How to divide fields in rural areas?
I. Rural land distribution policy
At present, China's rural land allocation policy is implemented in accordance with the relevant provisions of the Land Management Law and the Rural Land Contract Law.
1. Article 14 of the Land Management Law stipulates that the land collectively owned by farmers shall be contracted by members of this collective economic organization to engage in planting, forestry, animal husbandry and fishery production. The term of contracted operation of land is thirty years. The employer and the contractor shall conclude a contract to stipulate the rights and obligations of both parties. Farmers contracted to manage land have the obligation to protect and rationally use the land according to the purposes agreed in the contract. Farmers' right to contracted management of land is protected by law.
During the term of land contract operation, if the land contracted between individual contractors is properly adjusted, it must be approved by more than two-thirds of the members of the villagers' meeting or more than two-thirds of the villagers' representatives, and reported to the administrative department of agriculture of the township (town) people's government and the people's government at the county level for approval.
2. Article 18 of the Rural Land Contract Law stipulates that land contracting shall follow the following principles:
(a) in accordance with the provisions of the unified organization contract, members of the collective economic organization shall exercise the right to land contract equally according to law and may voluntarily give up the right to land contract;
(2) democratic consultation, fairness and reasonableness;
(3) The contract scheme shall be approved by more than two thirds of the members of the villagers' meeting of the collective economic organization or more than two thirds of the villagers' representatives in accordance with the provisions of Article 12 of this Law;
(4) The signing procedure is legal.
II. 20 17 Regulations on Rural Land Ownership

For resource assets such as land, we should focus on the registration and certification of land contractual management rights; For non-operating assets, focus on exploring an effective mechanism for collective unified management that is conducive to improving the ability to serve the public; For operating assets, the focus is to clarify the ownership of property rights, quantify the conversion of assets into shares to members of collective economic organizations, and develop various forms of stock cooperation. Improve the rural collective "three-capital" management supervision and income distribution system.
As for the pilot reform of rural land system, it has always attracted much attention. The document once again emphasizes three premises: the nature of land public ownership will not change, the red line of cultivated land will not break through, and the interests of farmers will not be damaged. Classified implementation of rural land acquisition, collective management of construction land into the market, homestead system reform pilot.
(2) Implement collective ownership, stabilize farmers' contracting rights and liberalize land management rights.
Implementing collective ownership means implementing the legal provisions that "the real estate and movable property owned by farmers collectively belong to collective members", clearly defining the rights of farmers' collective members, clarifying the ownership of collective land property rights and realizing the clarity of the subject of collective property rights. Stabilizing farmers' contracting rights is to implement the collective land contractual management right to every farmer in the collective organization fairly according to law. Emancipating the right of land management means allowing contracted farmers to voluntarily allocate the right of land management to subjects who are willing and capable of operating according to law and develop various forms of moderate scale operation.
