Provisions on the Administration of Official Document Delivery of State Organs

Legal analysis: all units send official documents through postal enterprises, and may not send official documents to express delivery enterprises; Postal confidential communication shall be used for mailing confidential official documents. Under special circumstances, confidential documents shall not be sent to individuals in principle. Non-confidential official documents can be delivered through postal channels such as express mail, express parcel and registered letter.

Legal basis: Article 55 of the Postal Law of People's Republic of China (PRC). Express delivery enterprises shall not engage in the mail delivery business monopolized by postal enterprises, and shall not deliver official documents of state organs.

Article 25 of the Law of People's Republic of China (PRC) on Guarding State Secrets, organs and units shall strengthen the management of state secret carriers, and no organization or individual may commit any of the following acts: (1) illegally acquiring or holding state secret carriers; (2) buying, selling, transferring or destroying state secret carriers without permission; (3) transmitting the carrier of state secrets through ordinary postal service, express delivery and other channels without taking security measures; (four) leaving the country by mail or consignment of state secret carriers; (5) Carrying or transmitting state secret carriers out of the country without the approval of the relevant competent authorities.
