Zhejiang Province, the general provisions of the waterway transportation management regulations

These regulations apply to the province's coastal, rivers, lakes and other navigable waters engaged in waterway transportation and waterway transportation services (collectively referred to as waterway transportation industry) business activities of units and individuals.

The waterway transport referred to in these regulations, including waterway passenger transport and waterway cargo transport; waterway transport services, including waterway passenger and freight station operation, shipping agency, passenger and freight forwarding agents and ship management. People's governments at or above the county level, the traffic administration is responsible for the organization of the administrative area.

Port and shipping management agencies at or above the county level is responsible for the specific implementation of the waterway transport industry management.

Public security, maritime, economic and trade, industry and commerce, taxation, price, water conservancy, tourism, marine and fisheries and other relevant departments, should be in accordance with their respective responsibilities to do a good job in the waterway transportation industry business activities related to management. Waterway transportation industry to implement unified management, coordinated development, the principle of fair competition.

Waterway transportation and waterway transportation service operators shall operate in accordance with the law, to provide society with safe, convenient, economical, high-quality services.

Waterway transportation and waterway transportation service operators of the legitimate rights and interests of the law shall be protected. People's governments at or above the county level shall incorporate waterway transportation into the national economy and social development plan, support and safeguard the development of waterway transportation.

The traffic administration departments at or above the county level shall, in accordance with the needs of the national economy and social development, the preparation of waterway transportation industry development plan, with the consent of the higher level of traffic administration departments, reported to the people's government at the same level for approval and implementation. Waterway transport industry business activities by the port and navigation management agencies to implement industry management.

Port and shipping agencies should be engaged in waterway transportation, waterway transportation services business activities to the community. Establishment of waterway transport enterprises shall have the following conditions:

(a) to meet the operational needs and safety management requirements of the organization, fixed office space;

(b) management personnel, professional and technical personnel to meet the prescribed requirements;

(c) meet the prescribed standards of operating vessels;

(d) with the operation of the business and the range of (d) have its own capital appropriate to the business and scope of operation;

(e) meet other conditions stipulated by the relevant state enterprise registration and management.

Engaged in waterway passenger transportation business activities, shall determine the stops along the passenger ship. Individual operators engaged in waterway general cargo transportation business activities, shall have the following conditions:

(a) with the prescribed qualifications;

(b) with the prescribed standards of operating vessels;

(c) in accordance with the relevant provisions of the state for liability insurance. Apply to engage in the waterway transportation industry business activities of units or individuals, shall submit a written application to the port and navigation management agencies at or above the county level.

The port and navigation management agency shall make a decision within twenty working days from the date of receipt of the application. Meet the conditions set forth in these Regulations, approval to engage in business activities, issued by the waterway transport license or waterway transport service license; not approved, shall state the reasons in writing.

The specific approval authority for the operation of waterway transport industry within the province, the provincial transport administration shall provide. Obtain a waterway transport license or waterway transport service license units or individuals, certificates to the local administration for industry and commerce to apply for business registration, approved by the receipt of business licenses before opening.

Waterway transport and waterway transport service operators shall, in accordance with the law, tax registration procedures. Waterway passenger transportation, waterway transport of dangerous goods, inland waterway cargo transportation of new capacity, shall gradually implement bidding.

The bidding shall follow the principles of fairness, justice, openness, competition and no compensation. Through the bidding for the right to operate the operator, in the bidding to determine the period should be in accordance with the commitment to provide services.
