Socialism with Chinese characteristics's rule of law principle

The rule of law in Socialism with Chinese characteristics must adhere to five principles.

1, adhere to the leadership of China * * * production party;

2. Adhere to the people's dominant position;

3. Adhere to equality before the law;

4. Adhere to the combination of ruling the country by law and ruling the country by virtue;

5, adhere to the reality of China.

1. The leadership of the Party is the most essential feature of Socialism with Chinese characteristics and the most fundamental guarantee of socialist rule of law;

2. Implementing the Party's leadership in the whole process and all aspects of governing the country according to law is the basic experience in the construction of socialist rule of law in China;

3. The Constitution of China established the leading position of China's * * * production party. Adhering to the party's leadership is the fundamental requirement of socialist rule of law and the proper meaning of comprehensively promoting the rule of law;

4. The leadership of the Party is consistent with the socialist rule of law. Only under the leadership of the party, governing the country according to law and implementing the rule of law can the people be masters of their own affairs and the rule of law in national and social life be promoted in an orderly manner.

Legal basis: Article 5 of the Constitution of People's Republic of China (PRC).

People's Republic of China (PRC) governs the country according to law and builds a socialist country ruled by law. The state maintains the unity and dignity of the socialist legal system. All laws, administrative regulations and local regulations shall not contravene the Constitution. All state organs and armed forces, political parties, social organizations, enterprises and institutions must abide by the Constitution and laws. All violations of the Constitution and laws must be investigated. No organization or individual may have privileges beyond the Constitution and laws.
