Regulations of Hubei Province on Scientific and Technological Progress (revised on 20 16)

Chapter I General Provisions Article 1 In order to promote scientific and technological progress, enhance the ability of independent innovation, accelerate the transformation and industrialization of scientific and technological achievements, and promote the transformation of scientific and educational advantages into economic and social development advantages, these Regulations are formulated in accordance with the Law of People's Republic of China (PRC) on Scientific and Technological Progress and other relevant laws and administrative regulations, and in light of the actual situation of this province. Article 2 These Regulations shall apply to scientific and technological research and development, technological innovation and service, transformation and popularization of achievements, scientific decision-making and management, and promotion and exchange of science and technology within the administrative area of this province. Article 3 Scientific and technological progress shall adhere to the principle of independent innovation, focus on leaping forward, supporting development and leading the future, and build a regional innovation system with provincial characteristics and an innovative Hubei around the implementation of the strategy of rejuvenating Hubei through science and education and building a resource-saving and environment-friendly society. Article 4 The provincial people's government shall lead the work of scientific and technological progress in the whole province, formulate scientific and technological development plans, define scientific and technological development goals, integrate scientific and technological resources, establish and improve the assessment system for promoting scientific and technological progress, and promote the coordination between scientific and technological progress and economic and social development.

The people's governments at or above the county level shall incorporate the work of scientific and technological progress into the national economic and social development plan, establish a coordination mechanism for scientific and technological progress, study major issues in the work of scientific and technological progress, and implement the target responsibility system and assessment system for scientific and technological progress. Article 5 The administrative department of science and technology of the provincial people's government is responsible for the macro-management and comprehensive coordination of the work of scientific and technological progress in the province, studies and puts forward strategies, policies and measures for scientific and technological development, formulates plans for scientific and technological development, formulates and organizes the implementation of special plans for science and technology, manages the work of high-tech industrial development zones in the province, and implements the assessment of scientific and technological progress in conjunction with relevant departments.

The administrative department of science and technology of the people's governments at or above the county level shall be responsible for the work of scientific and technological progress within their respective administrative areas, and other relevant administrative departments shall be responsible for the work of scientific and technological progress within their respective functions and duties. Article 6 The people's governments at or above the county level and their relevant departments shall increase financial investment, implement national taxation and financial policies, formulate and implement industrial and government procurement policies that are compatible with regional economic construction and social development, encourage and guide social capital investment, and promote the sustained and steady growth of scientific and technological research and development funds in the province. Seventh provincial people's government to formulate and implement intellectual property strategy, strengthen the protection of intellectual property rights, create a social environment that respects intellectual property rights, and encourage independent innovation.

Enterprises, institutions and scientific and technological personnel should enhance their awareness of intellectual property rights, enhance their ability of independent innovation and improve their ability to use, protect and manage intellectual property rights. Eighth to encourage organs, enterprises and institutions, social organizations and citizens to actively participate in and support the progress of science and technology, and promote the social fashion of advocating science, respecting talents and daring to innovate.

Actively develop the popularization of science and technology, popularize scientific and technological knowledge, and improve the scientific and cultural quality of citizens. Ninth people's governments at or above the county level shall establish and improve the science and technology award system, and reward organizations and individuals who have made important contributions in scientific and technological progress activities.

Encourage and guide organizations or individuals inside and outside the province to set up science and technology awards in this province to reward scientific and technological progress. Chapter II Scientific and Technological Research and Development and Industrialization of Achievements Article 10 Scientific and technological progress focuses on optoelectronic information, biotechnology, new materials, new energy, advanced manufacturing, modern agriculture, energy conservation and environmental protection, circular economy and high-tech transformation of traditional industries, organizes scientific research, technological development and scientific and technological application activities, accelerates the popularization and application of independent innovative technologies and products, and drives the adjustment of industrial structure and the transformation of development mode. Eleventh people's governments at or above the county level and their relevant departments shall implement the preferential policies of the state and the province, and encourage enterprises, institutions, social organizations and citizens to engage in scientific and technological research and development and scientific and technological application activities such as technology development, technology transfer, technical consultation and technical services. Article 12 People's governments at or above the county level and their relevant departments shall cultivate and develop the technology market, support the construction of service platforms for intellectual property rights, enterprise equity and creditor's rights transactions, encourage the development of science and technology business incubators, productivity promotion centers, venture capital institutions, technology assessment, brokerage and consulting institutions, improve the science and technology service system, and promote the industrialization of scientific and technological achievements. Article 13 The people's governments at or above the county level and their relevant departments shall, according to the needs of national and provincial industrial policies, regional industries and county economic development, build public technical service platforms, and focus on supporting the establishment of public technical service platforms in industrial clusters where small and medium-sized enterprises are concentrated and areas with industrial advantages.

Encourage institutions of higher learning, scientific and technological research and development institutions and enterprises to participate in the construction of public technical service platforms. Article 14 The project undertaker shall legally implement the invention patent right, computer software copyright, integrated circuit layout design right and new plant variety right formed by scientific and technological projects mainly funded by financial funds, and submit an annual report on the implementation and protection to the project management institution; If it meets the implementation conditions and is not implemented within one year without justifiable reasons, the project management institution may implement it free of charge according to law, or may license others to implement it with or without compensation.
