Regulations on the Protection of Ethnic Cultural Villages in Qiandongnan Miao and Dong Autonomous Prefecture (Revised in 2020)

Chapter I General Provisions Article 1 For the protection and development of ethnic cultural villages, these regulations are formulated in accordance with the provisions of the Law of the People's Republic of China on Urban and Rural Planning and other laws and regulations, and in the light of the actual situation of Qiandongnan Prefecture. Article 2 These Regulations shall apply to the protection and development of ethnic cultural villages within the administrative area of the Autonomous Prefecture. Article 3 The national cultural villages referred to in these regulations refer to the traditional villages listed in the national and provincial lists within the scope of the Autonomous Prefecture, the villages of minority nationalities named by the state and province, as well as other natural villages with well-preserved traditional architectural features expressly protected by the people's governments of the counties (cities). Article 4 The protection and development of national cultural villages follow the principles of protection priority, scientific planning, rational utilization and living heritage. Article 5 The people's governments of states and counties (cities) shall incorporate the protection and development of national cultural villages into their national economic and social development plans, and arrange for funds for the protection of national cultural villages in accordance with local conditions, to be included in the budgets at this level. Article 6 The state people's government and its housing and urban-rural construction administrative department in conjunction with the natural resources, ethnic religion, culture, sports, radio and television tourism administrative department is responsible for the guidance, supervision and planning approval of the protection of ethnic cultural villages in the administrative area.

The people's governments of counties (cities) and their administrative departments of housing and urban-rural construction, together with the administrative departments of natural resources, nationalities and religions, culture, sports, radio and television, and tourism, are responsible for the compilation and implementation of the development plan for the protection of ethnic cultural villages and the management of ethnic cultural villages in the administrative area.

Agriculture and rural areas, ecological and environmental protection, forestry and other relevant departments in accordance with their respective responsibilities, in collaboration with the protection of ethnic cultural villages. Article 7 township people's government is responsible for doing a good job in the area of national culture village protection, management, utilization of specific work. They are responsible for formulating the implementation plan for the protection and development of national cultural villages, organizing the implementation of protection and development projects, and carrying out the governance and rectification of villages; guiding the village (neighborhood) people's committees to set up village protection associations, and formulating the rules and regulations for the protection and development of villages; and guiding the national cultural villages to carry out the production and business activities, such as tourism and traditional handicrafts processing and production. Article 8 The village (neighborhood) people's committee where the national culture village is located shall, in accordance with the provisions of these regulations, set up a village protection association, participate in the preparation and implementation of the national culture village protection and development planning, do a good job in the protection and development of the national culture village and publicity work; organize the conclusion of the village rules and regulations for the protection and development of the national culture village and supervise their implementation; discourage and stop the violation of the provisions and requirements of the protection of the national culture village, and promptly report to the township people's government or the relevant departments for the protection and development of the national culture village. Timely report to the township people's government or relevant departments. Chapter II Protection Planning Article 9 National cultural villages shall be protected on a graded basis. Traditional villages listed on the national list, nationally named minority characteristic villages are classified as first-level protection villages; traditional villages listed on the provincial list, provincial named minority characteristic villages are classified as second-level protection villages; other villages with traditional architectural features are classified as third-level protection villages. Article 10 According to the needs of protection and development, an expansion area can be set up outside the protection scope of the first- and second-level protected villages as a reserved permitted construction area.

Expansion area of the housing construction advocate the use of national architectural elements, to maintain the architectural style and characteristics of national cultural villages. Article 11 The relevant administrative departments of the people's governments of the counties (municipalities) where the national cultural villages are located shall entrust the people's governments at the township level with the organization of the preparation of the protection and development plan for the national cultural villages.

Ethnic cultural villages protection and development planning, including traditional villages, minority character villages, administrative villages and settlements construction planning, should be multiple rules, to avoid duplication of preparation.

Ethnic and cultural villages protection and development planning approved by the people's government of the county (city).

The national culture village protection and development planning approved by law, shall not be modified without authorization. Article XII of the preparation of national culture village protection and development planning, shall fully listen to the views of the village (residents), agreed by the villagers' meeting or the meeting of villagers' representatives, and publicized to the village (residents). Article 13 The preparation or modification of land space planning and other planning, shall reflect the requirements of national culture village protection. Article 14 states, counties (cities) people's governments shall, according to the architectural styles of different ethnic groups and different building volume standards, the preparation of national cultural villages architectural style atlas, for national cultural villages to choose and reference.

The construction, maintenance and repair of buildings and structures in ethnic cultural villages shall conform to the style and standard requirements of the atlas. Chapter III Protection Measures Article 15 The protection of national cultural villages shall maintain and continue the traditional pattern and traditional architectural style, maintain the topography, streets and lanes and other spatial scales, shall not destroy and change its interdependent mountains, water, fields, forests, roads and other humanities and natural landscape environment of the spatial relationship and form, to maintain the solid and living farming culture inheritance.

Newly constructed, reconstructed and repaired buildings or structures, their height, volume, color tone, architectural style should be in line with the requirements of the conservation and development planning, and traditional architectural style and harmony with the original spatial landscape.

The construction, maintenance and repair of buildings in line with the traditional features to give appropriate incentives to support. Article XVI in the first and second level of protection within the village engaged in construction activities, should be used in traditional wood construction and other means to maintain the dry rail, the human character roof, hanging foot, small green tile and other wood structure features, to maintain the mountainous terrain and centralized and continuous residential style.
