Regulations of Jinan Municipality on the Protection of Historical and Cultural Cities

Chapter I General Provisions Article 1 In order to strengthen the protection of famous historical and cultural cities, inherit excellent historical and cultural heritage and promote the improvement of living environment and urban cultural quality, these Regulations are formulated in accordance with the Urban and Rural Planning Law of People's Republic of China (PRC), the Cultural Relics Protection Law of People's Republic of China (PRC), the Urban Planning Law of People's Republic of China (PRC), the Urban Planning Law of People's Republic of China (PRC), the Urban Planning Law of People's Republic of China (PRC) and the Urban Planning Law of People's Republic of China (PRC). "Regulations on the Protection of Famous Historical and Cultural Cities, Towns and Villages" and "Regulations on the Protection of Famous Historical and Cultural Cities, Towns and Villages in Shandong Province", combined with the actual situation of this Municipality. Article 2 These Regulations shall apply to the protection, supervision and administration of historical and cultural cities within the administrative area of this Municipality. Article 3 The protection of historical and cultural cities shall follow the principles of giving priority to protection, scientific planning, legal management and rational utilization, continue the traditional pattern, historical features and urban context of historical and cultural cities, and safeguard the authenticity and integrity of historical and cultural heritage. Article 4 The Municipal People's Government shall be responsible for the protection, supervision and management of historical and cultural cities in this Municipality, establish a joint conference system for the protection of historical and cultural cities, and set up an expert review committee for the protection of historical and cultural cities to coordinate and solve major problems in the work.

County (District) people's government is responsible for the protection, supervision and management of historical and cultural cities within its jurisdiction.

The town people's government and sub-district offices shall assist in the protection, supervision and management of historical and cultural cities.

Village (neighborhood) committees shall cooperate with the relevant work of protecting historical and cultural cities. Article 5 The municipal housing and urban-rural construction department shall, jointly with the departments in charge of natural resources, planning and cultural relics, be responsible for the protection, supervision and management of historical and cultural cities, towns and villages, historical and cultural blocks and historical buildings.

The municipal competent department of natural resources and planning is responsible for the planning and management of historical and cultural cities, historical and cultural blocks, traditional scenic spots and historical buildings, and guides the preparation of protection plans for historical and cultural towns, villages and traditional villages.

The municipal cultural relics department is responsible for guiding the protection, supervision and management of immovable cultural relics and underground cultural relics protection areas in historical and cultural cities, towns, villages, historical and cultural blocks and traditional style areas.

The municipal competent department of urban and rural water affairs is responsible for the protection, planning, organization, implementation, supervision and management of water bodies, famous springs, spring cultural landscapes and spring areas.

City landscaping and forestry greening departments are responsible for the protection, supervision and management of nature reserves, natural parks and ancient and famous trees.

The civil affairs department is responsible for the protection, supervision and management of traditional place names.

Development and reform, industry and information technology, public security, finance, ecological environment, urban management, transportation, agriculture and rural areas, commerce, culture and tourism, emergency management, state-owned assets supervision, market supervision, civil air defense, administrative examination and approval services, ethnic and religious, comprehensive administrative law enforcement and other relevant departments shall, according to their respective functions and duties, do a good job in the protection of historical and cultural cities. Article 6 The municipal competent department of natural resources and planning shall be responsible for organizing relevant experts to demonstrate matters such as protection planning, protection list and important protection measures within the historical city area of famous historical and cultural cities, and provide professional technical support for administrative decision-making. Seventh city and county (District) people's governments shall incorporate the protection of historical and cultural cities into the national economic and social development plan at the corresponding level, and the funds needed for the protection of historical and cultural cities shall be included in the fiscal budget at the corresponding level to ensure investment.

The funds for the protection of historical and cultural cities are used for census, mapping, identification, emergency rescue, planning, repair, subsidies, awards, academic research, etc. Eighth city and county (District) people's governments and their relevant departments shall organize publicity and education activities for the protection of historical and cultural cities, popularize protection knowledge and enhance public awareness of protection. Encourage the establishment of a volunteer service team for the protection of historical and cultural cities, and guide the public to participate in the protection and publicity of historical and cultural cities. Ninth city and county (District) people's governments and their relevant departments shall, in accordance with the relevant provisions of the state, commend and reward the units and individuals that have made outstanding contributions in the protection of historical and cultural cities. Tenth any unit or individual has the right to complain and report violations of laws and regulations on the protection of historical and cultural cities. The relevant departments shall promptly accept complaints and reports, and organize verification and handling. Chapter II Scope of Protection Article 11 The protection objects of Jinan's famous historical and cultural city include:

(a) the natural pattern and traditional features of the historical city;

(two) the ancient city, Weizihao reserve, commercial port area;

(3) Historical and cultural blocks and traditional areas;

(4) Famous historical and cultural towns, villages and traditional villages;

(5) Historical buildings;

(six) immovable cultural relics, underground cultural relics protection areas, famous springs, famous mountains, wetlands, ancient and famous trees, traditional place names, industrial heritage and protected objects stipulated by laws and regulations.

Involving the protection of immovable cultural relics, underground cultural relics protection areas, famous springs, famous mountains, wetlands, ancient and famous trees, traditional place names, industrial heritage, etc. Where laws and regulations provide otherwise, such provisions shall prevail. Article 12 The Municipal People's Government shall establish a list system for the protection of historical and cultural cities.

The protected objects approved or announced by the State Council and the people's governments of provinces, cities and counties are directly listed in the protection list.

Other protected objects determined by the people's governments of cities and counties shall be demonstrated by experts organized by the competent departments of natural resources and planning, housing and urban and rural construction, and cultural relics. , confirmed and announced by the people's government at the same level, included in the protection list.
