Decision of the Xi'an Municipal People's Government on Amending and Repealing Some Government Regulations (2017)

I. Modification of Some Provisions of 53 Government Regulations

(I) Implementing Measures for Funeral Management of Xi'an Municipality (Issued by Xi'an Municipal People's Government on March 5, 1990) Amended according to the Decision of Xi'an Municipal People's Government on Amending the Implementing Measures for Funeral Management of Xi'an Municipality on April 20, 2000 Amended according to the Decision of Xi'an Municipal People's Government on Amending the Implementing Measures for Funeral Management of Xi'an Municipality on August 15, 2004) Amended by the Decision on Amending the Implementing Measures for Funeral Management of Xi'an Municipality" of the Xi'an Municipal People's Government on the Decision on Amending and Abolishing Part of the Governmental Regulations, dated January 27, 2014)

1. management, transportation, and land".

2. Revising the first paragraph of Article 4 to read: "Designating Beilin District, Xincheng District, Lianhu District, Baqiao District, Yanta District, Weiyang District, Yanliang District, Lintong District, Chang'an District, Gaoling District, and Pangguang and Caotang Towns in Shuangyi District as the city's cremation areas."

Amending the second paragraph to read, "The cremation zones in Lantian and Zhouzhi counties shall be designated by the people's governments of the counties in accordance with the specific conditions of the counties."

3. Delete the word "township" from Article 8, and amend the phrase "foreign affairs, overseas Chinese affairs and other administrative departments" to "foreign affairs and overseas Chinese affairs administrative departments".

4. Article 9 was amended to read: "cremated remains before the funeral service must check the death certificate issued by the relevant departments, the death in the hospital, the hospital issued a certificate; unnatural deaths, by the public security department issued a certificate; residents (villagers) at home, the death of the community hospitals or township hospitals issued a certificate. "

5. Article 16 was amended to read: "In cemeteries, public cemeteries for the burial of ashes in a single grave or double burial tomb area shall not exceed 1 square meters; buried remains of a single grave area shall not exceed 4 square meters, double burial tomb shall not exceed 6 square meters.

"The term of use of cemetery graves and ash storage compartments shall be 20 years. Those who need to continue to keep them at the expiration of the period shall apply for an extension of use."

6. The word "land" in Articles 19 and 21 shall be amended to "national land".

(2) Provisions on Giving and Accepting Gifts in Foreign Official Business (Issued by the People's Government of the Municipality of Xi'an on April 5, 1994 Amended in accordance with the Decision of the People's Government of the Municipality of Xi'an on Amending the "Interim Measures for the Management of the Industry Coordination of the Municipality of Xi'an's Labor Insurance Fund for the Construction Industry," etc., 55 Regulations, dated November 3, 2010)

To amend the first paragraph of Article 10 and the second paragraph of Article 11 to read "land" instead of "land". In Article 11, "the Foreign Affairs Office of the Municipal People's Government" is amended to "the Foreign Affairs and Overseas Chinese Affairs Office of the Municipal People's Government".

(3) Xi'an Municipal Construction Labor Insurance Fund Industry Coordination and Management Measures (issued by the Xi'an Municipal People's Government on May 4, 1994) was amended by the Decision of the Xi'an Municipal People's Government on Amending the Interim Measures for Industry Coordination and Management of the Xi'an Municipal Construction Labor Insurance Fund of November 22, 1999 and by the Decision of the Xi'an Municipal People's Government on Amending the Interim Measures for Industry Coordination and Management of the Xi'an Construction Labor Insurance Fund of November 3, 2010) was amended to read Decision on Amending the Interim Measures for the Administration of Industry Coordination of the Labor Insurance Fund for the Construction Industry of Xi'an Municipality and 55 Other Regulations," amended by the Decision of the Xi'an Municipal People's Government on Amending and Abolishing Part of the Government Regulations, dated January 27, 2014)

1. " shall be amended to "counties under the jurisdiction of the city (including Yanliang District, Chang'an District, Lintong District, Gaoling District and Shuangyi District, the same hereinafter)".

2. Revise Article 7 to read: "The co-ordinating agency shall sign a contract with the construction unit that pays the labor insurance co-ordination fund. Before the commencement of construction procedures for the project, in accordance with the provisions of the one-time pre-collection of labor insurance fees payable. The labor insurance fees shall be liquidated before the completion of the construction project is filed, and the overpayment shall be refunded and the underpayment shall be made up."

3. Article 9, paragraph 4 was amended to read: "the implementation of general subcontracting of the project, its labor insurance co-ordination fund by the co-ordinating body directly allocated to the general contracting unit, subcontracting units should be entitled to the labor insurance fund by the general contracting unit according to subcontracting project valuation accounted for by the general contracting unit of the total value of the proportion of the total contracting project from the total amount of its labor insurance fund allocated."

4. Article 10 shall be amended as follows: "The payment items of the labor insurance fund shall be as follows:

"(1) Construction enterprises shall pay the social pension insurance premiums for employees (including migrant workers) and pay the expenses for the retirement of retired persons;

"(2) streamlining in the 1960s employees' living allowance, survivors' living hardship allowance, and living allowance for employees in difficulty;

"(iii) the work expenses of the coordinating agencies and other expenses charged to the Labor Insurance Fund as stipulated."

5. Article 11 is deleted.

6. Article 21 shall be replaced by Article 20, in which "Xi'an Municipal Commission of Urban and Rural Construction" shall be amended to "Municipal Construction Administration".

(4) Interim Measures for the Management of Comprehensive Urban Construction and Development Projects of Xi'an Municipality (Issued by the People's Government of Xi'an Municipality on April 25, 1996) Amended by the Decision of the People's Government of Xi'an Municipality on the Revision of "Interim Measures for the Management of Comprehensive Urban Construction and Development Projects of Xi'an Municipality" on November 22, 1999
