Regulations on the Protection of Historical and Cultural Heritage in Wuxi City

Chapter I General Provisions Article 1 In order to strengthen the protection of historical and cultural heritage, inheritance and carry forward the excellent historical culture, according to the "People's Republic of China *** and the State Cultural Relics Protection Law", the State Council, "Regulations on the Protection of Famous Historical and Cultural Cities and Towns and Villages," "Jiangsu Province, the protection of intangible cultural heritage regulations," and other laws and regulations, in conjunction with the actual situation of the city, the enactment of these regulations. Article 2 The protection and utilization of historical and cultural heritage within the administrative area of the city and its related management activities, the application of these regulations. Article 3 The historical and cultural heritage referred to in these regulations includes tangible and intangible cultural heritage.

Tangible cultural heritage refers to historical remains with historical, artistic and scientific value, which are preserved in material form.

The intangible cultural heritage refers to all kinds of traditional cultural expressions that exist in an immaterial form, are closely related to the life of the masses, and are inherited from generation to generation. Article 4 The protection of historical and cultural heritage shall adhere to the government-led, strengthen management, protection-oriented, rescue first, rational utilization, inheritance and development of the principle of correctly addressing the relationship between economic and social development and the protection of historical and cultural heritage. Article 5 municipal, county-level cities, district people's governments shall unify leadership, coordination of the administrative region of the protection of historical and cultural heritage, the protection of historical and cultural heritage objectives and requirements into the leadership at all levels of responsibility system to be assessed.

The cultural (cultural relics) administrative department shall be in charge of the protection and utilization of the historical and cultural heritage in the administrative area and the supervision and management work.

The competent department of urban and rural planning is responsible for the planning and management of historical and cultural neighborhoods, historical and cultural towns and villages, and historical buildings within the administrative area and related work.

Development and reform, construction, land, public security, housing management, industry and commerce, gardening, tourism and other relevant administrative departments, shall, in accordance with their respective responsibilities, *** with the protection of historical and cultural heritage of the relevant work. Article 6 The funds for the protection of historical and cultural heritage shall be raised by the people's governments of cities, counties and districts through the following channels:

(1) the annual financial budget;

(2) the business and operational revenues gained from the utilization of the historical and cultural heritage;

(3) the donations from all walks of life;

(4) other lawful sources. Article 7 Any unit or individual has the obligation to protect the historical and cultural heritage in accordance with law, and has the right to dissuade, report and accuse the behavior of destroying or damaging the historical and cultural heritage.

The people's governments of cities, counties and districts, or the administrative departments of culture (cultural relics) shall commend and reward units and individuals who have made outstanding contributions to the protection and management of historical and cultural heritage. Chapter II Historical and Cultural Neighborhoods and Historical and Cultural Townships and Villages Article 8 The declaration of municipal and county-level historical and cultural townships and villages shall be submitted by the local people's government, and the competent department of urban and rural planning of the municipal and county-level cities, in conjunction with the administrative department of culture (cultural relics), shall organize the relevant departments and experts to conduct the argumentation and put forward the examination opinions, and report to the people's government of the municipal and county-level cities for approval and publication.

The declaration of national and provincial historical and cultural towns and villages shall be carried out in accordance with the relevant laws and regulations. Article 9 The people's governments of cities and counties shall promptly organize the competent departments of urban and rural planning and the administrative departments of culture (cultural relics) to prepare protection plans and delineate the scope of protection of historical and cultural districts, towns and villages after they have been determined or approved for publication.

The people's governments of the districts or towns where the historical and cultural neighborhoods, towns and villages are located shall, in accordance with the approved protection plan, prepare detailed construction plans and implementation plans. Municipal, county-level city urban and rural planning departments shall, in conjunction with the cultural (cultural relics) administrative departments to organize experts on the construction of detailed planning and implementation of the program for demonstration, and reported to the municipal, county-level people's government for approval in a timely manner to the community. Article 10 in the historical and cultural neighborhoods, towns and villages engaged in construction activities, must comply with the requirements of the historical and cultural neighborhoods, towns and villages protection planning.

In the historical and cultural neighborhoods, towns and villages within the core protection of new construction, expansion of infrastructure and public **** service facilities, the competent department of urban and rural planning in the approval of the administrative departments of culture (cultural relics) should be consulted before. Article 11 Historical and cultural neighborhoods, towns and villages, according to the approved protection plan, detailed construction planning and implementation of the program, it is necessary to implement the relocation of housing and other facilities of the property owner or user, in accordance with the relevant provisions of the implementation. Article XIII of the historic and cultural districts, towns and villages within the scope of protection of fire protection facilities, channels, should be set up in accordance with the relevant fire safety technical standards and norms.
