Measures for the Preparation and Approval of Protection Planning for Famous Historical and Cultural Cities, Towns, Villages and Neighborhoods

Article 1 In order to regulate the preparation and approval of protection plans for famous historical and cultural cities, towns, villages and neighborhoods, these measures are formulated in accordance with the Law of the People's Republic of China on Urban and Rural Planning and the Regulations on the Protection of Famous Historical and Cultural Cities, Towns and Villages, and other laws and regulations. Article 2 These Measures shall apply to the preparation and approval of protection plans for famous historical and cultural cities, towns, villages and neighborhoods. Article 3 The implementation of protection and management of famous historical and cultural cities, towns, villages and neighborhoods, and construction activities within the scope of protection of famous historical and cultural cities, towns, villages and neighborhoods, and the improvement of infrastructure, public ****service facilities and the living environment, shall be in line with the protection plan. Article 4 The preparation of protection planning, shall maintain and continue the traditional pattern and historical features of historical and cultural cities, towns, villages and neighborhoods, maintain the authenticity and integrity of the historical and cultural heritage, inherit and carry forward the excellent traditional culture of the Chinese nation, and correctly deal with the relationship between economic and social development and the protection of the historical and cultural heritage. Article 5 The protection plan of famous historical and cultural cities and towns shall be prepared separately, and the following contents shall be incorporated into the master plan of the cities and towns:

(1) the protection principles and contents of the protection;

(2) the protection measures, the development intensity and the requirements of construction control;

(3) the requirements of protection of the traditional pattern and historical features;

(4) the core protection scope and the construction control zone;

(5) the protection of the historical cultural heritage; (6) the protection of the historical cultural heritage; and (7) the protection of the historical cultural heritage. control zone;

(v) other contents to be included. Article 6 If the city or county where the historical and cultural district is located has been identified as a famous historical and cultural city, the protection plan of the historical and cultural district shall be prepared separately according to the protection plan of the famous historical and cultural city.

The city or county where the historical and cultural district is located has not been identified as a famous historical and cultural city, the historical and cultural district protection plan shall be prepared separately and incorporated into the city or town master plan. Article 7 The preparation of detailed control plans for famous historical and cultural cities, towns and neighborhoods shall be in line with the protection plans for famous historical and cultural cities, towns and neighborhoods.

The planning depth of the protection plan for historical and cultural neighborhoods shall reach the depth of the detailed planning, and can be used as the detailed controlling plan for the neighborhood.

Historical and cultural cities, towns and neighborhoods within the scope of protection of the planning permission for construction projects, shall not violate the historical and cultural cities, towns and neighborhoods protection planning. Article 8 after the approval of the announcement of the historical and cultural city, the people's government of the historical and cultural city shall organize the preparation of historical and cultural city protection planning. After the approval of the announcement of the historical and cultural towns and villages, the people's government at the county level shall organize the preparation of historical and cultural towns and villages protection planning. After the approval of the announcement of the historical and cultural district, the people's government of the city and county shall organize the preparation of historical and cultural district protection planning.

Protection planning shall be completed within one year from the date of approval of the historical and cultural cities, towns, villages and neighborhoods. Article 9 The preparation of the protection plan for the historical and cultural cities, towns and neighborhoods shall be undertaken by the urban and rural planning preparation unit with Class A qualification.

Historical and cultural villages protection planning shall be undertaken by the urban and rural planning units with qualifications of Grade B or above. Article 10 The preparation of protection planning shall comply with the relevant national standards and technical specifications, and use basic information in accordance with the relevant provisions of the state.

Historical and cultural towns, villages, neighborhoods within the core protection area, indeed, because of the need for protection can not be in accordance with the relevant fire safety technical standards and norms for setting up fire fighting facilities and fire escape routes, by the public security organs of the people's government of the city, county fire fighting agencies, in conjunction with the competent departments of the same level of town and countryside planning to develop appropriate fire safety protection program.

Because of the public **** interest needs to carry out construction activities, the historical buildings can not implement in situ protection, must be relocated off-site protection or demolition, shall be by the city, county people's government in charge of urban and rural planning in conjunction with the competent department of cultural relics at the same level, the protection of the people's government of the province, autonomous region, province-level municipality directly under the central government determined by the competent department of cultural relics in conjunction with the competent department of cultural relics approved.

The relevant departments of the local people's governments at or above the county level shall, according to the needs of the preparation of protection planning, timely provision of relevant basic information. Article XI of the preparation of the protection plan, shall be scientifically demonstrated, and widely solicit the views of the relevant departments, experts and the public; if necessary, hearings can be held. Article 12 The protection plan of a famous historical and cultural city shall include the following contents:

(1) assessing the historical and cultural values, characteristics and problems;

(2) determining the overall protection objectives and protection principles, contents and priorities;

(3) proposing the overall protection strategy and the protection requirements for the municipal (county) areas;

(4) delineating the cultural relics protection units, underground cultural relics burial areas, historic buildings, historic and cultural districts of the core protection scope and construction control zone boundaries, and formulate corresponding protection and control measures;

(v) delineate the boundaries of the historic urban area, and put forward the protection measures for the protection of the traditional pattern of the famous city, its historical style, spatial scale, and its interdependent topography and geomorphology, rivers and lakes, water systems, and other natural landscapes and environments;

(vi) describe the (f) describe the artistic features, historical characteristics, construction age, use of historical buildings, numbering of historical buildings, and put forward the content and requirements for the protection and utilization;

(g) put forward the inheritance and promotion of traditional culture, and the protection of intangible cultural heritage and measures;

(h) put forward the planning requirements and measures for perfecting the functions of the city, and improving the infrastructure, public ****services facilities, and the production and living environment Planning requirements and measures;

(ix) put forward display, utilization requirements and measures;

(x) put forward the recent implementation of the protection of content;

(xi) put forward the implementation of the plan to safeguard measures.
