration of Farmers' Markets

Chapter I General Provisions Article 1 In order to standardize the management of farmers' markets, maintain the order of farmers' markets and promote the healthy development of farmers' markets, these Regulations are formulated in accordance with relevant laws and regulations and in light of the actual situation of this Municipality. Article 2 These Regulations shall apply to the management activities of farmers' markets in urban areas and counties (cities). Article 3 The term "farmers' market" as mentioned in these Regulations refers to a fair trade market with fixed places and corresponding facilities, which mainly focuses on the spot retail of edible agricultural products.

The term "farmers' market promoters" as mentioned in these Regulations refers to enterprises as legal persons or other organizations that provide venues, facilities and services for market operators and engage in the management of farmers' markets.

The floor operators mentioned in these Regulations refer to enterprises and individual industrial and commercial households engaged in business activities independently in the farmers' market. Article 4 The people's governments of cities and counties (cities, districts) shall organize, lead and coordinate the supervision and management of farmers' markets, and set up farmers' market management coordination institutions with market supervision and management, commerce, urban management, agriculture and rural areas, health, emergency management, public security and other relevant departments as member units to be specifically responsible for the guidance and coordination of farmers' market supervision and management. Fifth city and county (city, district) people's government market supervision and management departments in charge of the supervision and management of farmers' markets, other relevant departments in accordance with their respective responsibilities to do a good job in the supervision and management of farmers' markets.

Neighborhood offices and Township People's governments shall guide and urge farmers' market operators to implement management responsibilities. Sixth city, county (city) people's government in the preparation of urban and rural planning should be scientific layout, to reserve space for the construction of farmers' markets.

City, county (city) people's government department in charge of commerce shall, jointly with the relevant departments, prepare a special plan for the construction of farmers' market, and report it to the people's government at the same level for approval before implementation. Article 7 The competent commerce department of the Municipal People's Government shall, jointly with relevant departments, formulate standards for the construction of farmers' markets. Eighth city and county (city, district) people's governments shall formulate relevant policies to support and promote the construction and upgrading of farmers' markets.

City, county (city, district) people's governments shall, in accordance with the relevant provisions, commend or reward the units and individuals that have made remarkable achievements in promoting the development and management of farmers' markets. Chapter II Business Norms Article 9 A farmer's market promoter shall sign a contract with the operators in the market who rent their stalls and shops, and make an agreement on business management to clarify the rights and obligations of both parties.

Farmers' market promoters and floor operators can set up industry organizations according to law, carry out industry self-discipline and promote the standardized and orderly development of the industry. Tenth farmers' market operators should set up appropriate business areas for local farmers to temporarily sell their own edible agricultural products.

No unit or individual may set up temporary stalls for edible agricultural products in public places outside the farmers' market. Eleventh farmers market operators shall, in accordance with the following requirements, fulfill the responsibility of food safety management:

(a) to establish and implement the food safety management system of the farmers' market;

(two) equipped with full-time (part-time) food safety management personnel, professional and technical personnel, and organize food safety knowledge training every year;

(3) Examining the certificates of origin, purchase vouchers and conformity certificates of edible agricultural products, and keeping relevant copies for not less than six months;

(4) Edible agricultural products without certificates of origin, purchase vouchers or certificates of conformity shall be subject to sampling inspection or rapid inspection, and can only be put on the market after inspection or inspection is qualified;

(five) regularly check the business environment and conditions;

(6) Farmers' markets dealing in animals and animal products shall meet the relevant conditions for animal epidemic prevention, establish and implement a system of cleaning, disinfection and harmless treatment according to law, and abide by the relevant provisions of regional isolation and regular market closures;

(seven) regularly check the implementation of preventive measures for food safety accidents, and eliminate hidden dangers of quality and safety in time;

(eight) found in violation of food safety laws and regulations, should be stopped in time, and report to the market supervision and management department;

(nine) other duties of food safety management as prescribed by laws and regulations. Twelfth farmers' market operators shall perform their public security responsibilities in accordance with the following requirements:

(a) according to the standard configuration of fire control facilities and equipment, set up fire safety signs, and keep it intact and effective;

(two) to determine the fire safety administrator and organize the implementation of fire safety management;

(three) to do a good job in the safety management of buildings, structures and special equipment in the farmer's market;

(four) regular investigation and management of hidden dangers of production safety accidents, truthfully record the investigation and management of hidden dangers of accidents, inform employees and publish them in the farmer's market;

(five) to formulate emergency rescue plans for production safety accidents, organize emergency training and emergency drills on a regular basis, and ensure smooth emergency evacuation routes;

(six) in accordance with the provisions of the installation of video security monitoring facilities in line with technical standards, and ensure the normal operation;

(seven) other public security responsibilities stipulated by laws and regulations. Thirteenth farmers' market operators shall, in accordance with the following requirements, fulfill the responsibility of city appearance and environmental sanitation:

(a) to implement the relevant provisions of the responsible person of city appearance and environmental sanitation, clean up the site in time, and keep the site clean and orderly;

(two) set up garbage collection containers that meet the standards, and urge the operators in the venue to put garbage into the classification, and classify the garbage according to the requirements;

(three) to discourage and stop the operation of supermarkets (stalls), littering, building and other acts that damage the city appearance and environmental sanitation;

(four) the establishment of disease vector prevention and control facilities, the implementation of the person responsible for disease vector prevention and control work, to ensure that the market vector density control within the scope prescribed by the state;

(five) other city appearance and environmental sanitation responsibilities as stipulated by laws and regulations.
